1 3 #1. Page 3, by inserting after line 8 the
1 4 following:
1 5 "Sec. ___. NEW SECTION. 321.178A DRIVER
1 6 EDUCATION TEACHING PARENT.
1 7 1. TEACHING PARENT QUALIFICATIONS. As an
1 8 alternative to section 321.178, a teaching parent may
1 9 instruct a student in driver's education courses which
1 10 meet the requirements of this section, and provides
1 11 certified evidence that the requirements under this
1 12 section have been met.
1 13 2. DEFINITIONS. For purposes of this section:
1 14 a. "Student" means a person within the custody and
1 15 control of the teaching parent, who is between the
1 16 ages of fourteen and twenty-one years of age and who
1 17 satisfies preliminary licensing requirements of the
1 18 department.
1 19 b. "Teaching parent" means a person who is the
1 20 parent or guardian of a student, who holds a current
1 21 valid Iowa license to operate a motor vehicle, and who
1 22 is either a person providing competent instruction or
1 23 competent private instruction pursuant to section
1 24 299A.2 or 299A.3.
1 25 3. COURSE OF INSTRUCTION. A driver education
1 26 course administered by a teaching parent shall consist
1 27 at a minimum of the following:
1 28 a. Thirty clock hours of classroom instruction.
1 29 b. Forty hours of street or highway driving
1 30 including four hours of driving after sunset and
1 31 before sunrise while accompanied by a parent or
1 32 guardian.
1 33 c. Four hours of classroom instruction concerning
1 34 substance abuse.
1 35 d. Twenty minutes of instruction concerning
1 36 railroad crossing safety.
1 37 e. Instruction relating to becoming an organ donor
1 38 under the uniform anatomical gift Act.
1 39 The content of the course of instruction required
1 40 under this subsection shall be equivalent to that
1 41 required under section 321.178. However, the course
1 42 requirements, reference and study materials, manuals,
1 43 study aids, workbooks, physical requirements,
1 44 classroom dimensions, type of chalkboards, extra
1 45 vehicle safety equipment, extra foot brake, cut-off
1 46 switches, and extra mirrors required for instruction
1 47 under section 321.178 shall not be required for the
1 48 course of instruction provided under this section.
1 49 4. COURSE COMPLETION AND CERTIFICATION. Upon
1 50 completion of a course under this section, the
2 1 teaching parent shall document or provide evidence
2 2 showing substantial statutory compliance with the
2 3 requirements of subsection 3 and certify by affidavit
2 4 to the department of education that the course has
2 5 been completed. Documentation shall include the
2 6 following:
2 7 a. An affidavit attesting to satisfactory
2 8 completion of course work and street or highway
2 9 driving instruction.
2 10 b. A listing of subjects presented in classroom
2 11 training.
2 12 c. Copies of written tests completed by the
2 13 student.
2 14 d. A statement of the number of classroom hours of
2 15 instruction.
2 16 e. A log of street or highway driving instruction
2 17 including the dates when the lessons were conducted,
2 18 the student's and the parent's name and initials noted
2 19 next to each entry, notes on driving activities,
2 20 including a list of driving deficiencies and
2 21 improvements, and the duration of the driving time for
2 22 each session. If the department of education is
2 23 satisfied that the course has been completed in
2 24 accordance with this section, the department shall
2 25 certify it as an approved driver's education course.
2 26 5. INTERMEDIATE LICENSE. Any student who
2 27 successfully completes an approved driver education
2 28 course as provided in this section and who passes a
2 29 driving skills test to be administered by the
2 30 department and is otherwise qualified under section
2 31 321.180B, subsection 2, shall be eligible for an
2 32 intermediate license pursuant to section 321.180B.
2 33 Such a student is not required to file an affidavit
2 34 with the department regarding completion of street or
2 35 highway driving with a parent or guardian under
2 36 section 321.180B, subsection 2, and the hours of
2 37 driving required under subsection 3 shall substitute
2 38 for any hours of driving required under section
2 39 321.180B, subsection 2.
2 40 6. FULL LICENSE. A student must comply with
2 41 section 321.180B, subsection 4, to be eligible for a
2 42 full driver's license pursuant to section 321.180B."
