PAG LIN 1 1 Amend Senate File 2281 as follows: 1 2 #1. By striking page 1, line 31, through page 2, 1 3 line 25, and inserting the following: 1 4 "4. The state public defenderis authorized to1 5review any claim made for payment of indigent defense1 6costs and to take the following action if the state1 7public defender believes a claim is excessive:1 8a. If the claim is from a noncontract attorney,1 9the state public defender shall request a review by1 10the court granting the claim as to the reasonableness1 11of the claim within thirty days of receipt of the1 12claim.1 13b. If the claim is from a contract attorney, the1 14state public defender shall request a review by the1 15appointing court as to the reasonableness of the claim1 16within thirty days of receipt of the claimshall 1 17 establish hourly rates of compensation to be paid to 1 18 court-appointed counsel, and shall establish fee 1 19 limitations for particular categories of cases. The 1 20 hourly rates and fee limitations shall be reviewed at 1 21 least every three years. 1 22 5. The state public defender shall establish an 1 23 expedited procedure for court-appointed counsel to 1 24 request advance approval for anticipated compensation 1 25 in excess of any fee limitation. In determining 1 26 whether a request should be granted, the state public 1 27 defender shall consider whether the anticipated 1 28 services are necessary and reasonable. The state 1 29 public defender shall not require disclosure by the 1 30 attorney of any information which is not subject to 1 31 discovery under applicable law. Actions of the state 1 32 public defender with regard to requests for advance 1 33 approval for anticipated compensation in excess of any 1 34 fee limitation shall be deemed final agency action. 1 35 Notwithstanding chapter 17A, an attorney whose 1 36 request for approval is denied may seek an expedited 1 37 review of the denial by the appointing court, in 1 38 accordance with rules adopted by the state public 1 39 defender regarding procedure and conduct of review of 1 40 denials of requests. The type of review and relief 1 41 the court may provide shall be limited to the review 1 42 and relief specified in section 17A.19. The review 1 43 hearing shall be conducted on an expedited basis, in 1 44 the manner specified in rules promulgated by the 1 45 court. 1 46 6. The state public defender shall establish a 1 47 procedure for the submission of all claims for payment 1 48 of indigent defense fees and costs, including the 1 49 submission of interim claims in appropriate cases. 1 50 The state public defender shall review any claim made 2 1 for payment and shall pay all appropriate and 2 2 reasonable charges. If any portion of a claim is 2 3 excessive or not payable under the attorney's 2 4 appointment, the state public defender may deny that 2 5 portion of the claim. Actions of the state public 2 6 defender in approving, denying, or modifying claims 2 7 shall be deemed final agency action. 2 8 Notwithstanding the venue restrictions contained in 2 9 section 17A.19, the appointing court may hear 2 10 proceedings for judicial review of the actions of the 2 11 state public defender in approving, denying, or 2 12 modifying claims for compensation." 2 13 #2. Page 3, by inserting after line 4 the 2 14 following: 2 15 "Sec. ___. Section 13B.9, subsection 1, paragraph 2 16 b, Code 1997, is amended to read as follows: 2 17 b. Represent an indigent party, without fee and 2 18 upon an order of the court, in child in need of 2 19 assistance, family in need of assistance, delinquency, 2 20 and termination of parental rights proceedings 2 21 pursuant to chapter 232 in a county served by a public 2 22 defender. The local public defender shall counsel and 2 23 represent an indigent party in all proceedings 2 24 pursuant to chapter 232 in a county served by a public 2 25 defender and prosecute before or after judgment any 2 26 appeals or other remedies which the local public 2 27 defender considers to be in the interest of justice 2 28 unless other counsel is appointed to the case.The2 29state public defender shall be reimbursed by the2 30counties for services rendered by employees of the2 31local public defenders' offices under this subsection,2 32pursuant to section 232.141." 2 33 #3. Page 3, by inserting after line 4 the 2 34 following: 2 35 "Sec. ___. Section 13B.8, subsection 2, Code 1997, 2 36 is amended to read as follows: 2 37 2. a. The state public defender may appoint a 2 38 local public defender and may remove the local public 2 39 defender for cause. The local public defender must be 2 40 an attorney admitted to the practice of law before the 2 41 Iowa supreme court. 2 42 b. The state public defender may appoint assistant 2 43 local public defenders, clerks, investigators, 2 44 secretaries, and other employees. An assistant local 2 45 public defender must be an attorney licensed to 2 46 practice before the Iowa supreme court and may not 2 47 engage in the private practice of law." 2 48 #4. Page 3, by inserting after line 6 the 2 49 following: 2 50 "Sec. ___. Section 13B.9, subsection 3, Code 1997, 3 1 is amended by striking the subsection." 3 2 #5. Page 3, by inserting after line 8 the 3 3 following: 3 4 "Sec. ___. Section 124.407, unnumbered paragraphs 3 5 2 and 7, Code 1997, are amended by striking the 3 6 unnumbered paragraphs." 3 7 #6. Page 3, by inserting after line 35 the 3 8 following: 3 9 "Sec. ___. Section 232.141, subsections 2 and 3, 3 10 Code Supplement 1997, are amended to read as follows: 3 11 2. Upon certification of the court, all of the 3 12 following expenses are a charge upon the county in 3 13 which the proceedings are held, to the extent provided 3 14 in subsection 3: 3 15 a. The fees and mileage of witnesses and the 3 16 expenses of officers serving notices and subpoenas 3 17 incurred by an attorney appointed by the court to 3 18 serve as counsel or guardian ad litem. 3 19 b. Reasonable compensation for an attorney 3 20 appointed by the court to serve as counsel or guardian 3 21 ad litem. 3 22 3. Costs incurred under subsection 2 shall be paid 3 23 as follows: 3 24 a.AFor each fiscal year, a county shall be 3 25required to payliable forthe fiscal year beginning3 26July 1, 1989,an amount equal to the county's base 3 27 cost for witness and mileage fees and attorney fees 3 28established pursuant to section 232.141, subsection 8,3 29paragraph "d", Code 1989, for the fiscal year3 30beginning July 1, 1988, plus an amount equal to the3 31percentage rate of change in the consumer price index3 32as tabulated by the federal bureau of labor statistics3 33for the current year times the county's base costA 3 34 county's base cost shall be the amount a county was 3 35 required to pay pursuant to section 232.141, 3 36 subsection 3, Code 1997, for the fiscal year beginning 3 37 July 1, 1997, and ending June 30, 1998, in accordance 3 38 with the schedule contained in this Act. The payment 3 39 of the county's base cost shall be made through an 3 40 offset of the county allocation as provided in section 3 41 405A.4. 3 42b. A county's base cost for a fiscal year plus the3 43percentage rate of change amount as computed in3 44paragraph "a" is the county's base cost for the3 45succeeding fiscal year. The amount to be paid in the3 46succeeding year by the county shall be computed as3 47provided in paragraph "a".3 48c.b. Costs incurred under subsection 2,which are3 49not paid by the county under paragraphs "a" and "b"3 50 shall bereimbursedpaid by the state.Reimbursement4 1 Payment for the costs of compensation of an attorney 4 2 appointed by the court to serve as counsel or guardian 4 3 ad litem shall be made as provided in section 815.7. 4 4 Acountyperson eligible for payment by the state 4 5 shall apply forreimbursement to the department of4 6inspections and appeals which shall prescribe rules4 7and forms to implement this subsectionpayment as 4 8 provided in section 815.10. 4 9 Sec. ___. Section 237.20, subsection 4, paragraph 4 10 e, Code Supplement 1997, is amended to read as 4 11 follows: 4 12 e. The guardian ad litem of the foster child.The4 13 An attorney appointed as guardian ad litem shall be 4 14 eligible for compensation through section 232.141, 4 15 subsection1, paragraph "b"2. 4 16 Sec. ___. Section 405A.4, subsection 1, Code 1997, 4 17 is amended by adding the following new paragraph: 4 18 NEW PARAGRAPH. d. A deduction of the amount of 4 19 the county's liability for juvenile court proceedings 4 20 pursuant to section 232.141." 4 21 #7. Page 5, line 20, by inserting before the word 4 22 "experience" the following: "qualifications and". 4 23 #8. Page 6, line 12, by striking the word 4 24 "reasonable" and inserting the following: 4 25 "reasonable". 4 26 #9. Page 6, line 25, by striking the words "The 4 27 noncontract" and inserting the following: "The 4 28 expenses shall include any sum or sums as may be 4 29 necessary for investigation in the interests of 4 30 justice and, in the event of any appeal, the cost of 4 31 obtaining the transcript of the trial and the printing 4 32 of the trial record and necessary briefs. An". 4 33 #10. Page 6, by striking lines 26 and 27 and 4 34 inserting the following: "follow the case into 4 35 another county or into the appellate court unlessso4 36 directed to do so by the courtat the request of the". 4 37 #11. Page 6, line 30, by inserting after the word 4 38 "accordingly." the following: "If the attorney 4 39 follows the case into another county or into appellate 4 40 court, the attorney shall be entitled to compensation 4 41 as provided in this section." 4 42 #12. By striking page 9, line 30, through page 10, 4 43 line 5, and inserting the following: "receiving the 4 44 legal assistance within ten days of the court's ruling 4 45 in the case, or if the case is dismissed, within ten 4 46 days of the dismissal. 4 47 6. An appointed attorney shall submit a report 4 48 pertaining to the costs and fees accrued to date for 4 49 legal assistance to the court at the times specified 4 50 in subsections 4 and 5. If the appointed attorney is 5 1 a public defender, the report shall specify the hours 5 2 of services plus other expenses. If the appointed 5 3 attorney is a private attorney, the report shall 5 4 specify the hours of service and the amount of fees 5 5 claimed by the attorney plus other expenses. An 5 6 appointed attorney shall submit a supplemental report 5 7 for any fees and expenses accrued after the times 5 8 specified in subsections 4 and 5." 5 9 #13.
