1 1 Amend the House amendment, S-3466, to Senate File
1 2 503, as amended, passed, and reprinted by the Senate,
1 3 as follows:
1 4 #1. By striking page 1, line 28, through page 2,
1 5 line 48, and inserting the following:
1 6 "Sec. ___. NEW SECTION. 728.5A PHYSICAL CONTACT
1 7 IN CERTAIN NUDE PERFORMANCES OR ACTIVITIES.
1 8 1. An owner, manager, or person who exercises
1 9 direct control over a place of business required to
1 10 obtain a sales tax permit commits a serious
1 11 misdemeanor if the person allows a patron of the
1 12 business and an employee or performer to physically
1 13 touch or fondle one another at the place of business
1 14 under any of the following circumstances:
1 15 a. The employee or performer is engaged in the
1 16 actual or simulated public performance of any sex act
1 17 upon the premises of or in the place of business.
1 18 b. The employee or performer exposes the person's
1 19 genitals or buttocks or female breast while the
1 20 employee or performer acts as a waiter or waitress at
1 21 the place of business.
1 22 c. The employee or performer exposes the person's
1 23 genitals or female breast nipple while acting as an
1 24 entertainer, whether or not the owner of the place of
1 25 business in which the activity is performed employs or
1 26 pays any compensation to the employee or performer for
1 27 the performance of the activity.
1 28 d. The owner, manager, or person who exercises
1 29 direct control over the place of business allows or
1 30 permits any employee or performer to remain in or upon
1 31 the premises of the place of business if the person
1 32 exposes to public view the person's genitals, pubic
1 33 hair, or anus.
1 34 2. An owner, manager, or person who exercises
1 35 direct control over a place of business required to
1 36 obtain a sales tax permit commits an aggravated
1 37 misdemeanor if the person allows or permits a minor to
1 38 engage in or otherwise perform in a live act intended
1 39 to arouse or satisfy the sexual desires or appeal to
1 40 the purient interests of patrons and allows a patron
1 41 and the minor to physically touch or fondle one
1 42 another.
1 43 3. This section shall not apply to a theater,
1 44 concert hall, art center, museum, or similar
1 45 establishment which is primarily devoted to the arts
1 46 or theatrical performances and in which any of the
1 47 circumstances contained in this section were permitted
1 48 or allowed as part of an art exhibit or performance."
