PAG LIN 1 1 Amend the House Amendment S-3466, to Senate File 1 2 503, as amended, passed, and reprinted by the Senate, 1 3 as follows: 1 4 #1. By striking page 1, line 28, through page 2, 1 5 line 48, and inserting the following: 1 6 "Sec. ___. NEW SECTION. 728.5A ADMITTING MINORS 1 7 TO PREMISES WHICH PERMIT CERTAIN NUDE PERFORMANCES OR 1 8 ACTIVITIES. 1 9 1. An owner, manager, or person who exercises 1 10 direct control over a place of business required to 1 11 obtain a sales tax permit commits a serious 1 12 misdemeanor if the person admits or allows a minor to 1 13 enter the business premises and any of the following 1 14 circumstances apply: 1 15 a. The person allows or permits the actual or 1 16 simulated public performance of any sex act upon the 1 17 premises of or in the place of business. 1 18 b. The person allows or permits the exposure of 1 19 the genitals or buttocks or female breast of any 1 20 person who acts as a waiter or waitress at the place 1 21 of business. 1 22 c. The person allows or permits the exposure of 1 23 the genitals or female breast nipple of any person who 1 24 acts as an entertainer, whether or not the owner of 1 25 the place of business in which the activity is 1 26 performed employs or pays any compensation to the 1 27 person for the performance of the activity. 1 28 d. The person allows or permits any person to 1 29 remain in or upon the premises of the place of 1 30 business if the person exposes to public view the 1 31 person's genitals, pubic hair, or anus. 1 32 e. The person advertises that any of the 1 33 activities described in paragraphs "a" through "d" are 1 34 allowed or permitted in the place of business. 1 35 2. An owner, manager, or person who exercises 1 36 direct control over a place of business required to 1 37 obtain a sales tax permit commits a serious 1 38 misdemeanor if the person allows or permits a minor to 1 39 engage in or otherwise perform in a live act intended 1 40 to arouse or satisfy the sexual desires or appeal to 1 41 the purient interests of patrons. However, if the 1 42 person allows or permits a minor to participate in any 1 43 act included in paragraphs "a" through "d", the person 1 44 commits an aggravated misdemeanor. 1 45 3. This section shall not apply to a theater, 1 46 concert hall, art center, museum, or similar 1 47 establishment which is primarily devoted to the arts 1 48 or theatrical performances and in which any of the 1 49 circumstances contained in this section were permitted 1 50 or allowed as part of an art exhibit or performance." 2 1 #2.
