  1  1    Amend House File 702, as amended, passed, and
  1  2 reprinted by the House, as follows:
  1  3    #1.  Page 10, by inserting after line 20 the
  1  4 following:
  1  5    "Sec. 100.  Section 331.439, Code 1997, is amended
  1  6 by adding the following new subsection:
  1  7    NEW SUBSECTION.  8.  A county's management plans
  1  8 submitted under this section shall allow for the
  1  9 service needs of all ages of persons for whom
  1 10 expenditures may be made from the county's services
  1 11 fund.
  1 12    Sec. ___.  EFFECTIVE DATE AND APPLICABILITY
  1 13 PROVISION.  Section 100 of this division of this Act,
  1 14 being deemed of immediate importance, takes effect
  1 15 upon enactment.  The requirements of section 100 shall
  1 16 first apply to county mental health, mental
  1 17 retardation, and developmental disabilities services
  1 18 plans submitted under section 331.439 applicable to
  1 19 the fiscal year beginning July 1, 1997.  If a county's
  1 20 management plan for that fiscal year was submitted
  1 21 prior to the effective date of section 100 and is not
  1 22 in compliance with the provisions of section 100 of
  1 23 this Act, the county shall submit an amendment to the
  1 24 management plan as necessary for compliance.  The
  1 25 amendment shall be submitted within 60 days of the
  1 26 effective date of section 100 and is subject to the
  1 27 approval provisions of section 331.439."

  1 29 word "retardation" the following:  "and including an
  1 30 effective date and an applicability provision".
