  1  1    Amend House File 514, as amended, passed, and
  1  2 reprinted by the House, as follows:
  1  3    #1.  Page 6, by inserting after line 27 the
  1  4 following:
  1  5    "Sec. ___.  Section 321A.1, subsection 10, Code
  1  6 1997, is amended to read as follows:
  1  7    10.  PROOF OF FINANCIAL RESPONSIBILITY.  Proof of
  1  8 ability to respond in damages for liability, on
  1  9 account of accidents occurring subsequent to the
  1 10 effective date of the proof, arising out of the
  1 11 ownership, maintenance, or use of a motor vehicle, in
  1 12 amounts as follows:  With respect to accidents
  1 13 occurring on or after January 1, 1981, and prior to
  1 14 January 1, 1983, the amount of fifteen thousand
  1 15 dollars because of bodily injury to or death of one
  1 16 person in any one accident, and, subject to the limit
  1 17 for one person, the amount of thirty thousand dollars
  1 18 because of bodily injury to or death of two or more
  1 19 persons in any one accident, and the amount of ten
  1 20 thousand dollars because of injury to or destruction
  1 21 of property of others in any one accident; and with
  1 22 respect to accidents occurring on or after January 1,
  1 23 1983, the amount of twenty twenty-five thousand
  1 24 dollars because of bodily injury to or death of one
  1 25 person in any one accident, and, subject to the limit
  1 26 for one person, the amount of forty fifty thousand
  1 27 dollars because of bodily injury to or death of two or
  1 28 more persons in any one accident, and the amount of
  1 29 fifteen twenty-five thousand dollars because of injury
  1 30 to or destruction of property of others in any one
  1 31 accident.
  1 32    Sec. ___.  Section 321A.5, subsection 3, unnumbered
  1 33 paragraph 1, Code 1997, is amended to read as follows:
  1 34    A policy or bond is not effective under this
  1 35 section unless issued by an insurance company or
  1 36 surety company authorized to do business in this
  1 37 state, except that if the motor vehicle was not
  1 38 registered in this state, or was a motor vehicle which
  1 39 was registered elsewhere than in this state at the
  1 40 effective date of the policy or bond, or the most
  1 41 recent renewal thereof of the policy or bond, the
  1 42 policy or bond is not effective under this section
  1 43 unless the insurance company or surety company if not
  1 44 authorized to do business in this state executes a
  1 45 power of attorney authorizing the department to accept
  1 46 service on its behalf of notice or process in any
  1 47 action upon the policy or bond arising out of the
  1 48 accident.  However, with respect to accidents
  1 49 occurring on or after January 1, 1981, and before
  1 50 January 1, 1983, every such policy or bond is subject,
  2  1 if the accident has resulted in bodily injury or
  2  2 death, to a limit, exclusive of interest and costs, of
  2  3 not less than fifteen thousand dollars because of
  2  4 bodily injury to or death of one person in any one
  2  5 accident and, subject to the limit for one person, to
  2  6 a limit of not less than thirty thousand dollars
  2  7 because of bodily injury to or death of two or more
  2  8 persons in any one accident, and, if the accident has
  2  9 resulted in injury to or destruction of property, to a
  2 10 limit of not less than ten thousand dollars because of
  2 11 injury to or destruction of property of others in any
  2 12 one accident; and with respect to accidents occurring
  2 13 on or after January 1, 1983, every such Every policy
  2 14 or bond is subject, if the accident has resulted in
  2 15 bodily injury or death, to a limit, exclusive of
  2 16 interest and costs, of not less than twenty twenty-
  2 17 five thousand dollars because of bodily injury to or
  2 18 death of one person in any one accident and, subject
  2 19 to the limit for one person, to a limit of not less
  2 20 than forty fifty thousand dollars because of bodily
  2 21 injury to or death of two or more persons in any one
  2 22 accident, and, if the accident has resulted in injury
  2 23 to or destruction of property, to a limit of not less
  2 24 than fifteen twenty-five thousand dollars because of
  2 25 injury to or destruction of property of others in any
  2 26 one accident.
  2 27    Sec. ___.  Section 321A.15, subsection 1, Code
  2 28 1997, is amended to read as follows:
  2 29    1.  a.  Judgments referred to in this chapter and
  2 30 rendered upon claims arising from accidents occurring
  2 31 on or after January 1, 1981, and before January 1,
  2 32 1983, shall, for the purpose of this chapter only, be
  2 33 deemed satisfied when the following occur:
  2 34    (1)  When fifteen thousand dollars has been
  2 35 credited upon any judgment or judgments rendered in
  2 36 excess of that amount because of bodily injury to or
  2 37 death of one person as the result of any one accident.
  2 38    (2)  When, subject to the limit of fifteen thousand
  2 39 dollars because of bodily injury to or death of one
  2 40 person, the sum of thirty thousand dollars has been
  2 41 credited upon any judgment or judgments rendered in
  2 42 excess of that amount because of bodily injury to or
  2 43 death of two or more persons as the result of any one
  2 44 accident.
  2 45    (3)  When ten thousand dollars has been credited
  2 46 upon any judgment or judgments rendered in excess of
  2 47 that amount because of injury to or destruction of
  2 48 property of others as a result of any one accident.
  2 49    b.  Judgments referred to in this chapter and
  2 50 rendered upon claims arising from accidents occurring
  3  1 on or after January 1, 1983, shall, for the purpose of
  3  2 this chapter only, be are deemed satisfied when the
  3  3 following occur:
  3  4    (1) a.  When twenty twenty-five thousand dollars
  3  5 has been credited upon any judgment or judgments
  3  6 rendered in excess of that amount because of bodily
  3  7 injury to or death of one person as the result of any
  3  8 one accident.
  3  9    (2) b.  When, subject to the limit of twenty
  3 10 twenty-five thousand dollars because of bodily injury
  3 11 to or death of one person, the sum of forty fifty
  3 12 thousand dollars has been credited upon any judgment
  3 13 or judgments rendered in excess of that amount because
  3 14 of bodily injury to or death of two or more persons as
  3 15 the result of any one accident.
  3 16    (3) c.  When fifteen twenty-five thousand dollars
  3 17 has been credited upon any judgment or judgments
  3 18 rendered in excess of that amount because of injury to
  3 19 or destruction of property of others as a result of
  3 20 any one accident.
  3 21    Sec. ___.  Section 321A.21, subsection 2, paragraph
  3 22 b, Code 1997, is amended to read as follows:
  3 23    b.  Shall insure the person named in the policy and
  3 24 any other person, as insured, using the motor vehicles
  3 25 with the express or implied permission of the named
  3 26 insured, against loss from the liability imposed by
  3 27 law for damages arising out of the ownership,
  3 28 maintenance, or use of the motor vehicles within the
  3 29 United States of America or the Dominion of Canada,
  3 30 subject to limits exclusive of interest and costs,
  3 31 with respect to each such motor vehicle, as follows:
  3 32 With respect to all accidents which occur on or after
  3 33 January 1, 1981, and before January 1, 1983, fifteen
  3 34 thousand dollars because of bodily injury to or death
  3 35 of one person in any one accident and, subject to said
  3 36 limit for one person, thirty thousand dollars because
  3 37 of bodily injury to or death of two or more persons in
  3 38 any one accident, and ten thousand dollars because of
  3 39 injury to or destruction of property of others in any
  3 40 one accident; and with respect to all accidents which
  3 41 occur on or after January 1, 1983, twenty twenty-five
  3 42 thousand dollars because of bodily injury to or death
  3 43 of one person in any one accident and, subject to said
  3 44 limit for one person, forty fifty thousand dollars
  3 45 because of bodily injury to or death of two or more
  3 46 persons in any one accident, and fifteen twenty-five
  3 47 thousand dollars because of injury to or destruction
  3 48 of property of others in any one accident."
