  1  1    Amend House File 557, as amended, passed, and
  1  2 reprinted by the House, as follows:
  1  3    #1.  Page 10, by inserting after line 23 the
  1  4 following:
  1  5    "Sec. ___.  Section 515D.4, subsection 2,
  1  6 unnumbered paragraph 1, Code 1997, is amended to read
  1  7 as follows:
  1  8    Coverage under a policy A person shall not be
  1  9 canceled except by notice to the insured as provided
  1 10 in this chapter.  Notice of cancellation of coverage
  1 11 under a policy is not effective excluded from the
  1 12 policy unless it the exclusion is based on one or more
  1 13 of the following reasons:
  1 14    Sec. ___.  Section 515D.5, Code 1997, is amended to
  1 15 read as follows:
  1 16    515D.5  DELIVERY OF NOTICE.
  1 17    1.  Notwithstanding the provisions of sections
  1 18 515.80 through 515.81A, a notice of cancellation of a
  1 19 policy shall not be effective unless mailed or
  1 20 delivered by the insurer to the named insured at least
  1 21 twenty days prior to the effective date of
  1 22 cancellation, or, where the cancellation is for
  1 23 nonpayment of premium notwithstanding the provisions
  1 24 of sections 515.80 and 515.81A at least ten days prior
  1 25 to the date of cancellation.  A post office department
  1 26 certificate of mailing to the named insured at the
  1 27 address shown in the policy shall be proof of receipt
  1 28 of such mailing.  Unless the reason accompanies the
  1 29 notice of cancellation, the notice shall state that,
  1 30 upon written request of the named insured, mailed or
  1 31 delivered to the insurer not less than fifteen days
  1 32 prior to the date of cancellation, the insurer will
  1 33 state the reason for cancellation, together with
  1 34 notification of the right to a hearing before the
  1 35 commissioner within fifteen days as provided in this
  1 36 chapter.
  1 37    When the reason does not accompany the notice of
  1 38 cancellation, the insurer shall, upon receipt of a
  1 39 timely request by the named insured, state in writing
  1 40 the reason for cancellation.  A statement of reason
  1 41 shall be mailed or delivered to the named insured
  1 42 within five days after receipt of a request.
  1 43    2.  A notice of exclusion of a person under a
  1 44 policy pursuant to section 515D.4, is not effective
  1 45 unless written notice is mailed or delivered to the
  1 46 named insured at least twenty days prior to the
  1 47 effective date of the exclusion.  The written notice
  1 48 shall state the reason for the exclusion, together
  1 49 with notification of the right to a hearing before the
  1 50 commissioner pursuant to section 515D.10 within
  2  1 fifteen days of receipt or delivery of a statement of
  2  2 reason as provided in this section."
