  1  1    Amend Senate File 339 as follows:
  1  2    #1.  By striking everything after the enacting
  1  3 clause and inserting the following:
  1  4    "Section 1.  Section 507A.4, subsection 10, Code
  1  5 1997, is amended to read as follows:
  1  6    10.  a.  Transactions involving a multiple employer
  1  7 welfare arrangement, as defined in section 3 of the
  1  8 federal Employee Retirement Income Security Act of
  1  9 1974, 29 U.S.C. } 1002, paragraph 40, if the multiple
  1 10 employer welfare arrangement meets all of the
  1 11 following conditions:
  1 12    a. (1)  The arrangement is administered by an
  1 13 authorized insurer or an authorized third-party
  1 14 administrator.
  1 15    b. (2)  The arrangement has been in existence and
  1 16 provided health insurance for at least fifteen five
  1 17 years prior to July 1, 1994 1997.
  1 18    c. (3)  The arrangement was established by a trade,
  1 19 industry, or professional association of employers
  1 20 that has a constitution or bylaws, and has been
  1 21 organized and maintained in good faith for at least
  1 22 twenty ten continuous years prior to July 1, 1994
  1 23 1997.
  1 24    (4)  The arrangement registers with and obtains a
  1 25 certificate of registration issued by the commissioner
  1 26 of insurance.
  1 27    (5)  The arrangement is subject to the jurisdiction
  1 28 of the commissioner of insurance, including regulatory
  1 29 oversight and solvency standards as established by
  1 30 rules adopted by the commissioner of insurance
  1 31 pursuant to chapter 17A.
  1 32    b.  A multiple employer welfare arrangement
  1 33 registered with the commissioner of insurance which
  1 34 does not meet the solvency standards established by
  1 35 rule adopted by the commissioner of insurance is
  1 36 subject to chapter 507C.
  1 37    Sec. 2.  1994 Iowa Acts, chapter 1038, section 3,
  1 38 as amended by 1995 Iowa Acts, chapter 33, section 1,
  1 39 and 1996 Iowa Acts, chapter 1024, section 1, is
  1 40 amended to read as follows:
  1 41    SEC. 3.  REPEAL.  This Act is repealed effective
  1 42 July 1, 1997 1998.
  1 43    Sec. 3.  Section 513A.8, Code 1997, is repealed.
  1 44    Sec. 4.  EFFECTIVE DATE.  This Act, being deemed of
  1 45 immediate importance, takes effect upon enactment."
  1 46    #2.  Title page, line 1, by striking the words
