  1  1    Amend Senate File 503 as follows:
  1  2    #1.  Page 1, by inserting after line 25 the
  1  3 following:
  1  4    "Sec.    .  Section 702.11, Code 1997, is amended
  1  5 to read as follows:
  1  6    702.11  FORCIBLE FELONY.
  1  7    A "forcible felony" is any felonious child
  1  8 endangerment, assault, murder, sexual abuse,
  1  9 kidnapping, robbery, arson in the first degree, or
  1 10 burglary in the first degree.  However, sexual abuse
  1 11 in the third degree committed between spouses, sexual
  1 12 abuse in violation of section 709.4, subsection 2,
  1 13 paragraph "c", subparagraph (4), or sexual
  1 14 exploitation by a counselor or therapist in violation
  1 15 of section 709.15, or sexual exploitation by a law
  1 16 enforcement officer in violation of section 709.15A,
  1 17 is not a "forcible felony".
  1 18    Sec.    .  NEW SECTION.  709.15A  SEXUAL
  1 19 EXPLOITATION BY A LAW ENFORCEMENT OFFICER – PENALTY.
  1 20    1.  A law enforcement officer commits a class "D"
  1 21 felony when the officer sexually exploits a person who
  1 22 is the victim of, a suspect in, or a witness to a
  1 23 criminal act or other activity which the officer is
  1 24 investigating or to which the officer is responding.
  1 25    2.  For purposes of this section, "law enforcement
  1 26 officer" means a peace officer employed by the state
  1 27 or a political subdivision of the state.
  1 28    3.  For purposes of this section, "sexually
  1 29 exploits" means engaging in conduct that is for the
  1 30 purpose of arousing or satisfying the sexual desire of
  1 31 the law enforcement officer or other participant and
  1 32 includes but is not limited to kissing; touching of
  1 33 the clothed or unclothed inner thigh, breast, groin,
  1 34 buttock, anus, pubes, or genitals; or a sex act as
  1 35 defined in section 702.17."
