1 1 Amend Senate File 246 as follows:
1 2 #1. Page 6, by inserting after line 17 the
1 3 following:
1 4 "Sec. . Section 321G.7, unnumbered paragraph 2,
1 5 Code 1997, is amended to read as follows:
1 6 The department shall remit the fees to the
1 7 treasurer of state, who shall place the money in a
1 8 special conservation fund. The special conservation
1 9 fund shall include moneys transferred pursuant to
1 10 section 452A.83. The money is appropriated to the
1 11 department for the all-terrain vehicle and snowmobile
1 12 programs of the state. All-terrain vehicle fees shall
1 13 be used only for all-terrain vehicle programs and
1 14 snowmobile fees shall be used only for snowmobile
1 15 programs. Joint programs shall be supported from both
1 16 types of fees on a usage basis. The all-terrain
1 17 vehicle and snowmobile programs shall include grants,
1 18 subgrants, contracts, or cost-sharing of all-terrain
1 19 vehicle and snowmobile programs with political
1 20 subdivisions or incorporated private organizations or
1 21 both in accordance with rules adopted by the
1 22 commission. All all-terrain vehicle programs using
1 23 cost-sharing, grants, subgrants, or contracts shall
1 24 establish and implement a safety instruction program
1 25 either singly or in cooperation with other all-terrain
1 26 vehicle programs. At least fifty percent of the
1 27 special fund shall be available for political
1 28 subdivisions or incorporated private organizations or
1 29 both. Moneys from the special fund not used by the
1 30 political subdivisions or incorporated private
1 31 organizations or both shall remain in the all-terrain
1 32 vehicle or snowmobile accounts. The department may
1 33 use funds from these accounts for the administration
1 34 of the all-terrain vehicle and snowmobile programs.
1 35 Sec. . Section 452A.79, Code 1997, is amended
1 36 by adding the following new unnumbered paragraph:
1 37 NEW UNNUMBERED PARAGRAPH. All moneys derived from
1 38 the excise tax on the sale of motor fuel used in all-
1 39 terrain vehicles and snowmobiles shall be deposited in
1 40 the special conservation fund established under
1 41 section 321G.7.
1 42 Sec. . NEW SECTION. 452A.83 TRANSFER TO
1 43 SPECIAL CONSERVATION FUND.
1 44 The treasurer of state shall transfer from the
1 45 motor fuel tax fund to the special conservation fund
1 46 established under section 321G.7 that portion of the
1 47 moneys collected under this chapter which are
1 48 attributable to motor fuel used in all-terrain
1 49 vehicles and snowmobiles, computed as follows:
1 50 1. Determine annually, during the first full
2 1 business week in April, the total number of all-
2 2 terrain vehicles and snowmobiles which are registered
2 3 in the state.
2 4 2. Multiply the product of the total number of
2 5 registered all-terrain vehicles and snowmobiles and
2 6 fifty gallons times the amount of the excise tax
2 7 charged per gallon of motor fuel to obtain the total
2 8 amount of excise tax paid on all-terrain vehicle and
2 9 snowmobile fuel.
2 10 3. Subtract from the total amount of excise tax
2 11 paid on all-terrain vehicle and snowmobile fuel an
2 12 amount which represents three percent of the total tax
2 13 paid on all-terrain vehicle and snowmobile fuel, for
2 14 payment of the administrative costs, which shall be
2 15 allocated to the department of natural resources for
2 16 administration of all-terrain vehicle and snowmobile
2 17 programs."
2 18 #2. Title page, line 2, by striking the word
2 19 "increasing" and inserting the following: "providing
2 20 for".
2 21 #3. By renumbering as necessary.
