1 2 #1. By striking everything after the enacting
1 3 clause and inserting the following:
1 4 "Section 1. Section 321.34, Code 1997, is amended
1 5 by adding the following new subsection:
1 6 NEW SUBSECTION. 8A. EX-PRISONER OF WAR SPECIAL
1 7 PLATES. The owner of a motor vehicle subject to
1 8 registration under section 321.109, subsection 1,
1 9 light delivery truck, panel delivery truck, or pickup
1 10 who was a prisoner of war during the Second World War
1 11 at any time between December 7, 1941, and December 31,
1 12 1946, the Korean Conflict at any time between June 25,
1 13 1950, and January 31, 1955, or the Vietnam Conflict at
1 14 any time between August 5, 1964, and June 30, 1973,
1 15 all dates inclusive, may, upon written application to
1 16 the department, order special registration plates with
1 17 an ex-prisoner of war processed emblem with the emblem
1 18 designed by the department in cooperation with the
1 19 adjutant general which emblem signifies that the owner
1 20 was a prisoner of war as described in this subsection.
1 21 The application is subject to approval by the
1 22 department, in consultation with the adjutant general.
1 23 The special plates are subject to an annual fee of
1 24 fifteen dollars. The department shall validate the
1 25 special plates in the same manner as regular
1 26 registration plates are validated under this section.
1 27 The surviving spouse of a person who was issued
1 28 special plates under this subsection may continue to
1 29 use the special plates subject to registration of the
1 30 special plates in the surviving spouse's name and upon
1 31 payment of the annual registration fee. If the
1 32 surviving spouse remarries, the surviving spouse shall
1 33 return the special plates to the department and the
1 34 department shall issue regular registration plates to
1 35 the surviving spouse.
1 36 Sec. 2. Section 321.34, subsection 15, Code 1997,
1 37 is amended by striking the subsection.
1 38 Sec. 3. A person eligible to be issued ex-prisoner
1 39 of war special plates who ordered and paid for the
1 40 special plates on or after January 1, 1997, but prior
1 41 to the effective date of this Act shall be entitled to
1 42 a refund from the county treasurer of all fees in
1 43 excess of fifteen dollars paid for issuance of the
1 44 special plates. To obtain a refund, a person shall
1 45 apply to the county treasurer before the date the
1 46 person's current registration expires.
1 47 A county treasurer may request reimbursement to the
1 48 county for refunds paid by submitting a single claim
1 49 to the state department of transportation following
1 50 payment of all refunds, but in any event not later
2 1 than June 30, 1998. Notwithstanding any provision of
2 2 the Code to the contrary, claims shall be paid by the
2 3 department from registration fees deposited in the
2 4 road use tax fund under section 321.145.
2 5 Sec. 4. EFFECTIVE AND APPLICABILITY DATE. This
2 6 Act, being deemed of immediate importance, takes
2 7 effect upon enactment and is retroactively applicable
2 8 to January 1, 1997."

2 10 word "plates" the following: "and providing an
2 11 effective date and a retroactive applicability date".
