1 1 Section 1. SUBSTANCE ABUSE APPROPRIATION.
1 2 1. There is appropriated from the fund created by section
1 3 8.41 to the Iowa department of public health for the federal
1 4 fiscal year beginning October 1, 1998, and ending September
1 5 30, 1999, the following amount:
1 6 .................................................. $ 11,945,086
1 7 a. Funds appropriated in this subsection are the
1 8 anticipated funds to be received from the federal government
1 9 for the designated federal fiscal year under 42 U.S.C.,
1 10 chapter 6A, subchapter XVII, which provides for the substance
1 11 abuse prevention and treatment block grant. The department
1 12 shall expend the funds appropriated in this subsection as
1 13 provided in the federal law making the funds available and in
1 14 conformance with chapter 17A.
1 15 b. Of the funds appropriated in this subsection, an amount
1 16 not exceeding 5 percent shall be used by the department for
1 17 administrative expenses.
1 18 c. The department shall expend no less than an amount
1 19 equal to the amount expended for treatment services in state
1 20 fiscal year beginning July 1, 1997, for pregnant women and
1 21 women with dependent children.
1 22 d. Of the funds appropriated in this subsection, an amount
1 23 not exceeding $24,585 shall be used for audits.
1 24 e. Of the funds appropriated in this subsection, an amount
1 25 not exceeding $461,342 shall be used for current and former
1 26 recipients of federal supplemental security income (SSI).
1 27 2. The funds remaining from the appropriation made in
1 28 subsection 1 shall be allocated as follows:
1 29 a. At least 20 percent of the allocation shall be for
1 30 prevention programs.
1 31 b. At least 35 percent of the allocation shall be spent on
1 32 drug treatment and prevention activities.
1 33 c. At least 35 percent of the allocation shall be spent on
1 34 alcohol treatment and prevention activities.
1 35 3. The substance abuse block grant funds received from the
2 1 federal government in excess of the amount of the anticipated
2 2 federal fiscal year 1998-1999 award appropriated in subsection
2 3 1 shall be distributed at least 50 percent to treatment
2 4 programs and 50 percent to prevention programs except that,
2 5 based upon federal guidelines, the total amount of the excess
2 6 awarded to prevention programs shall not exceed $1,000,000.
2 7 Sec. 2. COMMUNITY MENTAL HEALTH SERVICES APPROPRIATION.
2 8 1. a. There is appropriated from the fund created by
2 9 section 8.41 to the Iowa department of human services for the
2 10 federal fiscal year beginning October 1, 1998, and ending
2 11 September 30, 1999, the following amount:
2 12 .................................................. $ 2,740,750
2 13 b. Funds appropriated in this subsection are the
2 14 anticipated funds to be received from the federal government
2 15 for the designated federal fiscal year under 42 U.S.C.,
2 16 chapter 6A, subchapter XVII, which provides for the community
2 17 mental health services block grant. The department shall
2 18 expend the funds appropriated in this subsection as provided
2 19 in the federal law making the funds available and in
2 20 conformance with chapter 17A.
2 21 c. The administrator of the division of mental health and
2 22 developmental disabilities shall allocate not less than 95
2 23 percent of the amount of the block grant to eligible community
2 24 mental health services providers for carrying out the plan
2 25 submitted to and approved by the federal substance abuse and
2 26 mental health services administration for the fiscal year
2 27 involved.
2 28 2. An amount not exceeding 5 percent of the funds
2 29 appropriated in subsection 1 shall be used by the department
2 30 of human services for administrative expenses. From the funds
2 31 set aside by this subsection for administrative expenses, the
2 32 division of mental health and developmental disabilities shall
2 33 pay to the auditor of state an amount sufficient to pay the
2 34 cost of auditing the use and administration of the state's
2 35 portion of the funds appropriated in subsection 1. The
3 1 auditor of state shall bill the division of mental health and
3 2 developmental disabilities for the costs of the audits.
3 3 Sec. 3. MATERNAL AND CHILD HEALTH SERVICES APPROPRIATIONS.
3 4 1. There is appropriated from the fund created by section
3 5 8.41 to the Iowa department of public health for the federal
3 6 fiscal year beginning October 1, 1998, and ending September
3 7 30, 1999, the following amount:
3 8 .................................................. $ 6,888,880
3 9 The funds appropriated in this subsection are the funds
3 10 anticipated to be received from the federal government for the
3 11 designated federal fiscal year under 42 U.S.C., chapter 7,
3 12 subchapter V, which provides for the maternal and child health
3 13 services block grant. The department shall expend the funds
3 14 appropriated in this subsection as provided in the federal law
3 15 making the funds available and in conformance with chapter
3 16 17A.
3 17 Of the funds appropriated in this subsection, an amount not
3 18 exceeding $45,700 shall be used for audits.
3 19 Funds appropriated in this subsection shall not be used by
3 20 the university of Iowa hospitals and clinics for indirect
3 21 costs.
3 22 2. An amount not exceeding $150,000 of the funds
3 23 appropriated in subsection 1 to the Iowa department of public
3 24 health shall be used by the Iowa department of public health
3 25 for administrative expenses in addition to the amount to be
3 26 used for audits in subsection 1.
3 27 The departments of public health, human services, and
3 28 education and the university of Iowa's mobile and regional
3 29 child health specialty clinics shall continue to pursue to the
3 30 maximum extent feasible the coordination and integration of
3 31 services to women and children.
3 32 3. a. Sixty-three percent of the remaining funds
3 33 appropriated in subsection 1 shall be allocated to supplement
3 34 appropriations for maternal and child health programs within
3 35 the Iowa department of public health. Of these funds,
4 1 $284,548 shall be set aside for the statewide perinatal care
4 2 program.
4 3 b. Thirty-seven percent of the remaining funds
4 4 appropriated in subsection 1 shall be allocated to the
4 5 university of Iowa hospitals and clinics under the control of
4 6 the state board of regents for mobile and regional child
4 7 health specialty clinics. The university of Iowa hospitals
4 8 and clinics shall not receive an allocation for indirect costs
4 9 from the funds for this program. Priority shall be given to
4 10 establishment and maintenance of a statewide system of mobile
4 11 and regional child health specialty clinics.
4 12 4. The Iowa department of public health shall administer
4 13 the statewide maternal and child health program and the
4 14 crippled children's program by conducting mobile and regional
4 15 child health specialty clinics and conducting other activities
4 16 to improve the health of low-income women and children and to
4 17 promote the welfare of children with actual or potential
4 18 handicapping conditions and chronic illnesses in accordance
4 19 with the requirements of Title V of the federal Social
4 20 Security Act.
4 21 Sec. 4. PREVENTIVE HEALTH AND HEALTH SERVICES
4 22 APPROPRIATIONS.
4 23 1. There is appropriated from the fund created by section
4 24 8.41 to the Iowa department of public health for the federal
4 25 fiscal year beginning October 1, 1998, and ending September
4 26 30, 1999, the following amount:
4 27 .................................................. $ 2,103,338
4 28 Funds appropriated in this subsection are the funds
4 29 anticipated to be received from the federal government for the
4 30 designated federal fiscal year under 42 U.S.C., chapter 6A,
4 31 subchapter XVII, which provides for the preventive health and
4 32 health services block grant. The department shall expend the
4 33 funds appropriated in this subsection as provided in the
4 34 federal law making the funds available and in conformance with
4 35 chapter 17A.
5 1 Of the funds appropriated in this subsection, an amount not
5 2 exceeding $5,522 shall be used for audits.
5 3 2. Of the funds appropriated in subsection 1, the specific
5 4 amount of funds stipulated by the notice of block grant award
5 5 shall be allocated for services to victims of sex offenses and
5 6 for rape prevention education.
5 7 3. An amount not exceeding $94,670 of the remaining funds
5 8 appropriated in subsections 1 and 2 shall be used by the Iowa
5 9 department of public health for administrative expenses in
5 10 addition to the amount to be used for audits in subsection 1.
5 11 4. After deducting the funds allocated in subsections 1,
5 12 2, and 3, the remaining funds appropriated in subsection 1
5 13 shall be used by the department for healthy people
5 14 2000/healthy Iowans 2000 program objectives, preventive health
5 15 advisory committee, and risk reduction services, including
5 16 nutrition programs, health incentive programs, chronic disease
5 17 services, emergency medical services, monitoring of the
5 18 fluoridation program and start-up fluoridation grants, and
5 19 acquired immune deficiency syndrome services. The moneys
5 20 specified in this subsection shall not be used by the
5 21 university of Iowa hospitals and clinics or by the state
5 22 hygienic laboratory for the funding of indirect costs. Of the
5 23 funds used by the department under this subsection, an amount
5 24 not exceeding $90,000 shall be used for the monitoring of the
5 25 fluoridation program and for start-up fluoridation grants to
5 26 public water systems, and at least $50,000 shall be used to
5 27 provide chlamydia testing.
5 28 Sec. 5. DRUG CONTROL AND SYSTEM IMPROVEMENT GRANT PROGRAM
5 29 APPROPRIATION.
5 30 1. There is appropriated from the fund created in section
5 31 8.41 to the office of the governor for the drug enforcement
5 32 and abuse prevention coordinator for the federal fiscal year
5 33 beginning October 1, 1998, and ending September 30, 1999, the
5 34 following amount:
5 35 .................................................. $ 5,806,000
6 1 Funds appropriated in this subsection are the anticipated
6 2 funds to be received from the federal government for the
6 3 designated fiscal year under 42 U.S.C., chapter 46, subchapter
6 4 V, which provides for the drug control and system improvement
6 5 grant program. The drug enforcement and abuse prevention
6 6 coordinator shall expend the funds appropriated in this
6 7 subsection as provided in the federal law making the funds
6 8 available and in conformance with chapter 17A.
6 9 2. An amount not exceeding 7 percent of the funds
6 10 appropriated in subsection 1 shall be used by the drug
6 11 enforcement and abuse prevention coordinator for
6 12 administrative expenses. From the funds set aside by this
6 13 subsection for administrative expenses, the drug enforcement
6 14 and abuse prevention coordinator shall pay to the auditor of
6 15 state an amount sufficient to pay the cost of auditing the use
6 16 and administration of the state's portion of the funds
6 17 appropriated in subsection 1.
6 18 Sec. 6. STOP VIOLENCE AGAINST WOMEN GRANT PROGRAM
6 19 APPROPRIATION.
6 20 1. There is appropriated from the fund created in section
6 21 8.41 to the office of the governor for the drug enforcement
6 22 and abuse prevention coordinator for the federal fiscal year
6 23 beginning October 1, 1998, and ending September 30, 1999, the
6 24 following amount:
6 25 .................................................. $ 1,619,000
6 26 Funds appropriated in this subsection are the anticipated
6 27 funds to be received from the federal government for the
6 28 designated fiscal year under 42 U.S.C., chapter 46, subchapter
6 29 XII-H, which provides for grants to combat violent crimes
6 30 against women. The drug enforcement and abuse prevention
6 31 coordinator shall expend the funds appropriated in this
6 32 subsection as provided in the federal law making the funds
6 33 available and in conformance with chapter 17A.
6 34 2. An amount not exceeding 5 percent of the funds
6 35 appropriated in subsection 1 shall be used by the drug
7 1 enforcement and abuse prevention coordinator for
7 2 administrative expenses. From the funds set aside by this
7 3 subsection for administrative expenses, the drug enforcement
7 4 and abuse prevention coordinator shall pay to the auditor of
7 5 the state an amount sufficient to pay the cost of auditing the
7 6 use and administration of the state's portion of the funds
7 7 appropriated in subsection 1.
7 8 Sec. 7. LOCAL LAW ENFORCEMENT BLOCK GRANT APPROPRIATION.
7 9 1. There is appropriated from the fund created in section
7 10 8.41 to the office of the governor for the drug enforcement
7 11 and abuse prevention coordinator for the federal fiscal year
7 12 beginning October 1, 1998, and ending September 30, 1999, the
7 13 following amount:
7 14 .................................................. $ 382,106
7 15 Funds appropriated in this subsection are the funds
7 16 anticipated to be received from the federal government for the
7 17 designated federal fiscal year under the federal Omnibus
7 18 Consolidated Recissions and Appropriations Act of 1997, Pub.
7 19 L. No. 104-134, which provides for grants to reduce crime and
7 20 improve public safety. The drug enforcement and abuse
7 21 prevention coordinator shall expend the funds appropriated in
7 22 this subsection as provided in the federal law making the
7 23 funds available and in conformance with chapter 17A.
7 24 2. An amount not exceeding 3 percent of the funds
7 25 appropriated in subsection 1 shall be used by the drug
7 26 enforcement and abuse prevention coordinator for
7 27 administrative expenses. From the funds set aside by this
7 28 subsection for administrative expenses, the drug enforcement
7 29 and abuse prevention coordinator shall pay to the auditor of
7 30 state an amount sufficient to pay the cost of auditing the use
7 31 and administration of the state's portion of the funds
7 32 appropriated in subsection 1.
7 33 Sec. 8. RESIDENTIAL SUBSTANCE ABUSE TREATMENT FOR STATE
7 34 PRISONERS FORMULA GRANT PROGRAM. There is appropriated from
7 35 the fund created in section 8.41 to the office of the governor
8 1 for the drug enforcement and abuse prevention coordinator for
8 2 the federal fiscal year beginning October 1, 1998, and ending
8 3 September 30, 1999, the following amount:
8 4 .................................................. $ 236,738
8 5 Funds appropriated in this subsection are the funds
8 6 anticipated to be received from the federal government for the
8 7 designated federal fiscal year under 42 U.S.C., chapter 136,
8 8 which provides grants for substance abuse treatment programs
8 9 in state and local correctional facilities. The drug
8 10 enforcement and abuse prevention coordinator shall expend the
8 11 funds appropriated in this subsection as provided in the
8 12 federal law making the funds available and in conformance with
8 13 chapter 17A.
8 14 Sec. 9. COMMUNITY SERVICES APPROPRIATIONS.
8 15 1. a. There is appropriated from the fund created by
8 16 section 8.41 to the division of community action agencies of
8 17 the department of human rights for the federal fiscal year
8 18 beginning October 1, 1998, and ending September 30, 1999, the
8 19 following amount:
8 20 .................................................. $ 5,307,702
8 21 Funds appropriated in this subsection are the funds
8 22 anticipated to be received from the federal government for the
8 23 designated federal fiscal year under 42 U.S.C., chapter 106,
8 24 which provides for the community services block grant. The
8 25 division of community action agencies of the department of
8 26 human rights shall expend the funds appropriated in this
8 27 subsection as provided in the federal law making the funds
8 28 available and in conformance with chapter 17A.
8 29 b. The administrator of the division of community action
8 30 agencies of the department of human rights shall allocate not
8 31 less than 96 percent of the amount of the block grant to
8 32 eligible community action agencies for programs benefiting
8 33 low-income persons. Each eligible agency shall receive a
8 34 minimum allocation of not less than $100,000. The minimum
8 35 allocation shall be achieved by redistributing increased funds
9 1 from agencies experiencing a greater share of available funds.
9 2 The funds shall be distributed on the basis of the poverty-
9 3 level population in the area represented by the community
9 4 action areas compared to the size of the poverty-level
9 5 population in the state.
9 6 2. An amount not exceeding 4 percent of the funds
9 7 appropriated in subsection 1 shall be used by the division of
9 8 community action agencies of the department of human rights
9 9 for administrative expenses. From the funds set aside by this
9 10 subsection for administrative expenses, the division of
9 11 community action agencies of the department of human rights
9 12 shall pay to the auditor of state an amount sufficient to pay
9 13 the cost of auditing the use and administration of the state's
9 14 portion of the funds appropriated in subsection 1. The
9 15 auditor of state shall bill the division of community action
9 16 agencies for the costs of the audits.
9 17 Sec. 10. COMMUNITY DEVELOPMENT APPROPRIATIONS.
9 18 1. There is appropriated from the fund created by section
9 19 8.41 to the department of economic development for the federal
9 20 fiscal year beginning October 1, 1998, and ending September
9 21 30, 1999, the following amount:
9 22 .................................................. $ 30,400,000
9 23 Funds appropriated in this subsection are the funds
9 24 anticipated to be received from the federal government for the
9 25 designated federal fiscal year under 42 U.S.C., chapter 69,
9 26 which provides for community development block grants. The
9 27 department of economic development shall expend the funds
9 28 appropriated in this subsection as provided in the federal law
9 29 making the funds available and in conformance with chapter
9 30 17A.
9 31 2. An amount not exceeding $1,414,000 for the federal
9 32 fiscal year beginning October 1, 1998, shall be used by the
9 33 department of economic development for administrative expenses
9 34 for the community development block grant. The total amount
9 35 used for administrative expenses includes $707,000 for the
10 1 federal fiscal year beginning October 1, 1998, of funds
10 2 appropriated in subsection 1 and a matching contribution from
10 3 the state equal to $707,000 from the appropriation of state
10 4 funds for the community development block grant and state
10 5 appropriations for related activities of the department of
10 6 economic development. From the funds set aside for
10 7 administrative expenses by this subsection, the department of
10 8 economic development shall pay to the auditor of state an
10 9 amount sufficient to pay the cost of auditing the use and
10 10 administration of the state's portion of the funds
10 11 appropriated in subsection 1. The auditor of state shall bill
10 12 the department for the costs of the audit.
10 13 Sec. 11. LOW-INCOME HOME ENERGY ASSISTANCE APPROPRIATIONS.
10 14 1. There is appropriated from the fund created by section
10 15 8.41 to the division of community action agencies of the
10 16 department of human rights for the federal fiscal year
10 17 beginning October 1, 1998, and ending September 30, 1999, the
10 18 following amount:
10 19 .................................................. $ 18,143,877
10 20 The funds appropriated in this subsection are the funds
10 21 anticipated to be received from the federal government for the
10 22 designated federal fiscal year under 42 U.S.C., chapter 94,
10 23 subchapter II, which provides for the low-income home energy
10 24 assistance block grants. The division of community action
10 25 agencies of the department of human rights shall expend the
10 26 funds appropriated in this subsection as provided in the
10 27 federal law making the funds available and in conformance with
10 28 chapter 17A.
10 29 2. An amount not exceeding $1,542,229 or 10 percent of the
10 30 funds appropriated in subsection 1, whichever is less, may be
10 31 used for administrative expenses for the low-income home
10 32 energy assistance program. Not more than $290,000 shall be
10 33 used for administrative expenses of the division of community
10 34 action agencies of the department of human rights. From the
10 35 total funds set aside in this subsection for administrative
11 1 expenses for the low-income home energy assistance program, an
11 2 amount sufficient to pay the cost of an audit of the use and
11 3 administration of the state's portion of the funds
11 4 appropriated is allocated for that purpose. The auditor of
11 5 state shall bill the division of community action agencies for
11 6 the costs of the audits.
11 7 3. The remaining funds appropriated in subsection 1 shall
11 8 be allocated to help eligible households, as defined under 42
11 9 U.S.C., chapter 94, subchapter II, to meet the costs of home
11 10 energy. After reserving a reasonable portion of the remaining
11 11 funds not to exceed 10 percent of the funds appropriated in
11 12 subsection 1, to carry forward into the federal fiscal year
11 13 beginning October 1, 1999, at least 15 percent of the funds
11 14 appropriated in subsection 1 shall be used for low-income
11 15 residential weatherization or other related home repairs for
11 16 low-income households. Of this amount, an amount not
11 17 exceeding 10 percent may be used for administrative expenses.
11 18 4. An eligible household must be willing to allow
11 19 residential weatherization or other related home repairs in
11 20 order to receive home energy assistance. If the eligible
11 21 household resides in rental property, the unwillingness of the
11 22 landlord to allow residential weatherization or other related
11 23 home repairs shall not prevent the household from receiving
11 24 home energy assistance.
11 25 5. Not more than 5 percent of the funds appropriated in
11 26 subsection 1 shall be used for assessment and resolution of
11 27 energy problems.
11 28 Sec. 12. SOCIAL SERVICES APPROPRIATIONS.
11 29 1. There is appropriated from the fund created by section
11 30 8.41 to the department of human services for the federal
11 31 fiscal year beginning October 1, 1998, and ending September
11 32 30, 1999, the following amount:
11 33 .................................................. $ 24,727,375
11 34 Funds appropriated in this subsection are the funds
11 35 anticipated to be received from the federal government for the
12 1 designated federal fiscal year under 42 U.S.C., chapter 7,
12 2 subchapter XX, which provides for the social services block
12 3 grant. The department of human services shall expend the
12 4 funds appropriated in this subsection as provided in the
12 5 federal law making the funds available and in conformance with
12 6 chapter 17A.
12 7 2. Not more than $1,572,354 of the funds appropriated in
12 8 subsection 1 shall be used by the department of human services
12 9 for general administration. From the funds set aside in this
12 10 subsection for general administration, the department of human
12 11 services shall pay to the auditor of state an amount
12 12 sufficient to pay the cost of auditing the use and
12 13 administration of the state's portion of the funds
12 14 appropriated in subsection 1.
12 15 3. In addition to the allocation for general
12 16 administration in subsection 2, the remaining funds
12 17 appropriated in subsection 1 shall be allocated in the
12 18 following amounts to supplement appropriations for the federal
12 19 fiscal year beginning October 1, 1998, for the following
12 20 programs within the department of human services:

12 34 Sec. 13. SOCIAL SERVICES BLOCK GRANT PLAN. The department
12 35 of human services during each state fiscal year shall develop
13 1 a plan for the use of federal social services block grant
13 2 funds for the subsequent state fiscal year.
13 3 The proposed plan shall include all programs and services
13 4 at the state level which the department proposes to fund with
13 5 federal social services block grant funds, and shall identify
13 6 state and other funds which the department proposes to use to
13 7 fund the state programs and services.
13 8 The proposed plan shall also include all local programs and
13 9 services which are eligible to be funded with federal social
13 10 services block grant funds, the total amount of federal social
13 11 services block grant funds available for the local programs
13 12 and services, and the manner of distribution of the federal
13 13 social services block grant funds to the counties. The
13 14 proposed plan shall identify state and local funds which will
13 15 be used to fund the local programs and services.
13 16 The proposed plan shall be submitted with the department's
13 17 budget requests to the governor and the general assembly.
13 18 Sec. 14. PROJECTS FOR ASSISTANCE IN TRANSITION FROM
13 19 HOMELESSNESS. Upon receipt of the minimum formula grant from
13 20 the federal alcohol, drug abuse, and mental health
13 21 administration to provide mental health services for the
13 22 homeless, the division of mental health and developmental
13 23 disabilities of the department of human services shall assure
13 24 that a project which receives funds under the formula grant
13 25 from either the federal or local match share of 25 percent in
13 26 order to provide outreach services to persons who are
13 27 chronically mentally ill and homeless or who are subject to a
13 28 significant probability of becoming homeless shall do all of
13 29 the following:
13 30 1. Provide community mental health services, diagnostic
13 31 services, crisis intervention services, and habilitation and
13 32 rehabilitation services.
13 33 2. Refer clients to medical facilities for necessary
13 34 hospital services, and to entities that provide primary health
13 35 services and substance abuse services.
14 1 3. Provide appropriate training to persons who provide
14 2 services to persons targeted by the grant.
14 3 4. Provide case management to homeless persons.
14 4 5. Provide supportive and supervisory services to certain
14 5 homeless persons living in residential settings which are not
14 6 otherwise supported.
14 7 6. Projects may expend funds for housing services
14 8 including minor renovation, expansion and repair of housing,
14 9 security deposits, planning of housing, technical assistance
14 10 in applying for housing, improving the coordination of housing
14 11 services, the costs associated with matching eligible homeless
14 12 individuals with appropriate housing, and one-time rental
14 13 payments to prevent eviction.
14 14 Sec. 15. CHILD CARE DEVELOPMENT FUND. There is
14 15 appropriated from the fund created by section 8.41 to the
14 16 department of human services for the federal fiscal year
14 17 beginning October 1, 1998, and ending September 30, 1999, the
14 18 following amount:
14 19 .................................................. $ 26,452,639
14 20 Funds appropriated in this section are the funds
14 21 anticipated to be received from the federal government under
14 22 42 U.S.C., chapter 105, subchapter II-B, which provides for
14 23 the child care development fund. The department shall expend
14 24 the funds appropriated in this section as provided in the
14 25 federal law making the funds available and in conformance with
14 26 chapter 17A.
14 27 Sec. 16. PROCEDURE FOR REDUCED FEDERAL FUNDS.
14 28 1. If the funds received from the federal government for
14 29 the block grants specified in this Act are less than the
14 30 amounts appropriated, the funds actually received shall be
14 31 prorated by the governor for the various programs, other than
14 32 for the services to victims of sex offenses and for rape
14 33 prevention education under section 4, subsection 2, of this
14 34 Act, for which each block grant is available according to the
14 35 percentages that each program is to receive as specified in
15 1 this Act. However, if the governor determines that the funds
15 2 allocated by the percentages will not be sufficient to effect
15 3 the purposes of a particular program, or if the appropriation
15 4 is not allocated by percentage, the governor may allocate the
15 5 funds in a manner which will effect to the greatest extent
15 6 possible the purposes of the various programs for which the
15 7 block grants are available.
15 8 2. Before the governor implements the actions provided for
15 9 in subsection 1, the following procedures shall be taken:
15 10 a. The chairpersons and ranking members of the senate and
15 11 house standing committees on appropriations, the appropriate
15 12 chairpersons and ranking members of subcommittees of those
15 13 committees, the director of the legislative service bureau,
15 14 and the director of the legislative fiscal bureau shall be
15 15 notified of the proposed action.
15 16 b. The notice shall include the proposed allocations, and
15 17 information on the reasons why particular percentages or
15 18 amounts of funds are allocated to the individual programs, the
15 19 departments and programs affected, and other information
15 20 deemed useful. Chairpersons notified shall be allowed at
15 21 least two weeks to review and comment on the proposed action
15 22 before the action is taken.
15 23 Sec. 17. PROCEDURE FOR INCREASED FEDERAL FUNDS.
15 24 1. If funds received from the federal government in the
15 25 form of block grants exceed the amounts appropriated in
15 26 sections 1, 2, 3, 4, 5, 7, 10, and 12 of this Act, the excess
15 27 shall be prorated to the appropriate programs according to the
15 28 percentages specified in those sections, except additional
15 29 funds shall not be prorated for administrative expenses.
15 30 2. If funds received from the federal government from
15 31 block grants exceed the amount appropriated in section 11 of
15 32 this Act for the low-income home energy assistance program, 15
15 33 percent of the excess shall be allocated to the low-income
15 34 residential weatherization program.
15 35 3. If funds received from the federal government from
16 1 community services block grants exceed the amount appropriated
16 2 in section 9 of this Act, 100 percent of the excess is
16 3 allocated to the community services block grant program.
16 4 Sec. 18. PROCEDURE FOR EXPENDITURE OF ADDITIONAL FEDERAL
16 5 FUNDS. If other federal grants, receipts, and funds and other
16 6 nonstate grants, receipts, and funds become available or are
16 7 awarded which are not available or awarded during the period
16 8 in which the general assembly is in session, but which require
16 9 expenditure by the applicable department or agency prior to
16 10 March 15 of the fiscal year beginning July 1, 1998, and ending
16 11 June 30, 1999, these grants, receipts, and funds are
16 12 appropriated to the extent necessary, provided that the fiscal
16 13 committee of the legislative council is notified within thirty
16 14 days of receipt of the grants, receipts, or funds and the
16 15 fiscal committee of the legislative council has an opportunity
16 16 to comment on the expenditure of the grants, receipts, or
16 17 funds.
16 18 Sec. 19. DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP.
16 19 Federal grants, receipts, and funds and other nonstate grants,
16 20 receipts, and funds, available in whole or in part for the
16 21 fiscal year beginning July 1, 1998, and ending June 30, 1999,
16 22 are appropriated to the department of agriculture and land
16 23 stewardship for the purposes set forth in the grants,
16 24 receipts, or conditions accompanying the receipt of the funds,
16 25 unless otherwise provided by law.
16 26 Sec. 20. OFFICE OF AUDITOR OF STATE. Federal grants,
16 27 receipts, and funds and other nonstate grants, receipts, and
16 28 funds, available in whole or in part for the fiscal year
16 29 beginning July 1, 1998, and ending June 30, 1999, are
16 30 appropriated to the office of auditor of state for the
16 31 purposes set forth in the grants, receipts, or conditions
16 32 accompanying the receipt of the funds, unless otherwise
16 33 provided by law.
16 34 Sec. 21. DEPARTMENT FOR THE BLIND. Federal grants,
16 35 receipts, and funds and other nonstate grants, receipts, and
17 1 funds, available in whole or in part for the fiscal year
17 2 beginning July 1, 1998, and ending June 30, 1999, are
17 3 appropriated to the department for the blind for the purposes
17 4 set forth in the grants, receipts, or conditions accompanying
17 5 the receipt of the funds, unless otherwise provided by law.
17 6 Sec. 22. ETHICS AND CAMPAIGN DISCLOSURE BOARD. Federal
17 7 grants, receipts, and funds and other nonstate grants,
17 8 receipts, and funds, available in whole or in part for the
17 9 fiscal year beginning July 1, 1998, and ending June 30, 1999,
17 10 are appropriated to the Iowa ethics and campaign disclosure
17 11 board for the purposes set forth in the grants, receipts, or
17 12 conditions accompanying the receipt of the funds, unless
17 13 otherwise provided by law.
17 14 Sec. 23. IOWA STATE CIVIL RIGHTS COMMISSION. Federal
17 15 grants, receipts, and funds and other nonstate grants,
17 16 receipts, and funds, available in whole or in part for the
17 17 fiscal year beginning July 1, 1998, and ending June 30, 1999,
17 18 are appropriated to the Iowa state civil rights commission for
17 19 the purposes set forth in the grants, receipts, or conditions
17 20 accompanying the receipt of the funds, unless otherwise
17 21 provided by law.
17 22 Sec. 24. COLLEGE STUDENT AID COMMISSION. Federal grants,
17 23 receipts, and funds and other nonstate grants, receipts, and
17 24 funds, available in whole or in part for the fiscal year
17 25 beginning July 1, 1998, and ending June 30, 1999, are
17 26 appropriated to the college student aid commission for the
17 27 purposes set forth in the grants, receipts, or conditions
17 28 accompanying the receipt of the funds, unless otherwise
17 29 provided by law.
17 30 Sec. 25. DEPARTMENT OF COMMERCE. Federal grants,
17 31 receipts, and funds and other nonstate grants, receipts, and
17 32 funds, available in whole or in part for the fiscal year
17 33 beginning July 1, 1998, and ending June 30, 1999, are
17 34 appropriated to the department of commerce for the purposes
17 35 set forth in the grants, receipts, or conditions accompanying
18 1 the receipt of the funds, unless otherwise provided by law.
18 2 Sec. 26. DEPARTMENT OF CORRECTIONS. Federal grants,
18 3 receipts, and funds and other nonstate grants, receipts, and
18 4 funds, available in whole or in part for the fiscal year
18 5 beginning July 1, 1998, and ending June 30, 1999, are
18 6 appropriated to the department of corrections for the purposes
18 7 set forth in the grants, receipts, or conditions accompanying
18 8 the receipt of the funds, unless otherwise provided by law.
18 9 Sec. 27. DEPARTMENT OF CULTURAL AFFAIRS. Federal grants,
18 10 receipts, and funds and other nonstate grants, receipts, and
18 11 funds, available in whole or in part for the fiscal year
18 12 beginning July 1, 1998, and ending June 30, 1999, are
18 13 appropriated to the department of cultural affairs for the
18 14 purposes set forth in the grants, receipts, or conditions
18 15 accompanying the receipt of the funds, unless otherwise
18 16 provided by law.
18 17 Sec. 28. DEPARTMENT OF ECONOMIC DEVELOPMENT. Federal
18 18 grants, receipts, and funds and other nonstate grants,
18 19 receipts, and funds, available in whole or in part for the
18 20 fiscal year beginning July 1, 1998, and ending June 30, 1999,
18 21 are appropriated to the department of economic development for
18 22 the purposes set forth in the grants, receipts, or conditions
18 23 accompanying the receipt of the funds, unless otherwise
18 24 provided by law.
18 25 Sec. 29. DEPARTMENT OF EDUCATION. Federal grants,
18 26 receipts, and funds and other nonstate grants, receipts, and
18 27 funds, available in whole or in part for the fiscal year
18 28 beginning July 1, 1998, and ending June 30, 1999, are
18 29 appropriated to the department of education for the purposes
18 30 set forth in the grants, receipts, or conditions accompanying
18 31 the receipt of the funds, unless otherwise provided by law.
18 32 Sec. 30. DEPARTMENT OF ELDER AFFAIRS. Federal grants,
18 33 receipts, and funds and other nonstate grants, receipts, and
18 34 funds, available in whole or in part for the fiscal year
18 35 beginning July 1, 1998, and ending June 30, 1999, are
19 1 appropriated to the department of elder affairs for the
19 2 purposes set forth in the grants, receipts, or conditions
19 3 accompanying the receipt of the funds, unless otherwise
19 4 provided by law.
19 5 Sec. 31. DEPARTMENT OF GENERAL SERVICES. Federal grants,
19 6 receipts, and funds and other nonstate grants, receipts, and
19 7 funds, available in whole or in part for the fiscal year
19 8 beginning July 1, 1998, and ending June 30, 1999, are
19 9 appropriated to the department of general services for the
19 10 purposes set forth in the grants, receipts, or conditions
19 11 accompanying the receipt of the funds, unless otherwise
19 12 provided by law.
19 13 Sec. 32. OFFICES OF THE GOVERNOR AND LIEUTENANT GOVERNOR.
19 14 Federal grants, receipts, and funds and other nonstate grants,
19 15 receipts, and funds, available in whole or in part for the
19 16 fiscal year beginning July 1, 1998, and ending June 30, 1999,
19 17 are appropriated to the offices of the governor and lieutenant
19 18 governor for the purposes set forth in the grants, receipts,
19 19 or conditions accompanying the receipt of the funds, unless
19 20 otherwise provided by law.
19 21 Sec. 33. DEPARTMENT OF HUMAN RIGHTS. Federal grants,
19 22 receipts, and funds and other nonstate grants, receipts, and
19 23 funds, available in whole or in part for the fiscal year
19 24 beginning July 1, 1998, and ending June 30, 1999, are
19 25 appropriated to the department of human rights for the
19 26 purposes set forth in the grants, receipts, or conditions
19 27 accompanying the receipt of the funds, unless otherwise
19 28 provided by law.
19 29 Sec. 34. DEPARTMENT OF HUMAN SERVICES. Federal grants,
19 30 receipts, and funds and other nonstate grants, receipts, and
19 31 funds, available in whole or in part for the fiscal year
19 32 beginning July 1, 1998, and ending June 30, 1999, are
19 33 appropriated to the department of human services, for the
19 34 purposes set forth in the grants, receipts, or conditions
19 35 accompanying the receipt of the funds, unless otherwise
20 1 provided by law.
20 2 Sec. 35. DEPARTMENT OF INSPECTIONS AND APPEALS. Federal
20 3 grants, receipts, and funds and other nonstate grants,
20 4 receipts, and funds, available in whole or in part for the
20 5 fiscal year beginning July 1, 1998, and ending June 30, 1999,
20 6 are appropriated to the department of inspections and appeals
20 7 for the purposes set forth in the grants, receipts, or
20 8 conditions accompanying the receipt of the funds, unless
20 9 otherwise provided by law.
20 10 Sec. 36. JUDICIAL DEPARTMENT. Federal grants, receipts,
20 11 and funds and other nonstate grants, receipts, and funds,
20 12 available in whole or in part for the fiscal year beginning
20 13 July 1, 1998, and ending June 30, 1999, are appropriated to
20 14 the judicial department for the purposes set forth in the
20 15 grants, receipts, or conditions accompanying the receipt of
20 16 the funds, unless otherwise provided by law.
20 17 Sec. 37. DEPARTMENT OF JUSTICE. Federal grants, receipts,
20 18 and funds and other nonstate grants, receipts, and funds,
20 19 available in whole or in part for the fiscal year beginning
20 20 July 1, 1998, and ending June 30, 1999, are appropriated to
20 21 the department of justice for the purposes set forth in the
20 22 grants, receipts, or conditions accompanying the receipt of
20 23 the funds, unless otherwise provided by law.
20 24 Sec. 38. IOWA LAW ENFORCEMENT ACADEMY. Federal grants,
20 25 receipts, and funds and other nonstate grants, receipts, and
20 26 funds, available in whole or in part for the fiscal year
20 27 beginning July 1, 1998, and ending June 30, 1999, are
20 28 appropriated to the Iowa law enforcement academy for the
20 29 purposes set forth in the grants, receipts, or conditions
20 30 accompanying the receipt of the funds, unless otherwise
20 31 provided by law.
20 32 Sec. 39. DEPARTMENT OF MANAGEMENT. Federal grants,

21 1 appropriated to the department of management for the purposes

21 4 Sec. 40. DEPARTMENT OF NATURAL RESOURCES. Federal grants,

21 7 beginning July 1, 1998, and ending June 30, 1999, are
21 8 appropriated to the department of natural resources for the
21 9 purposes set forth in the grants, receipts, or conditions

21 12 Sec. 41. BOARD OF PAROLE. Federal grants, receipts, and
21 13 funds and other nonstate grants, receipts, and funds,
21 14 available in whole or in part for the fiscal year beginning
21 15 July 1, 1998, and ending June 30, 1999, are appropriated to
21 16 the board of parole for the purposes set forth in the grants,
21 17 receipts, or conditions accompanying the receipt of the funds,
21 18 unless otherwise provided by law.
21 19 Sec. 42. DEPARTMENT OF PERSONNEL. Federal grants,
21 20 receipts, and funds and other nonstate grants, receipts, and
21 21 funds, available in whole or in part for the fiscal year
21 22 beginning July 1, 1998, and ending June 30, 1999, are
21 23 appropriated to the department of personnel for the purposes
21 24 set forth in the grants, receipts, or conditions accompanying
21 25 the receipt of the funds, unless otherwise provided by law.
21 26 Sec. 43. DEPARTMENT OF PUBLIC DEFENSE. Federal grants,
21 27 receipts, and funds and other nonstate grants, receipts, and
21 28 funds, available in whole or in part for the fiscal year
21 29 beginning July 1, 1998, and ending June 30, 1999, are
21 30 appropriated to the department of public defense for the
21 31 purposes set forth in the grants, receipts, or conditions
21 32 accompanying the receipt of the funds, unless otherwise
21 33 provided by law.
21 34 Sec. 44. PUBLIC EMPLOYMENT RELATIONS BOARD. Federal
21 35 grants, receipts, and funds and other nonstate grants,
22 1 receipts, and funds, available in whole or in part for the
22 2 fiscal year beginning July 1, 1998, and ending June 30, 1999,
22 3 are appropriated to the public employment relations board for
22 4 the purposes set forth in the grants, receipts, or conditions
22 5 accompanying the receipt of the funds, unless otherwise

22 7 Sec. 45. IOWA DEPARTMENT OF PUBLIC HEALTH. Federal
22 8 grants, receipts, and funds and other nonstate grants,

22 10 fiscal year beginning July 1, 1998, and ending June 30, 1999,
22 11 are appropriated to the Iowa department of public health for
22 12 the purposes set forth in the grants, receipts, or conditions

22 15 Sec. 46. DEPARTMENT OF PUBLIC SAFETY. Federal grants,
22 16 receipts, and funds and other nonstate grants, receipts, and
22 17 funds, available in whole or in part for the fiscal year
22 18 beginning July 1, 1998, and ending June 30, 1999, are
22 19 appropriated to the department of public safety, for the
22 20 purposes set forth in the grants, receipts, or conditions
22 21 accompanying the receipt of the funds, unless otherwise
22 22 provided by law.
22 23 Sec. 47. STATE BOARD OF REGENTS. Federal grants,
22 24 receipts, and funds and other nonstate grants, receipts, and
22 25 funds, available in whole or in part for the fiscal year
22 26 beginning July 1, 1998, and ending June 30, 1999, are
22 27 appropriated to the state board of regents for the purposes
22 28 set forth in the grants, receipts, or conditions accompanying
22 29 the receipt of the funds, unless otherwise provided by law.
22 30 Sec. 48. DEPARTMENT OF REVENUE AND FINANCE. Federal
22 31 grants, receipts, and funds and other nonstate grants,
22 32 receipts, and funds, available in whole or in part for the
22 33 fiscal year beginning July 1, 1998, and ending June 30, 1999,
22 34 are appropriated to the department of revenue and finance for
22 35 the purposes set forth in the grants, receipts, or conditions
23 1 accompanying the receipt of the funds, unless otherwise
23 2 provided by law.
23 3 Sec. 49. OFFICE OF SECRETARY OF STATE. Federal grants,
23 4 receipts, and funds and other nonstate grants, receipts, and
23 5 funds, available in whole or in part for the fiscal year
23 6 beginning July 1, 1998, and ending June 30, 1999, are
23 7 appropriated to the office of secretary of state for the
23 8 purposes set forth in the grants, receipts, or conditions
23 9 accompanying the receipt of the funds, unless otherwise
23 10 provided by law.
23 11 Sec. 50. IOWA STATE FAIR AUTHORITY. Federal grants,
23 12 receipts, and funds and other nonstate grants, receipts, and
23 13 funds, available in whole or in part for the fiscal year
23 14 beginning July 1, 1998, and ending June 30, 1999, are
23 15 appropriated to the Iowa state fair authority for the purposes
23 16 set forth in the grants, receipts, or conditions accompanying
23 17 the receipt of the funds, unless otherwise provided by law.
23 18 Sec. 51. OFFICE OF STATE-FEDERAL RELATIONS. Federal
23 19 grants, receipts, and funds and other nonstate grants,
23 20 receipts, and funds, available in whole or in part for the
23 21 fiscal year beginning July 1, 1998, and ending June 30, 1999,
23 22 are appropriated to the office of state-federal relations for
23 23 the purposes set forth in the grants, receipts, or conditions
23 24 accompanying the receipt of the funds, unless otherwise
23 25 provided by law.
23 26 Sec. 52. IOWA TELECOMMUNICATIONS AND TECHNOLOGY
23 27 COMMISSION. Federal grants, receipts, and funds and other
23 28 nonstate grants, receipts, and funds, available in whole or in
23 29 part for the fiscal year beginning July 1, 1998, and ending
23 30 June 30, 1999, are appropriated to the Iowa telecommunications
23 31 and technology commission for the purposes set forth in the
23 32 grants, receipts, or conditions accompanying the receipt of
23 33 the funds, unless otherwise provided by law.
23 34 Sec. 53. OFFICE OF TREASURER OF STATE. Federal grants,
23 35 receipts, and funds and other nonstate grants, receipts, and
24 1 funds, available in whole or in part for the fiscal year
24 2 beginning July 1, 1998, and ending June 30, 1999, are
24 3 appropriated to the office of treasurer of state for the
24 4 purposes set forth in the grants, receipts, or conditions
24 5 accompanying the receipt of the funds, unless otherwise
24 6 provided by law.
24 7 Sec. 54. STATE DEPARTMENT OF TRANSPORTATION. Federal
24 8 grants, receipts, and funds and other nonstate grants,
24 9 receipts, and funds, available in whole or in part for the
24 10 fiscal year beginning July 1, 1998, and ending June 30, 1999,
24 11 are appropriated to the state department of transportation for
24 12 the purposes set forth in the grants, receipts, or conditions
24 13 accompanying the receipt of the funds, unless otherwise
24 14 provided by law.
24 15 Sec. 55. COMMISSION OF VETERANS AFFAIRS. Federal grants,
24 16 receipts, and funds and other nonstate grants, receipts, and
24 17 funds, available in whole or in part for the fiscal year
24 18 beginning July 1, 1998, and ending June 30, 1999, are
24 19 appropriated to the commission of veterans affairs for the
24 20 purposes set forth in the grants, receipts, or conditions
24 21 accompanying the receipt of the funds, unless otherwise
24 22 provided by law.
24 23 Sec. 56. DEPARTMENT OF WORKFORCE DEVELOPMENT. Federal
24 24 grants, receipts, and funds and other nonstate grants,
24 25 receipts, and funds, available in whole or in part for the
24 26 fiscal year beginning July 1, 1998, and ending June 30, 1999,
24 27 are appropriated to the department of workforce development
24 28 for the purposes set forth in the grants, receipts, or
24 29 conditions accompanying the receipt of the funds, unless
24 30 otherwise provided by law.
24 31 Sec. 57. GOVERNOR'S ALLIANCE ON SUBSTANCE ABUSE. Federal
24 32 grants, receipts, and funds and other nonstate grants,
24 33 receipts, and funds, available in whole or in part for the
24 34 fiscal year beginning July 1, 1998, and ending June 30, 1999,
24 35 are appropriated to the governor's alliance on substance abuse
25 1 for the purposes set forth in the grants, receipts, or
25 2 conditions accompanying the receipt of the funds, unless
25 3 otherwise provided by law.
25 4 Sec. 58. DEPARTMENT OF INFORMATION TECHNOLOGY SERVICES.
25 5 Federal grants, receipts, and funds and other nonstate grants,
25 6 receipts, and funds, available in whole or in part for the
25 7 fiscal year beginning July 1, 1998, and ending June 30, 1999,
25 8 are appropriated to the department of information technology
25 9 services for the purposes set forth in the grants, receipts,
25 10 or conditions accompanying the receipt of the funds, unless
25 11 otherwise provided by law.
25 12 Sec. 59. LIHEAP FUNDING DISCONNECTION PROHIBITION. It
25 13 is the intent of the general assembly that if the governor
25 14 determines federal funds are insufficient to adequately
25 15 provide for certification of eligibility for the low-income
25 16 home energy assistance program by the community action
25 17 agencies during the federal fiscal year which commences
25 18 October 1, 1998, the Iowa utilities board shall issue an order
25 19 prohibiting disconnection of service from November 1 through
25 20 April 1 by a regulated public utility furnishing gas or
25 21 electricity to households whose income falls at or below one
25 22 hundred fifty percent of the federal poverty level as
25 23 established by the United States office of management and
25 24 budget. The board shall promptly adopt rules in accordance
25 25 with section 17A.4, subsection 2, and section 17A.5,
25 26 subsection 2, paragraph "b", to implement this requirement.
25 27 The energy assistance bureau of the department of human
25 28 rights, in consultation with the community action agencies,
25 29 shall certify to the utilities, households that are eligible
25 30 for moratorium protection utilizing the agency's existing
25 31 electronic database. Rules adopted under this section shall
25 32 also be published as a notice of intended action as provided
25 33 in section 17A.4.
25 34 EXPLANATION
25 35 The bill appropriates for the 1998-1999 federal fiscal year
26 1 which begins October 1, 1998, block grants available from the
26 2 federal government and provides procedures for increasing or
26 3 decreasing the appropriations if the block grants are
26 4 increased or decreased. Appropriations are also made for the
26 5 1998-1999 state fiscal year which begins July 1, 1998, of all
26 6 other nonstate grants, receipts, and funds available to this
26 7 state. The bill includes legislative intent that Iowa
26 8 utilities board is to issue an order prohibiting disconnection
26 9 of service to certain low-income households if the governor
26 10 determines federal funds are insufficient to adequately
26 11 provide for certification of eligibility for the low-income
26 12 home energy assistance program (LIHEAP) by the community
26 13 action agencies.
