1 1 Section 1. Section 272.2, Code 1997, is amended by adding
1 2 the following new subsections:
1 3 NEW SUBSECTION. 16. Adopt rules that, in order to assure
1 4 a free flow of information to administer this chapter, provide
1 5 that all investigation files, other investigation reports, and
1 6 other investigative information in the possession of the board
1 7 of educational examiners or its employees or agents which
1 8 relate to licensee discipline are privileged and confidential;
1 9 are not subject to discovery, subpoena, or other means of
1 10 legal compulsion for their release to a person other than the
1 11 licensee and the board, its employees, and agents involved in
1 12 licensee discipline; and are not admissible in evidence in a
1 13 judicial or administrative proceeding other than the
1 14 proceeding involving licensee discipline.
1 15 NEW SUBSECTION. 17. Review or investigate, or both, upon
1 16 its own motion pursuant to other evidence received by the
1 17 board, alleged acts or omissions the board reasonably believes
1 18 constitute cause under applicable law or administrative rule
1 19 for licensee discipline.
1 20 EXPLANATION
1 21 This bill authorizes the board to review or investigate,
1 22 pursuant to other evidence received by the board, alleged acts
1 23 or omissions the board reasonably believes constitute cause
1 24 for licensee discipline. The bill also directs the board of
1 25 educational examiners to adopt rules providing that all
1 26 investigative files and other investigative information in its
1 27 possession relating to licensee discipline are privileged and
1 28 confidential; are not subject to any means of legal compulsion
1 29 for their release to anyone other than the licensee and the
1 30 board, its employees, and agents; and are not admissible in
1 31 evidence in a judicial or administrative proceeding other than
1 32 the proceeding involving licensee discipline.
