1 1 Section 1. There is appropriated from those funds
1 2 designated within the energy conservation trust created in
1 3 section 473.11, for disbursement pursuant to section 473.11,
1 4 to the following named agencies for the fiscal year beginning
1 5 July 1, 1998, and ending June 30, 1999, the following amounts,
1 6 or so much thereof as is necessary, to be used for the
1 7 purposes designated:
1 8 1. To the division of community action agencies of the
1 9 department of human rights for qualifying energy conservation
1 10 programs for low-income persons, including but not limited to
1 11 energy weatherization projects, which target the highest
1 12 energy users, and including administrative costs:
1 13 a. To be expended first from the office of hearings and
1 14 appeals second-stage settlement (OHA) fund and then the
1 15 Warner/Imperial and Stripper Well funds:
1 16 .................................................. $ 400,000
1 17 b. To be expended from the Diamond Shamrock fund:
1 18 .................................................. $ 300,000
1 19 2. To the department of natural resources for the
1 20 following purposes:
1 21 a. For the state energy program, from the Exxon fund:
1 22 .................................................. $ 115,000
1 23 b. For administration of petroleum overcharge programs
1 24 from the Stripper Well fund, not to exceed the following
1 25 amount:
1 26 .................................................. $ 200,000
1 27 3. To the state department of transportation for deposit
1 28 into the intermodal revolving loan fund established in the
1 29 department from funds previously advanced to and repaid by the
1 30 department from the Exxon fund:
1 31 .................................................. $ 725,000
1 32 The intermodal revolving loan fund shall remain in
1 33 existence until June 30, 2019.
1 34 Notwithstanding section 8.33, the unencumbered or
1 35 unobligated moneys remaining at the end of any fiscal year
2 1 from the appropriations made in subsections 1, 2, and 3 shall
2 2 not revert but shall be available for expenditure during
2 3 subsequent fiscal years until expended for the purposes for
2 4 which originally appropriated.
2 5 Sec. 2. Section 473.11, Code 1997, is amended by adding
2 6 the following new subsection:
2 7 NEW SUBSECTION. 7. On June 30, 2003, the energy fund
2 8 disbursement council established in subsection 3 shall be
2 9 dissolved. At that time, the department of natural resources
2 10 shall be responsible for the disbursement of any funds either
2 11 received or remaining in the energy conservation trust. These
2 12 disbursements shall be for projects and programs consistent
2 13 with the allowable uses for the energy conservation trust.
2 14 Also, at that time, and annually thereafter, the state
2 15 department of transportation shall report to the department of
2 16 natural resources on the status of the intermodal revolving
2 17 loan fund established in the department. In the fiscal year
2 18 beginning July 1, 2019, the department of natural resources
2 19 shall assume responsibility for funds remaining in the
2 20 intermodal revolving loan fund and disburse them for energy
2 21 conservation projects and programs consistent with the
2 22 allowable uses for the energy conservation trust.
2 23 Sec. 3. 1993 Iowa Acts, chapter 11, section 3, is
2 24 repealed.
2 25 EXPLANATION
2 26 The bill provides for the appropriation from oil overcharge
2 27 funds for the 1998-1999 fiscal year to the departments of
2 28 human rights, natural resources, and transportation for energy
2 29 conservation programs and provides for the dissolution of the
2 30 energy fund disbursement council and the intermodal revolving
2 31 loan fund. The bill also eliminates the repeal of the energy
2 32 conservation trust.
