1 1 Section 1. Section 455D.11A, subsection 5, paragraph c,
1 2 Code 1997, is amended by striking the paragraph.
1 3 Sec. 2. Section 455D.11A, Code 1997, is amended by adding
1 4 the following new subsection:
1 5 NEW SUBSECTION. 8. All requirements for financial
1 6 assurance provided for in this section shall become effective
1 7 July 1, 1998.
1 8 EXPLANATION
1 9 Code section 455D.11A relates to the financial assurance an
1 10 owner or operator of a waste tire collection or processing
1 11 site must provide to the department of natural resources prior
1 12 to the initial approval of a permit or prior to the renewal of
1 13 a permit for an existing or expanding facility.
1 14 This bill strikes a paragraph in Code section 455D.11A,
1 15 subsection 5, which at present provides the amount of
1 16 financial assurance required for tires collected prior to July
1 17 1, 1992, the date the section was enacted. The bill provides
1 18 that the financial assurance requirements provided in this
1 19 section shall become effective July 1, 1998.
