PAG LIN 1 1 Section 1. Section 331.602, subsection 1, unnumbered 1 2 paragraph 1, Code 1997, is amended to read as follows: 1 3 Record all instruments presented to the recorder's office 1 4 for recordation upon payment of the proper fees and compliance 1 5 with other recording requirements as provided by law. The 1 6 instruments presented for filing or recordation shall be 1 7 legible and reproducible, and shall have typed or legibly 1 8 printed on them the names of all signatories including the 1 9 names of acknowledging officers and witnesses beneath the 1 10 original signatures. The instruments shall be no larger than 1 11 eight and one-half inches by fourteen inches and shall provide 1 12 a space at the top of the instrument at least eight and one- 1 13 half inches across the page by two inches in length, on which 1 14 space shall be typed or legibly printed across the page on the 1 15 bottom one-fourth inch of this space, the name, address, and 1 16 telephone number of the individual who prepared the 1 17 instrument. The remaining portion of this space shall be 1 18 reserved for use by the county recorder, except as otherwise 1 19 authorized by the recorder. Except as otherwise authorized by 1 20 the recorder, any instrument conveying real property shall 1 21 contain a place to be filled out with the name and complete 1 22 mailing address of the person responsible for paying the 1 23 property taxes for the real property subject to the 1 24 conveyance, in substantially the following form: "Address tax 1 25 statement to: ..........". 1 26 Sec. 2. Section 462A.78, subsection 5, Code 1997, is 1 27 amended to read as follows: 1 28 5. The funds collected under subsection 1, paragraph "a", 1 29 shall be placed in the general fund of the county and used for 1 30 the expenses of the county conservation board if one exists in 1 31 that county.Of each surcharge collected as required under1 32subsection 1, paragraph "b", the county recorder shall remit1 33five dollars to the department of revenue and finance for1 34deposit in the general fund of the state.1 35 Sec. 3. Section 554.9401, subsection 6, Code 1997, is 2 1 amended by striking the subsection. 2 2 Sec. 4. EFFECTIVE DATE. The amendment to section 331.602 2 3 in this Act takes effect January 1, 1998. 2 4 EXPLANATION 2 5 This bill relates to requirements for county recorders 2 6 processing documents. The bill eliminates provisions 2 7 requiring a county recorder to remit portions of surcharges 2 8 collected when filing documents connected to financing 2 9 statements provided under the uniform commercial code and 2 10 portions of fees collected when filing certificates of title 2 11 for boats to the department of revenue and finance for deposit 2 12 in the general fund of the state. The bill also provides that 2 13 an instrument conveying real property must contain a place to 2 14 be filled out with the name and complete mailing address of 2 15 the person responsible for paying the property taxes for the 2 16 real property subject to the conveyance. 2 17 This latter provision is effective January 1, 1998. 2 18 LSB 1810HC 77 2 19 da/jw/5
