PAG LIN 1 1 Section 1. Section 99D.7, subsection 18, Code 1997, is 1 2 amended to read as follows: 1 3 18. To revoke or suspend licenses and impose finesnot to1 4exceed one thousand dollars. 1 5 Sec. 2. Section 99D.15, subsection 3, paragraph d, Code 1 6 1997, is amended by striking the paragraph. 1 7 Sec. 3. Section 99D.25A, subsections 6, 7, and 8, Code 1 8 1997, are amended to read as follows: 1 9 6. Once a horse has been permitted the use of lasix,it1 10 the horse must be treated with lasix in the horse's stall, 1 11 unless the commission provides that the horse must be brought 1 12 to the detention barn for treatmentnot less than four hours1 13prior to scheduled post time for the race in which it is1 14entered to start. After the lasix treatment, the commission, 1 15 by rule, may authorize the release of the horse from the 1 16 horse's stall or detention barn before the scheduled post 1 17 time. If a horse is brought to the detention barn late, the 1 18 commission shall assess a civil penalty of one hundred dollars 1 19 against the trainer. 1 20 7. A horse entered to race with lasix must be treated at 1 21 least four hours prior to post time. The lasix shall be 1 22 administered intravenously by a veterinarian employed by the 1 23 owner or trainer of the horseunder the visual supervision of1 24the commission veterinarian. The commission shall adopt rules 1 25 to ensure that lasix is administered as provided in this 1 26 section. The commission shall require that the practicing 1 27 veterinarianmust deposit with the commission veterinarian at1 28the detention barn an unopened supply of lasix and sterile1 29hypodermic needles and syringes to be used for the1 30administrationsdeliver an affidavit signed by the 1 31 veterinarian which certifies information regarding the 1 32 treatment of the horse. The affidavit must be delivered to a 1 33 commission veterinarian within twenty minutes following the 1 34 treatment. The statement shall include at least the name of 1 35 the practicing veterinarian, the tattoo number of the horse, 2 1 the location of the barn and stall where the treatment 2 2 occurred, the race number of the horse, the name of the 2 3 trainer, and the time that the lasix was administered. Lasix 2 4 shall only be administered in a dose level of two hundred 2 5 fifty milligrams.The commission veterinarian shall extract a2 6test sample of the horse's blood, urine, or saliva to2 7determine whether the horse was improperly drugged after the2 8race is run.2 9 8. A person found within or in the immediate vicinity of 2 10 the detention barn or horse stall who is in possession of 2 11 unauthorized drugs or hypodermic needles or who is not 2 12 authorized to possess drugs or hypodermic needles shall, in 2 13 addition to any other penalties, be barred from entry into any 2 14 racetrack in Iowa and any occupational license the person 2 15 holds shall be revoked. 2 16 Sec. 4. Section 99F.9, subsection 5, Code 1997, is amended 2 17 to read as follows: 2 18 5. A person under the age of twenty-one years shall not 2 19 make a wager on an excursion gambling boat or at a racetrack 2 20 enclosure and shall not be allowed in the area of the 2 21 excursion boat or racetrack enclosure where gambling is being 2 22 conducted. However, a person eighteen years of age or older 2 23 may be employed to work in a gambling area. 2 24 EXPLANATION 2 25 This bill authorizes the racing and gaming commission to 2 26 set fines for pari-mutuel violations of chapter 99D consistent 2 27 with its authority under chapter 99F for excursion boat 2 28 gambling violations. The $1,000 limit is removed. 2 29 The bill strikes language associated with a state loan to 2 30 the Waterloo greyhound racetrack. The racetrack is no longer 2 31 in operation and the loan has been repaid. 2 32 The bill also allows a horse to be treated with lasix in 2 33 the horse's stall unless the racing and gaming commission 2 34 requires treatment in a detention barn. The bill also 2 35 requires the commission to adopt rules to ensure the lawful 3 1 application of the lasix. The veterinarian administering the 3 2 lasix shall provide an affidavit relating to the horse's 3 3 treatment. The penalty for illegal administration of drugs to 3 4 race horses or dogs is a class "D" felony. 3 5 Finally, the bill provides that persons who are less than 3 6 21 years of age shall not place a wager at a parimutuel 3 7 racetrack enclosure or be allowed in the area of the racetrack 3 8 enclosure where gambling is conducted. 3 9 LSB 1269DP 77 3 10 tj/cf/24
