PAG LIN 1 1 HOUSE FILE 2502 1 2 1 3 AN ACT 1 4 RELATING TO THE STATEWIDE NOTIFICATION CENTER AND PROVIDING 1 5 FOR ALTERNATIVE STAFF AND THE INFORMATION REQUIREMENTS 1 6 ASSOCIATED WITH THE NOTICE OF AN EXCAVATION. 1 7 1 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 9 1 10 Section 1. Section 480.3, subsection 1, paragraph a, Code 1 11 1997, is amended to read as follows: 1 12 a. A statewide notification center is established and 1 13 shall be organized as a nonprofit corporation pursuant to 1 14 chapter 504A. The center shall be governed by a board of 1 15 directors which shall represent and be elected by operators, 1 16 excavators, and other persons who participate in the center. 1 17 The boardshall, with input from all interested parties, shall 1 18 determine the operating procedures and technology needed for a 1 19 single statewide notification center,and establish a 1 20 notification processand. In addition, the board shall either 1 21 establish a competitive bidding procedure to select a vendor 1 22 to provide the notification service or retain sufficient and 1 23 necessary staff to provide the notification service.TheIf a 1 24 vendor is selected, terms of the agreement for the 1 25 notification service may be modified from time to time by the 1 26 board, and the agreement shall be reviewed, with an 1 27 opportunity to receive new bids, no less frequently than every 1 28 three years. If the board retains staff to provide the 1 29 notification service, the board, at the board's discretion, 1 30 may review the notification service at any time and make a 1 31 determination to use the competitive bidding procedure to 1 32 select a vendor. 1 33 Sec. 2. Section 480.4, subsection 1, Code 1997, is amended 1 34 to read as follows: 1 35 1. a. Except as otherwise provided in this section, prior 2 1 to any excavation, an excavator shall contact the notification 2 2 center and provide notice of the planned excavation. This 2 3 notice must be given at least forty-eight hours prior to the 2 4 commencement of the excavation, excluding Saturdays, Sundays, 2 5 and legal holidays. The notification center shall establish a 2 6 toll-free telephone number to allow excavators to provide the 2 7 notice required pursuant to this subsection. 2 8 b. A notice provided pursuant to this subsection for a 2 9 location within a city shallbe verbal andinclude the 2 10 following information: 2 11a. The name of the person providing the notice.2 12b. The precise location of the proposed area of2 13excavation, including the range, township, section, and2 14quarter section, if known.2 15 (1) A street address or block and lot numbers, or both, of 2 16 the proposed area of excavation. 2 17c.(2) The name and address of the excavator. 2 18d.(3) The excavator's telephone number. 2 19e.(4) The type and extent of the proposed excavation. 2 20f.(5) Whether the discharge of explosives is anticipated. 2 21g.(6) The date and time when excavation is scheduled to 2 22 begin. 2 23 (7) Approximate location of the excavation on the 2 24 property. 2 25 (8) If known, the name of the housing development and 2 26 property owner. 2 27 c. A notice provided pursuant to this subsection for a 2 28 location outside a city shall include the following 2 29 information: 2 30 (1) The name of the county, township, range, and section. 2 31 (2) The name and address of the excavator. 2 32 (3) The excavator's telephone number. 2 33 (4) The type and extent of the proposed excavation. 2 34 (5) Whether the discharge of explosives is anticipated. 2 35 (6) The date and time when excavation is scheduled to 3 1 begin. 3 2 (7) Approximate location of the excavation on the 3 3 property. 3 4 (8) If known, the quarter section, E911 address and global 3 5 positioning system coordinate, name of property owner, name of 3 6 housing development with street address or block and lot 3 7 numbers, or both. 3 8 d. For purposes of the requirements of this section, an 3 9 excavation commences the first time excavation occurs in an 3 10 area that was not previously identified by the excavator in an 3 11 excavation notice. 3 12 3 13 3 14 3 15 RON J.
