  1  1    Section 1.  Section 709.17, unnumbered paragraph 1, Code
  1  2 1997, is amended to read as follows:
  1  3    A criminal or juvenile justice agency shall not request or
  1  4 require a person claiming to be a victim of sexual abuse or
  1  5 claiming to be a witness regarding the sexual abuse of another
  1  6 person to submit to a polygraph or similar examination as a
  1  7 precondition to the agency conducting an investigation into
  1  8 the matter.  An agency wishing to perform which performs a
  1  9 polygraph examination of a person claiming to be a victim or
  1 10 witness shall inform the person of the following:  
  1 11                           EXPLANATION
  1 12    This bill prohibits criminal or juvenile justice agencies
  1 13 from requesting that a person claiming to be a victim of or
  1 14 witness to sexual abuse submit to a polygraph or similar
  1 15 examination as a precondition to the agency conducting an
  1 16 investigation into the matter.
