1 1 Section 1. SINGLE CONTACT REPOSITORY. There is
1 2 appropriated from the general fund of the state to the
1 3 department of general services, division of information
1 4 technology services, for the fiscal year beginning July 1,
1 5 1998, and ending June 30, 1999, the following amounts, or so
1 6 much thereof as is necessary, to be used for the purposes
1 7 designated:
1 8 1. For development and other start-up costs to establish a
1 9 single contact repository implementing the provisions of this
1 10 Act:
1 11 .................................................. $ 277,000
1 12 2. For operational costs of the single contact repository
1 13 in FY 1998-1999:
1 14 .................................................. $ 46,200
1 15 The department of inspections and appeals shall provide
1 16 direction to the division for implementation of the single
1 17 contact repository.
1 18 Sec. 2. Section 135C.33, Code Supplement 1997, is amended
1 19 by adding the following new subsection 1 and renumbering the
1 20 succeeding subsections:
1 21 NEW SUBSECTION. 1. For the purposes of this section, in
1 22 addition to the meaning defined for this chapter, "facility"
1 23 or "facility licensed under this chapter" includes all of the
1 24 following:
1 25 a. An elder group home certified under chapter 231B.
1 26 b. An assisted living facility certified or voluntarily
1 27 accredited under chapter 231C.
1 28 c. A provider of homemaker, home-health aide, home-care
1 29 aide, or adult day care services.
1 30 d. A hospice.
1 31 e. A provider of services under a federal medical
1 32 assistance home and community-based services waiver.
1 33 Sec. 3. Section 135C.33, Code Supplement 1997, is amended
1 34 by adding the following new subsection:
1 35 NEW SUBSECTION. 5. The department of inspections and
2 1 appeals, in conjunction with other departments and agencies of
2 2 state government involved with criminal history and abuse
2 3 registry information, shall establish a single contact
2 4 repository for facilities licensed under this chapter to have
2 5 electronic access to data to perform background checks for
2 6 purposes of employment.
2 7 Sec. 4. Section 692A.13, Code 1997, is amended by adding
2 8 the following new subsection:
2 9 NEW SUBSECTION. 9. The department shall provide
2 10 information for purposes of the single contact repository
2 11 established pursuant to section 135C.33, in accordance with
2 12 rules adopted by the department.
2 13 EXPLANATION
2 14 This bill relates to employment background checks by health
2 15 care facilities and services and creates a single contact
2 16 repository for access to data to obtain background
2 17 information. In addition, the bill provides an appropriation
2 18 to the department of general services for initial and
2 19 operating costs for the repository.
2 20 Code section 135C.33, relating to required abuse
2 21 information and criminal records checks for employment in
2 22 health care facilities licensed under Code chapter 135C, is
2 23 amended to require the checks of employees of elder group
2 24 homes, certified or accredited assisted living facilities,
2 25 providers of homemaker, home-health aide, home-care aide, and
2 26 adult day care services, hospices, and providers of services
2 27 under a federal medical assistance home and community-based
2 28 waiver services.
2 29 The bill directs the department of inspections and appeals
2 30 to work with other departments of state government in
2 31 establishing a single contact repository for these facilities
2 32 to electronically access data for performing the background
2 33 checks.
2 34 Code section 692A.13 is amended to direct the department of
2 35 public safety to provide sex offender registry information as
3 1 part of the single contact repository.
