PAG LIN 1 1 HOUSE FILE 2472 1 2 1 3 AN ACT 1 4 RELATING TO CIVIL PENALTIES IMPOSED FOR VIOLATIONS OF CITY 1 5 OR COUNTY ORDINANCES OR CITY OR COUNTY INFRACTIONS. 1 6 1 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 8 1 9 Section 1. Section 331.302, subsection 15, Code 1997, is 1 10 amended to read as follows: 1 11 15. A county shall not provide a civil penalty in excess 1 12 ofonefive hundred dollars for the violation of an ordinance 1 13 which is classified as a county infraction or if the 1 14 infraction is a repeat offense, a civil penalty not to exceed 1 15twoseven hundred fifty dollars for each repeat offense. A 1 16 county infraction is not punishable by imprisonment. 1 17 Sec. 2. Section 331.307, subsection 1, Code 1997, is 1 18 amended to read as follows: 1 19 1. A county infraction is a civil offense punishable by a 1 20 civil penalty of not more thanonefive hundred dollars for 1 21 each violation or if the infraction is a repeat offense a 1 22 civil penalty not to exceedtwoseven hundred fifty dollars 1 23 for each repeat offense. 1 24 Sec. 3. Section 364.3, subsection 6, Code 1997, is amended 1 25 to read as follows: 1 26 6. A city shall not provide a civil penalty in excess of 1 27onefive hundred dollars for the violation of an ordinance 1 28 which is classified as a municipal infraction or if the 1 29 infraction is a repeat offense, a civil penalty not to exceed 1 30twoseven hundred fifty dollars for each repeat offense. A 1 31 municipal infraction is not punishable by imprisonment. 1 32 Sec. 4. Section 364.22, subsection 1, unnumbered paragraph 1 33 1, Code 1997, is amended to read as follows: 1 34 A municipal infraction is a civil offense punishable by a 1 35 civil penalty of not more thanonefive hundred dollars for 2 1 each violation or if the infraction is a repeat offense, a 2 2 civil penalty not to exceedtwoseven hundred fifty dollars 2 3 for each repeat offense. However, notwithstanding section 2 4 364.3, a municipal infraction arising from noncompliance with 2 5 a pretreatment standard or requirement, referred to in 40 2 6 C.F.R. } 403.8, by an industrial user may be punishable by a 2 7 civil penalty of not more than one thousand dollars for each 2 8 day a violation exists or continues. 2 9 2 10 2 11 2 12 RON J.
