  1  1    Section 1.  Section 280.4, Code 1997, is amended by adding
  1  2 the following new subsection:
  1  3    NEW SUBSECTION.  4.  a.  There is appropriated annually
  1  4 from the general fund of the state to the school budget review
  1  5 committee two million dollars, or so much thereof as is
  1  6 necessary, to be awarded by the committee to school districts
  1  7 with limited English proficient student instruction program
  1  8 costs which, in the judgment of the committee, are high
  1  9 relative to instruction program costs for other limited
  1 10 English proficient student instruction programs in the state.
  1 11 Amounts awarded shall be in addition to any supplemental aid
  1 12 or modified allowable growth provided to a school district
  1 13 pursuant to subsection 3.
  1 14    b.  A school district with a limited English proficient
  1 15 student instruction program may submit an application, on a
  1 16 form developed by the department of education, for assistance
  1 17 pursuant to this subsection to the school budget review
  1 18 committee by November 1 of the school year in which the school
  1 19 district seeks assistance.  In making awards, the committee
  1 20 shall consider the size, diversity, and enrollment trends of
  1 21 the school district, the relative economic wealth and property
  1 22 tax base of the school district in comparison to other
  1 23 applying school districts, and the efforts the school district
  1 24 has undertaken to develop and monitor limited English
  1 25 proficient student assimilation into the school district
  1 26 population.  Preference shall be given to school districts
  1 27 which have previously received or are currently receiving
  1 28 supplemental aid or modified allowable growth from the
  1 29 committee for a limited English proficient student instruction
  1 30 program pursuant to subsection 3 and which have a limited
  1 31 English proficient student enrollment within the upper twenty-
  1 32 five percent of all limited English proficient student
  1 33 instruction program enrollments in the state, as determined by
  1 34 the department of management.
  1 35    c.  Assistance payments shall be made to school districts
  2  1 receiving an award in the manner provided in section 257.16,
  2  2 beginning with a December 15 payment, with the exception that
  2  3 funds shall be expended solely for purposes related to limited
  2  4 English proficient student program instruction.
  2  5 Notwithstanding section 8.33, the moneys appropriated in
  2  6 subsection 1 that remain unencumbered and unobligated at the
  2  7 close of the fiscal year shall not revert to the general fund
  2  8 but shall remain available for expenditure for the purposes
  2  9 designated during the succeeding fiscal year.  
  2 10                           EXPLANATION
  2 11    This bill provides for additional funding for school
  2 12 districts with high limited English proficiency program costs.
  2 13 The bill provides for an annual appropriation of $2 million
  2 14 from the general fund of the state to the school budget review
  2 15 committee, to be awarded by the committee to school districts
  2 16 with limited English proficient student instruction program
  2 17 costs which, in the judgment of the committee, are relatively
  2 18 high in comparison to similar programs in other school
  2 19 districts.  Applications may be submitted by school districts
  2 20 with a limited English proficient student instruction program
  2 21 by November 1 of the school year in which a school district
  2 22 seeks assistance.  In making awards, the committee shall
  2 23 consider the size, diversity, and enrollment trends of the
  2 24 school district, the relative economic wealth and property tax
  2 25 base of the school district in comparison to other applying
  2 26 school districts, and the efforts the school district has
  2 27 undertaken to develop and monitor limited English proficient
  2 28 student assimilation into the school district population.
  2 29 Priority will be given to school districts which have received
  2 30 supplemental aid or modified allowable growth for a limited
  2 31 English proficient student instruction program, and which have
  2 32 an enrollment placing the school district in the upper 25
  2 33 percent of all limited English proficient student instruction
  2 34 program enrollments in the state, as determined by the
  2 35 department of management.  Payments shall be made to school
  3  1 districts monthly from December 15 through June 15, and the
  3  2 amounts awarded shall be expended solely for purposes related
  3  3 to limited English proficient student program instruction.
  3  4 The bill provides for the nonreversion of unencumbered and
  3  5 unobligated funds at the close of the fiscal year.
