  1  4 RELATING TO THE COLLECTION AND PAYMENT OF FEES AND EXPENSES
  1  5    OF COUNTY MEDICAL EXAMINERS.  
  1  6 
  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  8 
  1  9    Section 1.  Section 331.802, subsection 2, Code 1997, is
  1 10 amended to read as follows:
  1 11    2.  If a person's death affects the public interest, the
  1 12 county medical examiner shall conduct a preliminary
  1 13 investigation of the cause and manner of death, prepare a
  1 14 written report of the findings, promptly submit the full
  1 15 report to the state medical examiner on forms prescribed for
  1 16 that purpose, and submit a copy of the report to the county
  1 17 attorney.  For each preliminary investigation and the
  1 18 preparation and submission of the required reports, the county
  1 19 medical examiner shall receive from the county of appointment
  1 20 a fee determined by the board plus the examiner's actual
  1 21 expenses.  The fee and expenses paid by the county of
  1 22 appointment shall be paid reimbursed to the county of
  1 23 appointment by the county of the person's residence.  However,
  1 24 if the person's death is caused by a defendant for whom a
  1 25 judgment of conviction and sentence is rendered under section
  1 26 707.2, 707.3, 707.4, 707.5, or 707.6A, the county of the
  1 27 person's residence may recover from the defendant the fee and
  1 28 expenses.  The fee and expenses of the county medical examiner
  1 29 who performs an autopsy or conducts an investigation of a
  1 30 person who dies after being brought into this state for
  1 31 emergency medical treatment by or at the direction of an out-
  1 32 of-state law enforcement officer or public authority shall be
  1 33 paid by the state.  A claim for payment shall be filed with
  1 34 the Iowa department of public health.
