  1  5 RAISING THE LIMIT ON THE AMOUNT OF ASSETS SUBJECT TO A
  1  6    CONSERVATORSHIP IN CASES WHERE A PRIVATE NONPROFIT
  1  7    CORPORATION SERVES AS CONSERVATOR AND PROVIDING FOR AN
  1  8    INCREASE IN THE AMOUNT OF ASSETS IN A MINOR WARD'S
  1  9    CONSERVATORSHIP ELIGIBLE FOR AN ORDER FOR TERMINATION
  1 10    OF THE CONSERVATORSHIP AND FOR DELIVERY OF THE CONSER-
  1 11    VATORSHIP ASSETS TO CERTAIN CUSTODIANS.

  1 13 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1 14  
  1 15    Section 1.  Section 633.63, subsection 3, Code 1997, is
  1 16 amended to read as follows:
  1 17    3.  A private nonprofit corporation organized under chapter
  1 18 504 or 504A is qualified to act as a guardian, as defined in
  1 19 section 633.3, subsection 19, or a conservator, as defined in
  1 20 section 633.3, subsection 7, where the assets subject to the
  1 21 conservatorship at the time when such corporation is appointed
  1 22 conservator are less than fifteen or equal to seventy-five
  1 23 thousand dollars and the corporation does not possess a
  1 24 proprietary or legal interest in an organization which
  1 25 provides direct services to the individual.
  1 26    Sec. 2.  Section 633.681, Code 1997, is amended to read as
  1 27 follows:
  1 28    633.681  ASSETS OF MINOR WARD EXHAUSTED.
  1 29    When the assets of a minor ward's conservatorship are
  1 30 exhausted or consist of personal property only of an aggregate
  1 31 value not in excess of four ten thousand dollars, the court,
  1 32 upon application or upon its own motion, may terminate the
  1 33 conservatorship and.  The order for termination shall direct
  1 34 the conservator to deliver the any property remaining after
  1 35 the payment of allowed claims and expenses of administration
  2  1 to the parent or other person entitled to the custody of the
  2  2 minor ward, for the use of the ward, after payment of allowed
  2  3 claims and expenses of administration a custodian under any
  2  4 uniform transfers to minors Act.  Such delivery shall have the
  2  5 same force and effect as if delivery had been made to the ward
  2  6 after attaining majority.
