1 1 Section 1. Section 614.1, subsection 2, Code Supplement
1 2 1997, is amended to read as follows:
1 3 2. INJURIES TO PERSON OR REPUTATION – RELATIVE RIGHTS –
1 4 STATUTE PENALTY. Those founded on injuries to the person or
1 5 reputation, including injuries to relative rights, whether
1 6 based on contract or tort, or for a statute penalty, within
1 7 two years. Notwithstanding this limitation, actions for
1 8 wrongful death based on personal injury that are not otherwise
1 9 limited by this or other sections of the Code shall be deemed
1 10 to accrue from the date of death, rather than the date of
1 11 injury.
1 12 EXPLANATION
1 13 This bill changes the time for accrual of an action for
1 14 wrongful death based on personal injury. Under this bill, the
1 15 statute of limitations would expire two years from the date of
1 16 death, rather than the date of injury.
1 17 This bill does not affect wrongful death actions subject to
1 18 other limitations under the Code, including malpractice
1 19 actions and product liability actions.
