PAG LIN 1 1 Section 1. Section 481A.48, unnumbered paragraph 1, Code 1 2 Supplement 1997, is amended to read as follows: 1 3NoA person, except as otherwise provided by law, shall not 1 4 willfully disturb, pursue, shoot, kill, take or attempt to 1 5 take or have in possession any of the following game birds or 1 6 animals except within the open season established by the 1 7 commission: Gray or fox squirrel, bobwhite quail, cottontail 1 8 or jack rabbit, duck, snipe, pheasant, goose, woodcock, 1 9 partridge, mourning dove, coot, rail, ruffed grouse, wild 1 10 turkey, pigeons, or deer. The seasons, bag limits, possession 1 11 limits and locality shall be established by the department or 1 12 commission under the authority of sections 456A.24, 481A.38, 1 13 and 481A.39. 1 14 EXPLANATION 1 15 This bill includes mourning doves among the game birds for 1 16 which the natural resource commission of the department of 1 17 natural resources shall establish an open season, bag limit, 1 18 possession limit, and locality pursuant to Code sections 1 19 456A.24, 481A.38, and 481A.39. 1 20 A violator is guilty of a simple misdemeanor which is 1 21 punishable by a minimum fine of $10. Each bird taken 1 22 illegally is a separate offense. Civil damages shall also be 1 23 imposed for illegally taking a game bird. 1 24 LSB 3137HH 77 1 25 tj/cf/24
