  1  1    Section 1.  NEW SECTION.  321.178A  DRIVER EDUCATION –
  1  2 TEACHING PARENT.
  1  3    1.  TEACHING PARENT QUALIFICATIONS.  As an alternative to
  1  4 section 321.178, a teaching parent may instruct a student in
  1  5 driver's education courses which meet the requirements of this
  1  6 section.  To qualify as a teaching parent, the parent or
  1  7 guardian must hold a teaching certificate at the secondary
  1  8 level and a valid certificate to teach driver's education, or
  1  9 comply with the definition of a teaching parent in this
  1 10 section, and provide certified evidence that the requirements
  1 11 under this section have been met.
  1 12    2.  DEFINITIONS.  For purposes of this section:
  1 13    a.  "Student" means a person within the custody and control
  1 14 of the teaching parent, who is between the ages of fourteen
  1 15 and twenty-one years of age and who satisfies preliminary
  1 16 licensing requirements of the department.
  1 17    b.  "Teaching parent" means a person who is the parent or
  1 18 guardian of a student, who holds a current valid Iowa license
  1 19 to operate a motor vehicle, and who elects to engage in
  1 20 instruction of the student.
  1 21    3.  COURSE OF INSTRUCTION.  A driver education course
  1 22 administered by a teaching parent shall consist at a minimum
  1 23 of the following:
  1 24    a.  Thirty clock hours of classroom instruction.
  1 25    b.  Fifty hours of street or highway driving.
  1 26    c.  Four hours of classroom instruction concerning
  1 27 substance abuse.
  1 28    The content of the course of instruction required under
  1 29 this subsection shall be equivalent to that required under
  1 30 section 321.178.  However, the course requirements, reference
  1 31 and study materials, manuals, study aids, workbooks, physical
  1 32 requirements, classroom dimensions, type of chalkboards, extra
  1 33 vehicle safety equipment, extra foot brake, cut-off switches,
  1 34 and extra mirrors required for instruction under section
  1 35 321.178 shall not be required for the course of instruction
  2  1 provided under this section.
  2  2    4.  COURSE COMPLETION AND CERTIFICATION.  Upon completion
  2  3 of a course under this section, the teaching parent shall
  2  4 document or provide evidence showing substantial statutory
  2  5 compliance with the requirements of subsection 3 and certify
  2  6 by affidavit to the department of education that the course
  2  7 has been completed.  Documentation shall include the
  2  8 following:
  2  9    a.  An affidavit attesting to satisfactory completion of
  2 10 course work and street or highway driving instruction.
  2 11    b.  A listing of subjects presented in classroom training.
  2 12    c.  Copies of written tests completed by the student.
  2 13    d.  A statement of the number of classroom hours of
  2 14 instruction.
  2 15    e.  A log of street or highway driving instruction
  2 16 including the dates when the lessons were conducted, the
  2 17 student's and the parent's name and initials noted next to
  2 18 each entry, notes on driving activities, including a list of
  2 19 driving deficiencies and improvements, and the duration of the
  2 20 driving time for each session.  If the department of education
  2 21 is satisfied that the course has been completed in accordance
  2 22 with this section, the department shall certify it as an
  2 23 approved driver's education course.
  2 24    5.  DRIVER'S LICENSE.  Any student who successfully
  2 25 completes an approved driver education course as provided in
  2 26 this section shall be eligible for a driver's license at the
  2 27 age of sixteen years.  
  2 28                           EXPLANATION
  2 29    This bill allows a parent or guardian to teach driver's
  2 30 education and allows a student who successfully completes the
  2 31 teaching parent instruction to obtain a driver's license.  To
  2 32 qualify as a teaching parent, the person must hold a teaching
  2 33 certificate at the secondary level and a valid certificate to
  2 34 teach driver's education, or comply with the definition of a
  2 35 teaching parent, and provide certified evidence that all the
  3  1 requirements in the bill have been met.
  3  2    The bill defines "student" as a person within the custody
  3  3 and control of the teaching parent, who is between the ages of
  3  4 14 and 21 years of age and who satisfies the state department
  3  5 of transportation's preliminary licensing requirements, and
  3  6 "teaching parent" as a person who is the parent or guardian of
  3  7 a student, who holds a current valid Iowa license to operate a
  3  8 motor vehicle, and who elects to engage in instruction of the
  3  9 student.
  3 10    The bill provides that a driver education course
  3 11 administered by a teaching parent shall consist of 30 clock
  3 12 hours of classroom instruction, 50 hours of street or highway
  3 13 driving, and four hours of classroom instruction concerning
  3 14 substance abuse.  Currently, a student must take 30 hours of
  3 15 classroom instruction, six or more hours of laboratory
  3 16 instruction, of which at least three hours must be street or
  3 17 highway driving, four hours of substance abuse instruction, 20
  3 18 minutes of instruction concerning railroad crossing safety,
  3 19 and instruction relating to becoming an organ donor.  The
  3 20 content of the parental instruction shall be equivalent to
  3 21 that required under section 321.178.  The course requirements,
  3 22 reference and study materials, manuals, study aids, workbooks,
  3 23 physical requirements, classroom dimensions, type of
  3 24 chalkboards, extra vehicle safety equipment, extra foot brake,
  3 25 cut-off switches, and extra mirrors are not required for a
  3 26 course of instruction under the bill.
  3 27    When the course is completed, the teaching parent must
  3 28 document or provide evidence showing substantial statutory
  3 29 compliance and certify that information by affidavit to the
  3 30 department.  Documentation includes an affidavit attesting to
  3 31 satisfactory completion of course work and street or highway
  3 32 driving instruction, a listing of subjects presented in
  3 33 classroom training, copies of written tests completed by the
  3 34 student, a statement of the number of classroom hours, and a
  3 35 log of street or highway driving instruction including the
  4  1 dates when the lessons were conducted, the student's name and
  4  2 initials, the parent's name and initials, notes on driving
  4  3 activities, including deficiencies and improvements, and the
  4  4 driving time for each session.  If the department of education
  4  5 is satisfied that the course has been completed as required in
  4  6 accordance with section 321.178A, the department of education
  4  7 shall certify the course as an approved driver's education
  4  8 course.  A student who successfully completes an approved
  4  9 driver's education course is eligible for a driver's license
  4 10 at 16 years of age.
