PAG LIN 1 1 HOUSE FILE 733 1 2 1 3 AN ACT 1 4 MAKING APPROPRIATIONS FROM THE REBUILD IOWA INFRASTRUCTURE 1 5 FUND TO THE DEPARTMENTS OF CULTURAL AFFAIRS, GENERAL 1 6 SERVICES, ECONOMIC DEVELOPMENT, PUBLIC DEFENSE, NATURAL 1 7 RESOURCES, REVENUE AND FINANCE, PUBLIC SAFETY, EDUCATION, 1 8 TRANSPORTATION, WORKFORCE DEVELOPMENT, AND AGRICULTURE AND 1 9 LAND STEWARDSHIP, AND TO THE COMMISSION OF VETERANS AFFAIRS, 1 10 LOESS HILLS DEVELOPMENT AND CONSERVATION AUTHORITY, STATE 1 11 FAIR FOUNDATION, AND STATE BOARD OF REGENTS, MAKING AN 1 12 APPROPRIATION OF MARINE FUEL TAX RECEIPTS FROM THE GENERAL 1 13 FUND OF THE STATE, AND MAKING STATUTORY CHANGES RELATING TO 1 14 THE APPROPRIATIONS. 1 15 1 16 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 17 1 18 DIVISION I 1 19 DEPARTMENT OF CULTURAL AFFAIRS 1 20 Section 1. There is appropriated from the rebuild Iowa 1 21 infrastructure fund to the department of cultural affairs for 1 22 the fiscal year beginning July 1, 1997, and ending June 30, 1 23 1998, the following amounts, or so much thereof as is 1 24 necessary, to be used for the purposes designated: 1 25 1. For the completion of undeveloped exhibit space at the 1 26 new historical building: 1 27 .................................................. $ 500,000 1 28 2. For allocation to an Iowa project that has received a 1 29 national endowment for the humanities award for the museum and 1 30 discovery center: 1 31 .................................................. $ 500,000 1 32 3. For a feasibility study by the city of Burlington 1 33 regarding the construction of a replica of the first 1 34 territorial capitol of Iowa: 1 35 .................................................. $ 25,000 2 1 Allocation of moneys pursuant to this subsection shall be 2 2 contingent upon a matching contribution of private moneys at a 2 3 rate of two dollars of private moneys for each dollar of state 2 4 appropriated moneys. 2 5 Notwithstanding section 8.33, the unencumbered or 2 6 unobligated moneys remaining on June 30 of the fiscal year 2 7 from moneys appropriated in this section may be expended 2 8 during the following fiscal year for the same purpose. 2 9 DEPARTMENT OF GENERAL SERVICES 2 10 Sec. 2. There is appropriated from the rebuild Iowa 2 11 infrastructure fund to the department of general services for 2 12 the fiscal year beginning July 1, 1997, and ending June 30, 2 13 1998, the following amounts, or so much thereof as is 2 14 necessary, to be used for the purposes designated: 2 15 1. For major maintenance needs including health, life, and 2 16 fire safety, for compliance with the federal Americans with 2 17 Disabilities Act for state-owned buildings and facilities: 2 18 .................................................. $ 7,000,000 2 19 2. For critical and deferred maintenance at Terrace Hill: 2 20 .................................................. $ 100,000 2 21 As a condition of receiving this appropriation made in this 2 22 subsection, private matching funds must be contributed on a 2 23 dollar-for-dollar basis. 2 24 3. For relocation of offices and other transition costs 2 25 associated with renovation of the Lucas state office building 2 26 and the old historical building: 2 27 .................................................. $ 1,300,000 2 28 4. For relocating the state library: 2 29 .................................................. $ 1,000,000 2 30 5. To fund the state share of the capitol gateway east 2 31 development project in conjunction with the city of Des 2 32 Moines: 2 33 .................................................. $ 50,000 2 34 6. For the installation of storm drainage, grading, new 2 35 asphalt, new lighting, and striping of capitol complex parking 3 1 lots 4 and 5 in accordance with capitol complex renovation 3 2 plans, provided that not more than $450,000 shall be used for 3 3 lot 4 and not more than $105,000 shall be used for lot 5, and 3 4 provided that existing capitol complex construction plans do 3 5 not conflict with the parking lot improvements: 3 6 .................................................. $ 555,000 3 7 7. For filling cracks, resurfacing, new handicapped 3 8 parking signs which comply with the provisions of chapter 3 9 321L, as amended by 1997 Iowa Acts, House File 688, and 3 10 striping capitol complex parking lots 13 and 15 in accordance 3 11 with capitol complex renovation plans, provided that not more 3 12 than $100,750 shall be used for lot 13 and not more than 3 13 $75,000 shall be used for lot 15, and provided that existing 3 14 capitol complex construction plans do not conflict with the 3 15 parking lot improvements: 3 16 .................................................. $ 175,750 3 17 8. For the design and construction of new or replacement 3 18 buildings at the state training school by allocating not more 3 19 than $1,600,000 for design and construction of a living unit, 3 20 allocating not more than $800,000 for design and construction 3 21 of a multipurpose building, and allocating not more than 3 22 $200,000 for the design of a new school building: 3 23 .................................................. $ 2,600,000 3 24 9. For renovation of an existing cottage to provide 3 25 additional beds for females at the Toledo juvenile home: 3 26 .................................................. $ 350,000 3 27 10. For conducting a survey of the condition of state- 3 28 owned property: 3 29 .................................................. $ 500,000 3 30 The department shall report on the progress of the vertical 3 31 infrastructure survey and provide an accounting of how the 3 32 appropriation in subsection 1 was spent to the joint 3 33 transportation, infrastructure and capitals appropriations 3 34 subcommittee not later than February 1, 1998. 3 35 Notwithstanding section 8.33, unencumbered or unobligated 4 1 funds remaining on June 30, 2002, from the funds appropriated 4 2 in this section, shall revert to the rebuild Iowa 4 3 infrastructure fund on August 31, 2002. 4 4 Sec. 3. 1996 Iowa Acts, chapter 1218, section 13, is 4 5 amended to read as follows: 4 6 SEC. 13. 4 7 1. There is appropriated from the rebuild Iowa 4 8 infrastructure fund of the state to the department of general 4 9 services for the fiscal period beginning July 1, 1996, and 4 10 ending June 30,19991998, the following amounts, or so much 4 11 thereof as is necessary, to be used for the projects in the 4 12 amounts and for the fiscal years as designated in subsection 4 13 2: 4 14 a. There is appropriated from the rebuild Iowa 6 2 infrastructure fund to the department of general services for 6 3 the fiscal year beginning July 1, 1998, and ending June 30, 6 4 1999, the following amounts, or so much thereof as is 6 5 necessary, to be used for the purposes designated: 6 6 1. For exterior state capitol building restoration: 6 7 .................................................. $ 4,400,000 6 8 2. For interior state capitol building restoration: 6 9 .................................................. $ 4,200,000 6 10 3. For conducting a survey of the condition of state-owned 6 11 property: 6 12 .................................................. $ 500,000 6 13 4. For the design and construction of new or replacement 6 14 buildings at the state training school by allocating not more 6 15 than $2,300,000 to complete construction of the new school 6 16 building and allocating not more than $400,000 for the design 6 17 of the new gymnasium building: 6 18 .................................................. $ 2,700,000 6 19 5. For repair of capitol complex parking lots in 6 20 accordance with capitol complex renovation plans: 6 21 .................................................. $ 1,500,000 6 22 6. For relocating the state library: 6 23 .................................................. $ 4,000,000 6 24 Notwithstanding section 8.33, unencumbered or unobligated 6 25 funds remaining on June 30, 2003, from the funds appropriated 6 26 in this section, shall revert to the rebuild Iowa 6 27 infrastructure fund on August 31, 2003. 6 28 Sec. 5. There is appropriated from the rebuild Iowa 6 29 infrastructure fund to the department of general services for 6 30 the fiscal year beginning July 1, 1999, and ending June 30, 6 31 2000, the following amount, or so much thereof as is 6 32 necessary, to be used for the purpose designated: 6 33 For construction of a new gymnasium building at the state 6 34 training school: 6 35 .................................................. $ 4,000,000 7 1 Sec. 6. The department of general services, after 7 2 consulting with the appropriate committee designated by the 7 3 legislative council, shall contract with a private person with 7 4 experience in evaluating the renovation and repair needs of 7 5 vertical infrastructure as defined in section 8.57, subsection 7 6 5, paragraph "c", to conduct the survey of the condition of 7 7 state-owned property. 7 8 DEPARTMENT OF ECONOMIC DEVELOPMENT 7 9 Sec. 7. There is appropriated from the rebuild Iowa 7 10 infrastructure fund to the department of economic development 7 11 for the fiscal period beginning July 1, 1997, and ending June 7 12 30, 1998 1999, the following amounts, or so much thereof as is 7 13 necessary, to be used for the purposes designated: 7 14 1. For the fiscal year beginning July 1, 1997, and ending 7 15 June 30, 1998: 7 16 a. For a welcome center at living history farms: 7 17 .................................................. $ 500,000 7 18 b. For the historical site preservation grant program: 7 19 .................................................. $ 500,000 7 20 c. For construction of a China-Des Moines trade and 7 21 cultural center: 7 22 .................................................. $ 150,000 7 23 d. For the main street investments loan program, 7 24 notwithstanding section 8.57, subsection 5, paragraph "c": 7 25 .................................................. $ 200,000 7 26 2. For the fiscal year beginning July 1, 1998, and ending 7 27 June 30, 1999: 7 28 a. For the historical site preservation grant program: 7 29 .................................................. $ 2,500,000 7 30 b. For a welcome center at Okoboji: 7 31 .................................................. $ 200,000 7 32 Notwithstanding section 8.33, the unencumbered or 7 33 unobligated moneys remaining on June 30 of the fiscal year 7 34 from the moneys appropriated in this section may be expended 7 35 during the following fiscal year for the same purpose. 8 1 Sec. 8. 1996 Iowa Acts, chapter 1218, section 55, 8 2 unnumbered paragraph 1, is amended to read as follows: 8 3 There is appropriated from the rebuild Iowa infrastructure 8 4 fund of the state, notwithstanding section 8.57, subsection 5, 8 5 paragraph "c", to the Iowa department of economic development 8 6 for the fiscal years beginning July 1, 1996, and ending June 8 7 30, 1998, the following amounts, or so much thereof as is 8 8 necessary, to be deposited in the physical infrastructure 8 9 assistance fund created in section 15E.175 and used only in 8 10 accordance with subsection 3, provided that the department, to 8 11 the best of its abilities, expend the funds on projects which 8 12 meet the definition of vertical infrastructure: 8 13 Sec. 9. 1996 Iowa Acts, chapter 1218, section 55, 8 14 subsection 2, is amended to read as follows: 8 15 2. For the fiscal year beginning July 1, 1997, and ending 8 16 June 30, 1998, the following amount: 8 17 .................................................. $6,100,0008 18 4,130,000 8 19 DEPARTMENT OF PUBLIC DEFENSE 8 20 Sec. 10. There is appropriated from the rebuild Iowa 8 21 infrastructure fund to the department of public defense for 8 22 the fiscal year beginning July 1, 1997, and ending June 30, 8 23 1998, the following amount, or so much thereof as is 8 24 necessary, to be used for the purpose designated: 8 25 For maintenance and repair of national guard armories and 8 26 facilities: 8 27 .................................................. $ 400,000 8 28 Notwithstanding section 8.33, the unencumbered or 8 29 unobligated moneys remaining on June 30 of the fiscal year 8 30 from the moneys appropriated in this section may be expended 8 31 during the following fiscal year for the same purpose. 8 32 DEPARTMENT OF NATURAL RESOURCES 8 33 Sec. 11. There is appropriated from the marine fuel tax 8 34 receipts deposited in the general fund of the state to the 8 35 department of natural resources for the fiscal year beginning 9 1 July 1, 1997, and ending June 30, 1998, the following amount, 9 2 or so much thereof as is necessary, to be used for the purpose 9 3 designated: 9 4 For the purpose of funding capital projects funded from 9 5 marine fuel tax receipts for the purposes specified in section 9 6 452A.79: 9 7 .................................................. $ 1,800,000 9 8 Notwithstanding section 8.33, unencumbered or unobligated 9 9 funds remaining on June 30, 1998, from the funds appropriated 9 10 in this section, shall revert to the general fund of the state 9 11 on August 31, 1998. 9 12 STATE DEPARTMENT OF TRANSPORTATION 9 13 Sec. 12. There is appropriated from the rebuild Iowa 9 14 infrastructure fund to the state department of transportation 9 15 for the fiscal year beginning July 1, 1997, and ending June 9 16 30, 1998, the following amounts, or so much thereof as is 9 17 necessary, to be used for the purposes designated: 9 18 1. For allocating $75,000 for the Nishna Valley trail 9 19 project at Anita state park and for acquiring, constructing, 9 20 and improving recreational trails within the state: 9 21 .................................................. $ 1,000,000 9 22 2. For funding, on a matching basis, recreational trail 9 23 projects, with priority given to completion of trail 9 24 connections and sections between existing trails and parks 9 25 within the established state recreational trails system: 9 26 .................................................. $ 1,000,000 9 27 Projects funded in subsection 2 shall be matched by one 9 28 dollar of private or other funds for each three dollars of 9 29 state funds. 9 30 The department may, upon proper documentation from the 9 31 governmental subdivision, pay the state's share of a project 9 32 directly to the contractor undertaking the project. 9 33 Notwithstanding section 8.33, unencumbered or unobligated 9 34 funds remaining on June 30 of the fiscal year from funds 9 35 appropriated in this section shall not revert to the rebuild 10 1 Iowa infrastructure fund but shall remain available for 10 2 expenditure for the same purpose during the following fiscal 10 3 year. 10 4 Sec. 13. There is appropriated from the rebuild Iowa 10 5 infrastructure fund to the state department of transportation 10 6 for the fiscal year beginning July 1, 1998, and ending June 10 7 30, 1999, the following amounts, or so much thereof as is 10 8 necessary, to be used for the purposes designated: 10 9 1. For acquiring, constructing, and improving recreational 10 10 trails within the state: 10 11 .................................................. $ 1,000,000 10 12 2. For funding, on a matching basis, recreational trail 10 13 projects, with priority given to completion of trail 10 14 connections and sections between existing trails and parks 10 15 within the established state recreational trails system: 10 16 .................................................. $ 1,000,000 10 17 Projects funded in subsection 2 shall be matched by one 10 18 dollar of private or other funds for each three dollars of 10 19 state funds. 10 20 The department may, upon proper documentation from the 10 21 governmental subdivision, pay the state's share of a project 10 22 directly to the contractor undertaking the project. 10 23 Notwithstanding section 8.33, unencumbered or unobligated 10 24 funds remaining on June 30 of the fiscal year from funds 10 25 appropriated in this section shall not revert to the rebuild 10 26 Iowa infrastructure fund but shall remain available for 10 27 expenditure for the same purpose during the following fiscal 10 28 year. 10 29 DEPARTMENT OF REVENUE AND FINANCE 10 30 Sec. 14. Notwithstanding section 8.57, subsection 5, 10 31 paragraph "c", there is appropriated from the rebuild Iowa 10 32 infrastructure fund to the department of revenue and finance 10 33 for the fiscal year beginning July 1, 1997, and ending June 10 34 30, 1998, the following amount, or so much thereof as is 10 35 necessary, to be used for the purpose designated: 11 1 For upgrades to the Iowa financial accounting system, 11 2 provided that none of the moneys appropriated in this section 11 3 shall be used for personnel expenses not associated with the 11 4 installation of the upgrades to the system or for training 11 5 expenses: 11 6 .................................................. $ 1,875,000 11 7 DEPARTMENT OF PUBLIC SAFETY 11 8 Sec. 15. Notwithstanding section 8.57, subsection 5, 11 9 paragraph "c", there is appropriated from the rebuild Iowa 11 10 infrastructure fund to the department of public safety for the 11 11 fiscal period beginning July 1, 1997, and ending June 30, 11 12 2000, the following amount, or so much thereof as is 11 13 necessary, to be used for the conversion of the department of 11 14 public safety's radio system from analog to digital 11 15 technology, provided that none of the moneys appropriated in 11 16 this section shall be used for personnel expenses not 11 17 associated with the installation of the radio system or for 11 18 training expenses: 11 19 1. For the fiscal year beginning July 1, 1997, and ending 11 20 June 30, 1998: 11 21 .................................................. $ 1,897,786 11 22 2. For the fiscal year beginning July 1, 1998, and ending 11 23 June 30, 1999: 11 24 .................................................. $ 2,074,663 11 25 3. For the fiscal year beginning July 1, 1999, and ending 11 26 June 30, 2000: 11 27 .................................................. $ 2,339,200 11 28 The department of public safety shall notify local law 11 29 enforcement agencies and fire departments of the department's 11 30 intent to purchase new radio equipment and shall allow any 11 31 local law enforcement agency or fire department, which wishes 11 32 to purchase with its own funds on the same purchase order, to 11 33 participate in the joint purchase in order to purchase new 11 34 radio equipment for the local law enforcement agency or fire 11 35 department. 12 1 Notwithstanding section 8.33, unencumbered or unobligated 12 2 moneys remaining on June 30, 2001, shall revert on August 31, 12 3 2001. 12 4 DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP 12 5 Sec. 16. There is appropriated from the rebuild Iowa 12 6 infrastructure fund, notwithstanding section 8.57, subsection 12 7 5, paragraph "c", to the department of agriculture and land 12 8 stewardship for the fiscal period beginning July 1, 1997, and 12 9 ending June 30, 1999, the following amounts, or so much 12 10 thereof as is necessary, to be used for deposit in the 12 11 alternative drainage system assistance fund created in section 12 12 159.29A, if enacted by 1997 Iowa Acts, Senate File 473, for 12 13 purposes of supporting the alternative drainage system 12 14 assistance program administered by the soil conservation 12 15 division of the department of agriculture and land stewardship 12 16 as provided in section 159.29B, if enacted by 1997 Iowa Acts, 12 17 Senate File 473: 12 18 1. For the fiscal year beginning July 1, 1997, and ending 12 19 June 30, 1998: 12 20 .................................................. $ 1,500,000 12 21 2. For the fiscal year beginning July 1, 1998, and ending 12 22 June 30, 1999: 12 23 .................................................. $ 1,500,000 12 24 As a condition of receiving the appropriations in this 12 25 section, the department shall allocate seventy-five percent of 12 26 the estimated or actual cost of improvements as defined by 12 27 section 468.3, not to exceed five hundred thousand dollars 12 28 each fiscal year, for a single drainage improvement project, 12 29 which will provide alternative drainage outlets to allow for 12 30 the closing of thirty or more agricultural drainage wells, 12 31 constructed by a drainage district established under section 12 32 468.22 on or after July 1, 1987, and prior to July 1, 1997, 12 33 for which a construction contract for the project is 12 34 successfully let prior to March 1, 1998. 12 35 DEPARTMENT OF WORKFORCE DEVELOPMENT 13 1 Sec. 17. Notwithstanding section 8.57, subsection 5, 13 2 paragraph "c", there is appropriated from the rebuild Iowa 13 3 infrastructure fund to the department of workforce development 13 4 for the fiscal period beginning July 1, 1997, and ending June 13 5 30, 1999, the following amounts, or so much thereof as is 13 6 necessary, to be used for the integrated information system 13 7 provided that none of the moneys appropriated in this section 13 8 shall be used for personnel expenses not associated with the 13 9 installation of the system or for training expenses: 13 10 1. For the fiscal year beginning July 1, 1997, and ending 13 11 June 30, 1998: 13 12 .................................................. $ 700,000 13 13 2. For the fiscal year beginning July 1, 1998, and ending 13 14 June 30, 1999: 13 15 .................................................. $ 300,000 13 16 JUDICIAL DEPARTMENT 13 17 Sec. 18. There is appropriated from the rebuild Iowa 13 18 infrastructure fund to the judicial department for the fiscal 13 19 period beginning July 1, 1997, and ending June 30, 1999, the 13 20 following amounts, or so much thereof as is necessary, to be 13 21 used for the purposes designated: 13 22 1. For the fiscal year beginning July 1, 1997, and ending 13 23 June 30, 1998, for planning for the relocation of judicial 13 24 department offices out of the capitol: 13 25 .................................................. $ 150,000 13 26 2. For the fiscal year beginning July 1, 1998, and ending 13 27 June 30, 1999, contingent on the decision being made to 13 28 relocate the judicial department's offices out of the capitol: 13 29 .................................................. $ 2,000,000 13 30 Notwithstanding section 8.33, moneys appropriated under 13 31 subsection 2 remaining unobligated or unexpended at the end of 13 32 the fiscal year, shall not revert until August 31, 2001. 13 33 COMMISSION OF VETERANS AFFAIRS 13 34 Sec. 19. There is appropriated from the rebuild Iowa 13 35 infrastructure fund to the commission of veterans affairs for 14 1 the fiscal period beginning July 1, 1997, and ending June 30, 14 2 1999, the following amounts, or so much thereof as is 14 3 necessary, to be used for the purposes designated: 14 4 1. For the fiscal year beginning July 1, 1997, and ending 14 5 June 30, 1998, for expansion of the food preparation area and 14 6 dining room at the veteran's home: 14 7 .................................................. $ 1,400,000 14 8 2. For the fiscal year beginning July 1, 1998, and ending 14 9 June 30, 1999, for expansion of the food preparation area and 14 10 dining room and major maintenance at the veteran's home, 14 11 provided that not more than $850,000 shall be allocated for 14 12 major maintenance projects: 14 13 .................................................. $ 2,750,000 14 14 Notwithstanding section 8.33, the unencumbered or 14 15 unobligated moneys remaining on June 30 of the fiscal year 14 16 from the moneys appropriated in this section may be expended 14 17 during the following fiscal year for the same purpose. 14 18 LOESS HILLS DEVELOPMENT AND CONSERVATION AUTHORITY 14 19 Sec. 20. There is appropriated from the rebuild Iowa 14 20 infrastructure fund, notwithstanding section 8.57, subsection 14 21 5, paragraph "c", to the Loess Hills development and 14 22 conservation authority for the fiscal year beginning July 1, 14 23 1997, and ending June 30, 1998, the following amount, or so 14 24 much thereof as is necessary, to be used for the purpose 14 25 designated: 14 26 For deposit in the Loess Hills development and conservation 14 27 fund created in section 161D.2 for the purposes specified in 14 28 section 161D.1: 14 29 .................................................. $ 742,500 14 30 IOWA STATE FAIR FOUNDATION 14 31 Sec. 21. There is appropriated from the rebuild Iowa 14 32 infrastructure fund of the state to the Iowa state fair 14 33 foundation for the fiscal period beginning July 1, 1997, and 14 34 ending June 30, 1999, the following amount, or so much thereof 14 35 as is necessary, to be used for rennovation, restoration, and 15 1 improvement projects on the state fairgrounds and for 15 2 distributing in accordance with chapter 174, $1,060,000 each 15 3 fiscal year to qualified fairs which belong to the association 15 4 of Iowa fairs: 15 5 For the fiscal year beginning July 1, 1997, and ending June 15 6 30, 1998: 15 7 .................................................. $ 5,460,000 15 8 For the fiscal year beginning July 1, 1998, and ending July 15 9 1, 1999: 15 10 .................................................. $ 5,460,000 15 11 Notwithstanding section 8.33, the unencumbered or 15 12 unobligated moneys remaining on June 30 of the fiscal year 15 13 from the moneys appropriated in this section may be expended 15 14 during the following fiscal year for the same purpose. 15 15 Sec. 22. Effective July 1, 1997, the departments of 15 16 general services, workforce development, and public safety, 15 17 and the commission on veterans affairs are authorized to enter 15 18 into contracts for the full cost of carrying out the projects 15 19 for which appropriations are made in this division of this 15 20 Act. The state shall not be obligated for costs associated 15 21 with contracts identified in this section in excess of funds 15 22 appropriated by the general assembly. 15 23 DIVISION II 15 24 STATE BOARD OF REGENTS 15 25 Sec. 23. 15 26 1. There is appropriated from the rebuild Iowa 15 27 infrastructure fund of the state to the state board of regents 15 28 for the fiscal period beginning July 1, 1997, and ending June 15 29 30, 2001, the following amounts, or so much thereof as is 15 30 necessary, to be used for the projects designated in 15 31 subsection 2: 15 32 a. For the fiscal year beginning July 1, 1997, and ending 15 33 June 30, 1998: 15 34 .................................................. $ 19,500,000 15 35 b. For the fiscal year beginning July 1, 1998, and ending 16 1 June 30, 1999: 16 2 .................................................. $ 19,500,000 16 3 c. For the fiscal year beginning July 1, 1999, and ending 16 4 June 30, 2000: 16 5 .................................................. $ 19,500,000 16 6 d. For the fiscal year beginning July 1, 2000, and ending 16 7 June 30, 2001: 16 8 .................................................. $ 11,915,000 16 9 The state board of regents shall determine the amounts to 16 10 be allocated to each project for each fiscal year of the 16 11 fiscal period beginning July 1, 1997, and ending June 30, 16 12 2001, based upon project needs. However, the total 16 13 appropriated funds for a project for all fiscal years of that 16 14 fiscal period shall not exceed the amount listed in subsection 16 15 2 for that project. 16 16 2. The state board of regents is authorized to undertake, 16 17 plan, construct, equip, and otherwise carry out the following 16 18 projects at the institutions under the jurisdiction of the 16 19 board in the following appropriated amounts: 16 20 a. For construction of the livestock infectious disease 16 21 isolation facility at Iowa state university of science and 16 22 technology: 16 23 .................................................. $ 9,270,000 16 24 b. For construction and renovation of the medical 16 25 education and biomedical research facilities at the university 16 26 of Iowa: 16 27 .................................................. $ 27,000,000 16 28 c. For renovation of Lang hall at the university of 16 29 northern Iowa: 16 30 .................................................. $ 12,900,000 16 31 d. For Phase II construction of the engineering teaching 16 32 and research complex at Iowa state university of science and 16 33 technology: 16 34 .................................................. $ 20,900,000 16 35 e. For improvements to the lakeside laboratory complex: 17 1 .................................................. $ 140,000 17 2 f. Conditioned upon the state board of regents allocating 17 3 funding for building maintenance at the Iowa school for the 17 4 deaf for the fiscal year beginning July 1, 1997, and ending 17 5 June 30, 1998, in an amount equal to or greater than the 17 6 amount of funding allocated for that purpose in the previous 17 7 fiscal year, the following amount, to be used for a visual 17 8 alert system and to address fire safety deficiencies at the 17 9 Iowa school for the deaf: 17 10 .................................................. $ 110,000 17 11 g. Conditioned upon the state board of regents allocating 17 12 funding for building maintenance at the Iowa braille and sight 17 13 saving school for the fiscal year beginning July 1, 1997, and 17 14 ending June 30, 1998, in an amount equal to or greater than 17 15 the amount of funding allocated for that purpose in the 17 16 previous fiscal year, the following amount, to be used for 17 17 deferred maintenance at the Iowa braille and sight saving 17 18 school: 17 19 .................................................. $ 95,000 17 20 3. Effective July 1, 1997, the state board of regents is 17 21 authorized to enter into contracts for the full cost of 17 22 carrying out the projects listed in subsection 2, for which 17 23 appropriations are made in subsection 1, for the fiscal years 17 24 beginning July 1, 1997, July 1, 1998, July 1, 1999, and July 17 25 1, 2000. 17 26 The state shall not be obligated for costs associated with 17 27 contracts identified in this section in excess of funds 17 28 appropriated by the general assembly. 17 29 4. a. Notwithstanding section 8.33, funds appropriated in 17 30 subsection 1, paragraph "a", for the fiscal year beginning 17 31 July 1, 1997, which remain unexpended as of June 30, 1998, 17 32 shall be available for expenditure through June 30, 2002. 17 33 b. Notwithstanding section 8.33, funds appropriated in 17 34 subsection 1, paragraph "b", for the fiscal year beginning 17 35 July 1, 1998, which remain unexpended as of June 30, 1999, 18 1 shall be available for expenditure through June 30, 2003. 18 2 c. Notwithstanding section 8.33, funds appropriated in 18 3 subsection 1, paragraph "c", for the fiscal year beginning 18 4 July 1, 1999, which remain unexpended as of June 30, 2000, 18 5 shall be available for expenditure through June 30, 2004. 18 6 d. Notwithstanding section 8.33, funds appropriated in 18 7 subsection 1, paragraph "d", for the fiscal year beginning 18 8 July 1, 2000, which remain unexpended as of June 30, 2001, 18 9 shall be available for expenditure through June 30, 2005. 18 10 The board of regents shall not submit a request to the 18 11 governor or general assembly for funding from the rebuild Iowa 18 12 infrastructure fund or other funds for capital projects, 18 13 including funding for planning for capital projects, until 18 14 fiscal year 2001, except for project or planning funding 18 15 requested for the Iowa school for the deaf or the Iowa braille 18 16 and sight saving school. 18 17 DIVISION III 18 18 COMMUNITY COLLEGE VOCATIONAL-TECHNICAL 18 19 TECHNOLOGY IMPROVEMENT PROGRAM 18 20 Sec. 24. NEW SECTION. 260A.1 COMMUNITY COLLEGE 18 21 VOCATIONAL-TECHNICAL TECHNOLOGY IMPROVEMENT APPROPRIATION. 18 22 1. Notwithstanding section 8.57, subsection 5, paragraph 18 23 "c", there is appropriated from the rebuild Iowa 18 24 infrastructure fund created in section 8.57, to the department 18 25 of education for each fiscal year of the fiscal period 18 26 beginning July 1, 1997, and ending June 30, 2001, the sum of 18 27 three million dollars for the community college vocational- 18 28 technical technology improvement program. 18 29 2. Moneys appropriated in subsection 1 shall be allocated 18 30 by the department of education to each community college in 18 31 the proportion that the allocation to that community college 18 32 in 1996 Iowa Acts, chapter 1215, section 6, subsection 15, 18 33 bears to the total appropriation made in 1996 Iowa Acts, 18 34 chapter 1215, section 6, subsection 15, to all community 18 35 colleges. 19 1 3. For each year in which an appropriation is made to the 19 2 community college vocational-technical technology improvement 19 3 program, the department of education shall notify the 19 4 department of revenue and finance of the amount to be paid to 19 5 each community college based upon the allocation criteria set 19 6 forth for the appropriation pursuant to subsection 2. 19 7 Allocations to each community college under this section shall 19 8 be made in one payment on or about October 15 and one payment 19 9 on or about February 15 of the fiscal year in which the 19 10 appropriation is made, taking into consideration the relative 19 11 budget and cash position of the state resources. 19 12 4. Moneys received by a community college under this 19 13 section shall not be commingled with general state financial 19 14 aid, including financial aid to merged areas in lieu of 19 15 personal property tax replacement payments under section 19 16 427A.13, to merged areas as defined in section 260C.2, and 19 17 including moneys received for vocational education programs in 19 18 accordance with chapters 258 and 260C. Payments made to a 19 19 community college shall be accounted for by the community 19 20 college separately from other state aid payments. Each 19 21 community college shall maintain a separate listing within its 19 22 budget accounting for payments received and expenditures made 19 23 pursuant to this section and section 260A.3. 19 24 5. Moneys received under this section shall supplement, 19 25 not supplant, the moneys each community college budgets for 19 26 technology. A community college may also use moneys received 19 27 under this section for projects, as defined in section 8.57, 19 28 subsection 5, paragraph "c", related to the acquisition or 19 29 installation of technology. A community college shall not be 19 30 eligible for funds under this section unless the community 19 31 college, without including moneys received under this section, 19 32 maintains the same average amount of expenditure for 19 33 technology per year as the community college maintains during 19 34 the fiscal period beginning July 1, 1994, and ending June 30, 19 35 1997. 20 1 6. Moneys received under this section shall not be used 20 2 for payment of any collective bargaining agreement or 20 3 arbitrator's decision negotiated or awarded under chapter 20. 20 4 Sec. 25. NEW SECTION. 260A.2 COMMUNITY COLLEGE 20 5 VOCATIONAL-TECHNICAL TECHNOLOGY IMPROVEMENT PLANS. 20 6 Prior to receiving moneys under this chapter, the board of 20 7 directors of a community college shall adopt a technology plan 20 8 that supports community college vocational-technical 20 9 technology improvement efforts, authorizes a needs assessment 20 10 of business and industry in the district, and includes an 20 11 evaluation component, and shall provide to the department of 20 12 education adequate assurance that funds received under this 20 13 chapter will be used in accordance with the technology plan. 20 14 The plan shall be developed by licensed professional staff of 20 15 the community college, including both faculty members and 20 16 school administrators, the private sector, trade and 20 17 professional organizations, and other interested parties, and 20 18 shall, at a minimum, focus on the attainment of the 20 19 vocational-technical skills and achievement goals of the 20 20 student. The plan shall consider the community college's 20 21 interconnectivity with the Iowa communications network, and 20 22 shall demonstrate how, over a four-year period, the board will 20 23 utilize technology to improve vocational-technical student 20 24 achievement. The technology plan shall be kept on file at the 20 25 community college. Progress made under the plan shall be 20 26 reported annually to the department of education in a manner 20 27 prescribed by the department of education. 20 28 Sec. 26. NEW SECTION. 260A.3 COMMUNITY COLLEGE 20 29 VOCATIONAL-TECHNICAL TECHNOLOGY IMPROVEMENT EXPENDITURES. 20 30 A community college shall expend funds received pursuant to 20 31 section 260A.1 for the acquisition, lease, lease-purchase, 20 32 installation, and maintenance of instructional technology 20 33 equipment used in vocational-technical programs, including 20 34 hardware and software, materials and supplies related to 20 35 instructional technology, faculty development and training 21 1 related to instructional technology, and projects, as defined 21 2 in section 8.57, subsection 5, paragraph "c", related to the 21 3 acquisition or installation of technology funded through this 21 4 chapter, and shall establish priorities for the use of the 21 5 funds. However, funds received by a community college 21 6 pursuant to section 260A.1 shall not be expended to add a 21 7 full-time equivalent position or otherwise increase staffing. 21 8 Sec. 27. NEW SECTION. 260A.4 FUTURE REPEAL. 21 9 This chapter is repealed effective July 1, 2001. 21 10 DIVISION IV 21 11 MISCELLANEOUS STATUTORY CHANGES 21 12 Sec. 28. NEW SECTION. 7E.5A BUILDINGS AND INFRASTRUCTURE 21 13 MAINTENANCE FUNDING. 21 14 1. For each new vertical infrastructure project undertaken 21 15 on or after July 1, 1997, the department in control of the 21 16 vertical infrastructure shall identify and recommend to the 21 17 general assembly funding sufficient to meet the projected 21 18 maintenance, repair, and replacement needs of the vertical 21 19 infrastructure. 21 20 2. As used in this section, "vertical infrastructure" 21 21 means the same as defined in section 8.57, subsection 5, 21 22 paragraph "c". 21 23 Sec. 29. NEW SECTION. 15E.176 MAIN STREET INVESTMENTS 21 24 LOAN PROGRAM. 21 25 The department shall adopt rules to implement a main street 21 26 investments loan program to increase the availability of lower 21 27 cost funds to stimulate building restorations or 21 28 rehabilitations of historic buildings within the central 21 29 business district of a city which is a certified local 21 30 government, or in the Iowa main street program or the rural 21 31 main street program. The rules shall include the following 21 32 conditions: 21 33 1. Investment loans shall be limited to projects for a 21 34 building restoration or rehabilitation located in the central 21 35 business district whose boundaries are the same as the main 22 1 street or rural main street or central business district of a 22 2 city which is a certified local government project area. 22 3 2. Eligible borrowers are limited to the property owner, 22 4 contract purchaser of record, or long-term lessee. 22 5 3. Loan applications under this program shall be for the 22 6 restoration or rehabilitation of buildings which are eligible 22 7 or nominated or listed on the national register of historic 22 8 places. Public buildings are excluded. 22 9 4. The maximum loan amount under the main street 22 10 investments loan program is fifty thousand dollars per 22 11 project. 22 12 Sec. 30. NEW SECTION. 15.177 APPLICATION PROCESS. 22 13 Applicants shall be certified as eligible for assistance 22 14 prior to submitting applications to the department for loans 22 15 under the main street investment loan program. Administrative 22 16 rules pursuant to chapter 17A shall be adopted by the 22 17 department in consultation with the department of cultural 22 18 affairs to require applicants to do the following: 22 19 1. Show evidence of preliminary design assistance. 22 20 2. Show evidence of preliminary design review approval 22 21 from the local design review committee. 22 22 3. Submit project plans and specifications prepared by a 22 23 design professional with historic preservation experience. 22 24 Sec. 31. NEW SECTION. 18.24 COORDINATION OF VERTICAL 22 25 INFRASTRUCTURE DATABASES. 22 26 1. The director shall establish by administrative rule, 22 27 and as part of a survey conducted regarding the condition of 22 28 state-owned property, a uniform system for evaluating and 22 29 rating vertical infrastructure needs in the state so that the 22 30 vertical infrastructure needs of each state entity and 22 31 proposed vertical infrastructure projects, including the state 22 32 board of regents, can be compared. The director shall consult 22 33 with state entities which already have databases regarding 22 34 their vertical infrastructure needs and shall seek input from 22 35 individuals or organizations with expertise in public vertical 23 1 infrastructure assessment in drafting proposed rules. 23 2 2. As used in this section, "vertical infrastructure" has 23 3 the same meaning as in section 8.57, subsection 5, paragraph 23 4 "c". 23 5 Sec. 32. Section 174.1, subsection 1, Code 1997, is 23 6 amended to read as follows: 23 7 1. "Fair" shall meana bona fide exhibition of23 8agricultural, dairy, and kindred products, livestock, and farm23 9implementsan annual gathering of people that incorporates 23 10 agricultural exhibits, shows, or competition which has the 23 11 following activities: 23 12 a. Extension, 4-H, or future farmers of America programs. 23 13 b. Commercial and educational exhibits. 23 14 c. Competition in the fine or home craft arts. 23 15 Sec. 33. Section 174.9, unnumbered paragraph 1, Code 1997, 23 16 is amended to read as follows: 23 17 Each eligible society which is a member of the association 23 18 of Iowa fairs and which conducts a county fair shall be 23 19 entitled to receive aid from the state as provided in this 23 20 chapter. In order to be eligible for state aid, a society 23 21 must file with thetreasurer of stateIowa state fair 23 22 foundation, as established in section 173.22, on or before 23 23 November 1 of each year, a statement which shall show: 23 24 Sec. 34. Section 174.9, subsection 4, Code 1997, is 23 25 amended to read as follows: 23 26 4. A copy of the published financial statement published 23 27 as required by law, together with proof of such publication 23 28 and a certified statement showing an itemized list of premiums 23 29 awarded, and such other information as thetreasurer of state23 30 Iowa state fair foundation may require. 23 31 Sec. 35. Section 174.10, Code 1997, is amended to read as 23 32 follows: 23 33 174.10 APPROPRIATION AVAILABILITY. 23 34 1.Each county shall receive an equal share of any moneys23 35appropriated to support one or more societies conducting one24 1or more county fairs in that county, if the society or24 2societies are eligible for the state aid. MoneysAny moneys 24 3 appropriated for county or local fairs shall be paid directly 24 4 to each eligible society which conducts a fair which qualifies 24 5 for funding. 24 6 2. The association of Iowa fairs shall provide the 24 7treasurer of stateIowa state fair foundation with a list of 24 8 each society in a county which is a member of the association 24 9 and conducts a fair in that county as provided in this 24 10 chapter. If a county has more than one fair, the association 24 11 shall list the name of each society conducting a fair in that 24 12 county for three or more years. Thetreasurer of stateIowa 24 13 state fair foundation shall not authorize payment of state aid 24 14 to a society, unless the society complies with section 174.9 24 15 and the name of the society appears on the association's list. 24 16 3.If a county has more than one fair eligible for state24 17aid, theThe amount of state aid forthat countyeach fair 24 18 which is eligible for state aid shall bedivided equally among24 19the eligible societies in that countyequal. 24 20 4. If no society in a county qualifies to receive state 24 21 aid, that county's share shall be divided equally among the 24 22 counties with societies eligible for state aid, as provided in 24 23 this section. 24 24 5.If an official county fair is designated by election,24 25the total amount of state aid for that county shall be paid to24 26that society determined to be conducting the official county24 27fair.The board of supervisors, upon receiving a petition 24 28 seeking to designate an official county fair which meets the 24 29 requirements of section 331.306, shall submit to the 24 30 registered voters of the county at the next general election 24 31 following submission of the petition or at a special election 24 32 if requested by the petitioners at no cost to the county, the 24 33 question of which fair shall be designated as the official 24 34 county fair. Notice of the election shall be given as 24 35 provided in section 49.53. The fair receiving a majority of 25 1 the votes cast on the question shall be designated the 25 2 official county fair. 25 3 Sec. 36. Section 174.12, unnumbered paragraph 1, Code 25 4 1997, is amended to read as follows: 25 5 The department of revenue and finance shall issue a warrant 25 6 to a society for the amount due in state aid, less five 25 7 hundred dollars, as provided in this chapter. Thetreasurer25 8of stateIowa state fair foundation must certify to the 25 9 department that the society is eligible under this chapter to 25 10 receive the amount due provided in section 174.10. The 25 11 department shall issue a warrant to the society for the 25 12 remaining five hundred dollars, if all of the following apply: 25 13 Sec. 37. NEW SECTION. 461A.3A RESTORE THE OUTDOORS 25 14 PROGRAM. 25 15 1. The department shall establish a restore the outdoors 25 16 program. The purpose of the program is to provide funding for 25 17 projects involving existing vertical infrastructure as defined 25 18 in section 8.57, subsection 5, paragraph "c", or the 25 19 construction of new vertical infrastructure if the new 25 20 construction is required due to increased demand for 25 21 facilities at the park or if it is not cost-effective to 25 22 repair or renovate the existing vertical infrastructure. 25 23 Projects shall be limited to existing state parks and other 25 24 public facilities managed by the department. 25 25 2. There is appropriated from the rebuild Iowa 25 26 infrastructure fund for each fiscal year of the fiscal period 25 27 beginning July 1, 1997, and ending June 30, 2001, the sum of 25 28 four million dollars to the department for use in the restore 25 29 the outdoors program of which, one million dollars shall be 25 30 used to fund projects in parks of governmental subdivisions 25 31 which are connected by a recreational trail to a state park or 25 32 the state recreational trail system. Notwithstanding section 25 33 8.33, unencumbered or unobligated moneys remaining at the end 25 34 of a fiscal year shall not revert but shall remain available 25 35 for expenditure during the following fiscal year for purposes 26 1 of the restore the outdoors program. 26 2 The department shall provide in its annual budget 26 3 documentations to the governor and general assembly a report 26 4 on the use of moneys under the program since the last report 26 5 and the projected use of future moneys. 26 6 26 7 26 8 26 9 RON J.
