PAG LIN 1 1 Section 1. Section 335.6, Code 1997, is amended by adding 1 2 the following new unnumbered paragraph: 1 3 NEW UNNUMBERED PARAGRAPH. If an ordinance containing a 1 4 regulation, restriction, or boundary is adopted in compliance 1 5 with this chapter, it shall take effect on the thirtieth day 1 6 following its adoption, unless within twenty-eight days 1 7 following its adoption the county auditor receives a petition 1 8 asking that an election be called to approve or reject the 1 9 action of the board in adopting the ordinance. The petition 1 10 shall meet the requirements of section 331.306, except that 1 11 only eligible electors who are residents of the unincorporated 1 12 area of the county may sign the petition. Within thirty days 1 13 after the petition is received by the county auditor, the 1 14 board shall either repeal the ordinance or direct the county 1 15 commissioner of elections to submit the question to the 1 16 registered voters of the unincorporated area of the county at 1 17 the next following general election. If a majority of those 1 18 voting on the question approves the ordinance, the ordinance 1 19 shall take effect January 1 following the election. If the 1 20 ordinance is rejected at the election, the ordinance is 1 21 repealed immediately. This paragraph applies only to the 1 22 adoption of zoning ordinances adopted pursuant to this chapter 1 23 on or after July 1, 1997. 1 24 EXPLANATION 1 25 This bill provides that an ordinance containing a zoning 1 26 regulation, restriction, or boundary is subject to referendum 1 27 by petition filed within 28 days of adoption of the ordinance. 1 28 The bill applies only to adoption of zoning ordinances 1 29 adopted on or after July 1, 1997. 1 30 LSB 1661HH 77 1 31 sc/jw/5.1
