  1  4 ELIMINATING NOTICE REQUIREMENTS RELATING TO THE LOCATION OF
  1  5    CERTAIN ELECTRIC TRANSMISSION LINES, WIRES, OR CABLES.

  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 
  1  8 
  1  9    Section 1.  Section 478.1, unnumbered paragraph 2, Code
  1 10 1997, is amended to read as follows:
  1 11    If the transmission line, wire, or cable is capable of
  1 12 operating only at an electric voltage of less than thirty-four
  1 13 and one-half kilovolts, no franchise is required.  However,
  1 14 the utilities board shall retain jurisdiction over all such
  1 15 lines, wires, or cables and shall prescribe the contents of a
  1 16 written notice and map to be timely provided to the board and
  1 17 affected parties including owners of electric supply lines
  1 18 located within six-tenths of one mile of proposed construction
  1 19 of such lines, wires or cables.  A person who seeks to
  1 20 construct, erect, maintain or operate a transmission line,
  1 21 wire, or cable which will operate at an electric voltage of
  1 22 less than thirty-four and one-half kilovolts outside of cities
  1 23 and which cannot secure the necessary voluntary easements to
  1 24 do so may petition the board pursuant to section 478.3,
  1 25 subsection 1, for a franchise granting authority for such
  1 26 construction, erection, maintenance, or operation, and for the
  1 27 use of the right of eminent domain.
