PAG LIN 1 1 Section 1. Section 239.10, Code 1997, is amended to read 1 2 as follows: 1 3 239.10 IMMUNIZATION. 1 4 1. a.To the extent feasible, theThe department shall 1 5determine the immunization status ofrequire immunizations of 1 6 children who are preschool age and are a member of a family 1 7 receiving assistance under this chapter.The status shall be1 8determinedThe department shall adopt rules setting forth the 1 9 immunization requirements which shall be in accordance with 1 10 the immunization recommendations adopted by the Iowa 1 11 department of public health under section 139.9, including the 1 12 exemption provisions in section 139.9, subsection 4.If the1 13department determines a child is not in compliance with the1 14immunization recommendations, the department shall refer the1 15child's parent or guardian to a local public health agency for1 16immunization services for the child and other members of the1 17child's family.The rules shall specify the types of 1 18 immunizations required, the age groupings to which the 1 19 requirements apply, and other provisions. The rules shall 1 20 also include exemptions for good cause or for factors beyond 1 21 the control of the child's parent, guardian, or custodian. 1 22 The exemptions shall be in addition to those established by 1 23 the Iowa department of public health. 1 24 b. Unless exempt by rule, a recipient family which is not 1 25 in compliance with an immunization requirement shall be 1 26 subject to sanction. The sanction shall be a deduction from 1 27 cash benefit assistance payable to the child's family in an 1 28 amount equivalent to twenty-five percent of the applicable 1 29 family investment program payment standard. The sanction 1 30 shall apply until the family complies with the immunization 1 31 requirement. 1 32 2. The department of human services shall cooperate with 1 33 the Iowa department of public health to establish an 1 34 interagency agreement allowing the sharing of pertinent client 1 35 data, as permitted under federal law and regulation, for the 2 1 purposes of determining immunization rates ofrecipients of2 2 persons receiving assistance, evaluating family investment 2 3 program efforts toencouragerequire immunizations, and 2 4 developing strategies to further encourage immunization of 2 5recipients ofpersons receiving assistance. 2 6 Sec. 2. EFFECTIVE DATE. This Act takes effect July 1, 2 7 1998. 2 8 EXPLANATION 2 9 This bill relates to recipient immunization requirements 2 10 under the family investment program. 2 11 Code section 239.10, relating to immunization of children 2 12 receiving assistance under the family investment program, is 2 13 amended to require immunization as a condition of the family 2 14 receiving assistance. The department of human services is 2 15 directed to provide in rule, exemptions to the requirement for 2 16 good cause and for factors beyond the parent's control. The 2 17 department is to sanction families who do not comply with the 2 18 immunization requirements. The sanction is a deduction from 2 19 cash assistance payable to the family until the family 2 20 complies. Current law is stricken which directs the 2 21 department to make a referral of a recipient family who does 2 22 not comply with the immunization provisions to a local public 2 23 health agency. 2 24 The bill takes effect July 1, 1998. 2 25 LSB 2344HV 77 2 26 jp/jj/8
