PAG LIN 1 1 Section 1. Section 206.6, subsection 1, Code 1997, is 1 2 amended by adding the following new unnumbered paragraph: 1 3 NEW UNNUMBERED PARAGRAPH. The secretary shall not issue a 1 4 new license to an applicant engaged in the business of 1 5 applying pesticides as part of a lawn care service, unless the 1 6 applicant has completed a number of hours in a course of study 1 7 regarding the sound practice of lawn care services at an 1 8 accredited educational institution or acquired an equivalent 1 9 understanding by experience, as provided by rules which shall 1 10 be adopted by the secretary. 1 11 Sec. 2. Section 206.17, Code 1997, is amended to read as 1 12 follows: 1 13 206.17 RECIPROCAL AGREEMENT. 1 14 The secretary may waive all or part of the following 1 15 requirements for a person who has satisfied substantially the 1 16 same requirements in another state, pursuant to a reciprocal 1 17 basis with the other state: 1 18 1. The examination requirements as provided for in 1 19 sections 206.6 and 206.7on a reciprocal basis with any other1 20state which has substantially the same standards. 1 21 2. The educational or experience requirements for 1 22 applicants engaged in the business of applying pesticides as 1 23 part of a lawn care service as provided in section 206.6. 1 24 EXPLANATION 1 25 This bill amends section 206.6, which provides licensure 1 26 requirements for persons engaged in the business of applying 1 27 pesticides. The bill provides that the secretary of 1 28 agriculture shall not issue a new license to an applicant 1 29 engaged in the business of applying pesticides as part of a 1 30 lawn care service, unless the applicant has completed a number 1 31 of hours in a course of study regarding the sound practice of 1 32 lawn care services at an accredited educational institution or 1 33 acquired an equivalent understanding by experience, as 1 34 provided by rules which shall be adopted by the secretary. 1 35 The bill also provides that the secretary may waive this 2 1 requirement if an applicant has satisfied similar requirements 2 2 in another state and the department has a reciprocal agreement 2 3 with the state. 2 4 LSB 1550HH 77 2 5 da/jj/8
