PAG LIN 1 1 Section 1. Section 321G.4, unnumbered paragraph 2, Code 1 2 1997, is amended to read as follows: 1 3 The owner of the all-terrain vehicle or snowmobile shall 1 4 file an application for registration with the appropriate 1 5 county recorder on forms provided by the commission. The 1 6 application shall be completed and signed by the owner of the 1 7 all-terrain vehicle or snowmobile and shall be accompanied by 1 8 a fee of twenty dollars and a writing fee. An all-terrain 1 9 vehicle or a snowmobile shall not be registered by the county 1 10 recorder until the county recorder is presented with receipts, 1 11 bills of sale, or other satisfactory evidence that the sales 1 12 or use tax has been paid for the purchase of the all-terrain 1 13 vehicle or snowmobile or that the owner is exempt from paying 1 14 the tax. However, an owner of an all-terrain vehicle, except 1 15 an all-terrain vehicle purchased new on or after January 1, 1 16 1990, may apply for registration without proof of sales or use 1 17 tax paid untilone year afterJanuary 1,19901998. Upon 1 18 receipt of the application in approved form accompanied by the 1 19 required fees, the county recorder shall enter it upon the 1 20 records and shall issue to the applicant a pocket-size 1 21 registration certificate. The certificate shall be executed 1 22 in triplicate, one copy to be delivered to the owner, one copy 1 23 to the commission, and one copy to be retained on file by the 1 24 county recorder. The registration certificate shall bear the 1 25 number awarded to the all-terrain vehicle or snowmobile and 1 26 the name and address of the owner. The registration 1 27 certificate shall be carried either in the all-terrain vehicle 1 28 or snowmobile or on the person of the operator of the machine 1 29 when in use. The operator of an all-terrain vehicle or 1 30 snowmobile shall exhibit the registration certificate to a 1 31 peace officer upon request, to a person injured in an accident 1 32 involving an all-terrain vehicle or snowmobile, or to the 1 33 owner or operator of another all-terrain vehicle or snowmobile 1 34 or the owner of personal or real property when the all-terrain 1 35 vehicle or snowmobile is involved in a collision or accident 2 1 of any nature with another all-terrain vehicle or snowmobile 2 2 or the property of another person or to the property owner or 2 3 tenant when the all-terrain vehicle or snowmobile is being 2 4 operated on private property without permission from the 2 5 property owner or tenant. 2 6 EXPLANATION 2 7 Current law requires the owner of an all-terrain vehicle to 2 8 register the vehicle with the county recorder every two years 2 9 unless the vehicle is exempt from registration under the 2 10 provisions of section 321G.8. However, the county recorder is 2 11 not allowed to register an all-terrain vehicle until the sales 2 12 or use tax is paid for the purchase of the vehicle, unless the 2 13 owner is exempted from the tax. Section 321G.4 allows the 2 14 owner of an all-terrain vehicle, except an all-terrain vehicle 2 15 purchased new on or after January 1, 1990, to apply for 2 16 registration without proof of sales or use tax paid until 2 17 January 1, 1990. 2 18 This bill extends the date to January 1, 1998, so that an 2 19 all-terrain vehicle purchased prior to January 1, 1990, could 2 20 be registered until January 1, 1998, without showing proof of 2 21 sales or use tax paid. 2 22 LSB 2262HH 77 2 23 mk/cf/24
