PAG LIN 1 1 Section 1. Section 7D.10, Code 1997, is amended to read as 1 2 follows: 1 3 7D.10 COURT COSTS. 1 4 1. If sufficient funds for court costs have not been 1 5 appropriated to a state department, or if sufficient funds are 1 6 not otherwise available for such purposes within the budget of 1 7 a state department, the executive council may pay,out of any1 8money in the state treasury not otherwisefrom moneys 1 9 appropriated in subsection 2, expenses incurred, or costs 1 10 taxed to the state, in any proceeding brought by or against 1 11 any of the state departments or in which the state is a party 1 12 or is interested. This section shall not be construed to 1 13 authorize the payment of travel or other personal expenses of 1 14 state officers or employees. 1 15 2. There is appropriated from the general fund of the 1 16 state to the executive council for each fiscal year, twenty- 1 17 five thousand dollars, to be used for the purposes of 1 18 subsection 1 in accordance with this subsection. If the 1 19 moneys appropriated in this subsection are fully obligated for 1 20 a fiscal year, a state department requiring funding for 1 21 purposes of subsection 1 shall submit a request to the general 1 22 assembly for an appropriation. 1 23 EXPLANATION 1 24 This bill limits a standing unlimited appropriation to the 1 25 executive council for costs associated with court proceedings 1 26 to which the state is a party or has an interest and there is 1 27 insufficient funding in a state department's budget to pay the 1 28 costs. 1 29 The bill amends Code section 7D.10 to limit the standing 1 30 appropriation to $25,000 for each fiscal year. If this amount 1 31 is fully obligated, a state department requiring funding for 1 32 the court costs must obtain funding for the court costs by 1 33 submiting an appropriation request to the general assembly. 1 34 LSB 1741HH 77 1 35 jp/cf/24.1
