1 1 Section 1. Section 301.28, Code 1997, is amended by
1 2 striking the section and inserting in lieu thereof the
1 3 following:
1 4 301.28 OFFICERS AND TEACHERS AS AGENTS FOR BOOKS AND
1 5 SUPPLIES.
1 6 A school director, officer, area education director, or
1 7 teacher who knowingly acts as an agent for school textbooks or
1 8 school supplies within the district of office or employment
1 9 during the term of office or employment commits a serious
1 10 misdemeanor.
1 11 Sec. 2. EFFECTIVE DATE. This Act, being deemed of
1 12 immediate importance, takes effect upon enactment.
1 13 EXPLANATION
1 14 This bill strikes a current prohibition which provides that
1 15 a school director, officer, area education director, or
1 16 teacher who acts as an agent for school textbooks or school
1 17 supplies in any state district during the term of office or
1 18 employment commits a serious misdemeanor.
1 19 The bill permits a school director, officer, area education
1 20 director, or teacher to act as an agent for school textbooks
1 21 or school supplies in districts outside of the person's
1 22 district of office or employment during the term of office or
1 23 employment. However, under the bill, it will remain a serious
1 24 misdemeanor for such a person to act as an agent for school
1 25 textbooks or school supplies within the district during the
1 26 term of office or employment.
1 27 The bill takes effect upon enactment.
