1 1 Section 1. NEW SECTION. 331.424C MENTAL HEALTH, MENTAL
1 2 RETARDATION, AND DEVELOPMENTAL DISABILITIES SERVICES
1 3 SUPPLEMENTAL LEVY.
1 4 1. To the extent that the levy for the services fund under
1 5 section 331.424A is insufficient to meet the county's need for
1 6 services under section 331.424A, the board of supervisors may
1 7 certify a supplemental levy as provided in this section.
1 8 2. a. If recommended and approved in accordance with
1 9 paragraph "b" for each fiscal year, to the extent not included
1 10 by the county in the levy under section 331.424A, a
1 11 supplemental levy under this section is authorized for the
1 12 administrative costs for the fiscal year associated with the
1 13 county's implementation of the county's management plan for
1 14 mental health, mental retardation, and developmental
1 15 disabilities services in accordance with section 331.439,
1 16 subsection 1, paragraphs "b", "c", and "d".
1 17 b. If the county board of supervisors projects that
1 18 revenues available for expenditure in the county's services
1 19 fund under section 331.424A for the succeeding fiscal year
1 20 will be insufficient to pay all of the costs chargeable to the
1 21 services fund in the succeeding fiscal year, the board may
1 22 annually certify a levy under this section for the
1 23 administrative costs described in paragraph "a" provided all
1 24 of the following conditions are met:
1 25 (1) The board of supervisors submits a request for review
1 26 of the county's projected revenues and expenditures for the
1 27 services fund to the state-county management committee and the
1 28 committee concurs that the projections are reasonable.
1 29 (2) Following the concurrence of the state-county
1 30 management committee under subparagraph (1), the board of
1 31 supervisors adopts a resolution authorizing a supplemental
1 32 levy under this section for the administrative costs described
1 33 in paragraph "a" and the resolution specifies the amount of
1 34 administrative costs to be raised by the levy.
1 35 3. Property tax dollars levied under this section shall be
2 1 deposited into the county's services fund created in section
2 2 331.424A.
2 3 Sec. 2. APPLICABILITY. The levy authority in section
2 4 331.424C as enacted by this Act first applies to taxes payable
2 5 in the fiscal year beginning July 1, 1998.
2 6 EXPLANATION
2 7 This bill authorizes under certain circumstances a county
2 8 to certify a supplemental levy on an annual basis for
2 9 administrative costs associated with the county's
2 10 implementation of service management provisions for mental
2 11 health services or for mental retardation and developmental
2 12 disabilities services in accordance with the county's approved
2 13 management plans under section 331.439. Section 331.439
2 14 requires the county, as a condition of state funding
2 15 provisions, to implement the service management provisions for
2 16 mental health by July 1, 1996, and for mental retardation and
2 17 developmental disabilities on or before January 1, 1997.
2 18 To exercise the supplemental levy authority, a county board
2 19 of supervisors must project that revenues for the county's
2 20 mental health, mental retardation, and developmental
2 21 disabilities services fund will not be sufficient to pay all
2 22 of the costs chargeable to the fund in the fiscal year. In
2 23 addition, the board must obtain the concurrence of the state-
2 24 county management committee for the board's projections and
2 25 adopt a resolution authorizing the levy.
2 26 An applicability section provides that the supplemental
2 27 levy authority first applies to taxes payable in the fiscal
2 28 year beginning July 1, 1998.
