1 1 Section 1. Section 232.2, subsection 42, Code 1997, is
1 2 amended to read as follows:
1 3 42. "Physical abuse or neglect" or "abuse or neglect"
1 4 means any nonaccidental physical injury suffered by a child as
1 5 the result of the acts or omissions of the child's parent,
1 6 guardian, or custodian or other person legally responsible for
1 7 the child. Indicators of a physical injury include but are
1 8 not limited to a welt, bruise, mark, or other evidence of
1 9 physical injury which exists for a period of twenty-four hours
1 10 or more.
1 11 Sec. 2. Section 232.68, subsection 2, paragraph a, Code
1 12 1997, is amended to read as follows:
1 13 a. Any nonaccidental physical injury, or injury which is
1 14 at variance with the history given of it, suffered by a child
1 15 as the result of the acts or omissions of a person responsible
1 16 for the care of the child. Indicators of a physical injury
1 17 include but are not limited to a welt, bruise, mark, or other
1 18 evidence of injury which exists for a period of twenty-four
1 19 hours or more.
1 20 EXPLANATION
1 21 This bill establishes physical injury indicators of child
1 22 abuse and physical abuse and neglect as used in the juvenile
1 23 justice code (Code chapter 232).
1 24 The definition of physical abuse or neglect and abuse or
1 25 neglect in Code section 232.2 is amended to provide indicators
1 26 of physical injury. Indicators include but are not limited to
1 27 a welt, bruise, mark, or other evidence of injury which exists
1 28 for a period of 24 hours or more.
1 29 The definition of child abuse in Code section 232.68 is
1 30 amended with similar language.
