1 1 Section 1. NEW SECTION. 136E.1 WARNINGS OF RISKS
1 2 ASSOCIATED WITH ALCOHOL.
1 3 1. A person in the course of doing business who holds a
1 4 license or permit under chapter 123 to sell alcoholic
1 5 beverages for consumption on the premises shall not knowingly
1 6 and intentionally expose another person to alcoholic beverages
1 7 which have been linked to birth defects without providing a
1 8 warning as prescribed by rule of the Iowa department of public
1 9 health.
1 10 2. The Iowa department of public health shall adopt rules
1 11 which require a warning regarding the risks associated with
1 12 the use of alcoholic beverages during pregnancy in the form of
1 13 a sign posted in the restrooms of the establishment.
1 14 3. A warning shall include the following language:
1 15 "WARNING: Drinking alcoholic beverages during pregnancy may
1 16 cause birth defects".
1 17 4. A person who does not provide a warning as prescribed
1 18 under this section is guilty of a simple misdemeanor.
1 19 EXPLANATION
1 20 This bill requires persons who hold a license or permit to
1 21 sell alcoholic beverages to post signs in the restrooms of the
1 22 establishment to provide warnings of the risks associated with
1 23 drinking alcohol during pregnancy. A person who does not
1 24 provide the warning is guilty of a simple misdemeanor.
