1 3 #1. Page 28, by inserting after line 19 the
1 4 following:
1 5 "Division XI
1 6 VISITATION – DEVIATION FROM GUIDELINES
1 7 Sec. ___. Section 598.21, Code Supplement 1997, is
1 8 amended by adding the following new subsection:
1 9 NEW SUBSECTION. 4C. If visitation is awarded to a
1 10 parent in excess of the average liberal visitation
1 11 rights award, the court shall do all of the following:
1 12 a. Deem the presumption that the amount of child
1 13 support which would result from application of the
1 14 guidelines prescribed by the supreme court is the
1 15 correct amount of child support rebutted.
1 16 b. Deviate from the guidelines in calculating the
1 17 child support obligation.
1 18 c. Provide a record or written finding that
1 19 application of the child support guidelines under such
1 20 award of visitation rights would be unjust or
1 21 inappropriate."
