1 3 #1. Page 66, by inserting after line 27, the
1 4 following:
1 5 "Sec. ___. HAWK-I TRUST FUND.
1 6 1. If House File 2517 is enacted by the Seventy-
1 7 seventh General Assembly, 1998 Session, a HAWK-I trust
1 8 fund is created in the state treasury under the
1 9 authority of the department of human services, to
1 10 which all state appropriations shall be deposited and
1 11 used to carry out the purposes of this chapter. Other
1 12 revenues of the program such as grants, contributions,
1 13 and participant payments shall not be considered
1 14 revenue of the state, but rather shall be funds of the
1 15 program.
1 16 2. The trust fund shall be separate from the
1 17 general fund of the state and shall not be considered
1 18 part of the general fund of the state. The moneys in
1 19 the trust fund are not subject to section 8.33 and
1 20 shall not be transferred, used, obligated,
1 21 appropriated, or otherwise encumbered except as
1 22 provided in this chapter. Notwithstanding section
1 23 12C.7, subsection 2, interest or earnings on moneys
1 24 deposited in the trust fund shall be credited to the
1 25 trust fund."
