  1  1    Amend Senate File 2119, as passed by the Senate, as
  1  2 follows:
  1  3    #1.  Page 2, by inserting after line 2 the
  1  4 following:
  1  5    "Sec. ___.  Section 185C.27, Code 1997, is amended
  1  6 to read as follows:
  1  7    185C.27  REFUND OF ASSESSMENT.
  1  8    A producer who has sold corn and had a state
  1  9 assessment deducted from the sale price, by
  1 10 application in writing to the board, may secure a
  1 11 refund in the amount deducted.  The refund shall be
  1 12 payable only when the application shall have been made
  1 13 to the board within sixty one hundred eighty days
  1 14 after the deduction.  Application forms shall be given
  1 15 by the board to each first purchaser when requested
  1 16 and the first purchaser shall make the applications
  1 17 available to any producer.  Each application for
  1 18 refund by a producer shall have attached to the
  1 19 application proof of the assessment deducted.  The
  1 20 proof of assessment may be in the form of a duplicate
  1 21 or certified copy of the purchase invoice by the first
  1 22 purchaser.  The board shall have thirty days from the
  1 23 date the application for refund is received to remit
  1 24 the refund to the producer.  The board may provide for
  1 25 refunds of a federal assessment as provided by federal
  1 26 law.  Unless inconsistent with federal law, refunds
  1 27 shall be made under section 185C.26."
