  1  1    Amend House File 2282 as follows:
  1  2    #1.  Page 8, by inserting after line 20 the
  1  3 following:
  1  4    "Sec. ___.  Section 298.2, Code Supplement 1997, is
  1  5 amended by adding the following new subsection:
  1  6    NEW SUBSECTION.  7.  There is appropriated annually
  1  7 from the general fund of the state to the department
  1  8 of management for the school budget year beginning
  1  9 July 1, 1998, and succeeding budget years, an amount
  1 10 sufficient to equalize the regular physical plant and
  1 11 equipment levy across all school districts having
  1 12 imposed the regular levy at the rate of ninety-two
  1 13 dollars and fifty cents per pupil.  The funds
  1 14 appropriated shall be allocated as follows:
  1 15    a.  For each school district which has imposed the
  1 16 regular physical plant and equipment levy pursuant to
  1 17 this section for the budget year, the department of
  1 18 management shall, by April 15 of the base year,
  1 19 determine whether, and the amount by which, the
  1 20 regular physical plant and equipment levy property tax
  1 21 revenue generated in the school district for the
  1 22 budget year falls below the amount of ninety-two
  1 23 dollars and fifty cents per pupil.  In making this
  1 24 determination, the department shall utilize the most
  1 25 recent figures available for the district's valuation
  1 26 of taxable property and the actual enrollment
  1 27 certified to the department by the department of
  1 28 education for the base year.
  1 29    b.  If it is determined that the property tax
  1 30 revenue generated by the regular physical plant and
  1 31 equipment levy for a school district is less than
  1 32 ninety-two dollars and fifty cents per pupil, the
  1 33 department of management shall deposit, for each
  1 34 school district experiencing a shortfall, an amount
  1 35 equal to the difference between the amount of revenue
  1 36 generated by the school district pursuant to the
  1 37 regular physical plant and equipment levy and the
  1 38 figure of ninety-two dollars and fifty cents per
  1 39 pupil, to the credit of the district in the physical
  1 40 plant and equipment levy fund by September 15 of the
  1 41 budget year.  Amounts credited shall be added to the
  1 42 revenue generated from the regular and, if applicable,
  1 43 voter-approved physical plant and equipment levies as
  1 44 provided in this section and expended as provided in
  1 45 section 298.3."
  1 46    #2.  Title page, line 1, by inserting after the
  1 47 word "Act" the following:  "relating to the funds
  1 48 available to school districts for infrastructure
  1 49 needs,".
  1 50    #3.  Title page, line 3, by inserting after the
  2  1 word "bonds," the following:  "providing for the
  2  2 equalization of the regular physical plant and
  2  3 equipment levy, making an appropriation,".
  2  4    #4.  By renumbering as necessary.
