  1  1    Amend Senate File 429, as amended, passed, and
  1  2 reprinted by the Senate, as follows:
  1  3    #1.  Page 1, by inserting after line 25 the
  1  4 following:
  1  5    "Sec.    .  NEW SECTION.  462A.9A  WATERCRAFT
  1  6 SAFETY COURSES – CERTIFICATION REQUIRED.
  1  7    1.  The department shall establish a personal
  1  8 watercraft safety course approved by the commission
  1  9 not later than January 15, 1999.  The personal
  1 10 watercraft safety course shall be administered by the
  1 11 department and shall be taught in at least twelve
  1 12 counties commencing January 15, 1999.  Each person who
  1 13 successfully completes an approved personal watercraft
  1 14 safety course shall be issued a personal watercraft
  1 15 safety certificate.
  1 16    2.  Not later than January 15, 2001, the department
  1 17 shall establish a watercraft safety course approved by
  1 18 the commission.  The watercraft safety course shall
  1 19 include all watercraft including personal watercraft
  1 20 in its curriculum and shall be taught in at least one-
  1 21 half of the counties of this state.  Each person who
  1 22 successfully completes an approved personal watercraft
  1 23 safety course shall be issued a watercraft safety
  1 24 certificate."
  1 25    #2.  Page 1, line 30, by striking the word
  1 26 "eighteen" and inserting the following:  "sixteen".
  1 27    #3.  Page 2, by striking lines 6 through 17 and
  1 28 inserting the following:
  1 29    "Sec.    .  Section 462A.12, subsection 6, Code
  1 30 1997, is amended by striking the subsection and
  1 31 inserting in lieu thereof the following:
  1 32    6.  a.  An owner or operator of any vessel
  1 33 propelled by a motor of more than six horsepower shall
  1 34 not permit any person under twelve years of age to
  1 35 operate the vessel unless accompanied by a responsible
  1 36 person of at least eighteen years of age.  However,
  1 37 commencing May 18, 2001, a person who is twelve years
  1 38 of age or older but less than sixteen years of age
  1 39 shall not operate any vessel propelled by a motor of
  1 40 more than six horsepower unless accompanied by a
  1 41 responsible person of at least eighteen years of age
  1 42 or unless the person under sixteen years of age has
  1 43 successfully completed an approved watercraft safety
  1 44 course.
  1 45    b.  After May 18, 1999, an owner or operator of a
  1 46 personal watercraft shall not permit any person who is
  1 47 under sixteen years of age to operate a personal
  1 48 watercraft unless accompanied by a responsible person
  1 49 of at least eighteen years of age or unless the person
  1 50 under sixteen years of age has successfully completed
  2  1 an approved personal watercraft safety course."
  2  2    #4.  Page 2, line 26, by striking the word "eight"
  2  3 and inserting the following:  "seven".
  2  4    #5.  Page 3, by striking lines 18 through 23 and
  2  5 inserting the following:  "subparagraph (2), Code
  2  6 1997, is amended by striking the subparagraph and
  2  7 inserting in lieu thereof the following:
  2  8    (2)  Motorboats or personal watercraft shall
  2  9 maintain a minimum passing or meeting distance of
  2 10 fifty feet when both vessels are traveling at speeds
  2 11 greater than five miles per hour in rivers or streams
  2 12 of this state except the Mississippi and Missouri
  2 13 rivers.  The minimum passing or meeting distance of
  2 14 one hundred feet shall be maintained by vessels
  2 15 traveling at speeds over five miles per hour on the
  2 16 Mississippi or Missouri rivers and other waters of the
  2 17 state."
