  1  1    Amend the Senate amendment, H-1775, to House File
  1  2 662, as amended, passed, and reprinted by the House,
  1  3 as follows:
  1  4    #1.  Page 1, by inserting after line 2 the
  1  5 following:
  1  6    "#   .  Page 1, by inserting before line 1 the
  1  7 following:
  1  8    "Section 1.  Section 13B.6, subsection 1, Code
  1  9 1997, is amended to read as follows:
  1 10    1.  There is established in the state general fund
  1 11 of the state an account to be known as the state
  1 12 public defender operating account.  The state public
  1 13 defender may bill a county for services rendered to
  1 14 the county by the office of the state public defender.
  1 15 Receipts shall be deposited in the operating account
  1 16 established under this section subsection.  There is
  1 17 appropriated from the state general fund of the state
  1 18 all amounts deposited in the state public defender
  1 19 operating account for use in maintaining the
  1 20 operations of the office of state public defender.
  1 21    1A.  There is established in the general fund of
  1 22 the state an account to be known as the indigent
  1 23 defense assessment fee account.  Receipts shall be
  1 24 deposited in the account established under this
  1 25 subsection as required by law.  There is appropriated
  1 26 from the general fund of the state all amounts
  1 27 deposited in the indigent defense fee assessment
  1 28 account for payment by the state public defender of
  1 29 any shortfalls which may arise in the state public
  1 30 defender operating account for payment of court-
  1 31 appointed attorney fees."
  1 32    #   .  By striking page 1, line 35, through page 2,
  1 33 line 30, and inserting the following:
  1 34    "Sec. ___.  Section 602.8106, subsection 1, Code
  1 35 1997, is amended by adding the following new
  1 36 paragraph:
  1 37    NEW PARAGRAPH.  g.  For the filing of an affidavit
  1 38 of financial status for a determination of indigency
  1 39 and qualification for court-appointed counsel under
  1 40 section 815.9, thirty dollars.
  1 41    Sec. ___.  Section 602.8107, subsection 2,
  1 42 paragraph d, Code 1997, is amended to read as follows:
  1 43    d.  Court costs, including correctional fees
  1 44 assessed pursuant to sections 356.7 and 904.108,
  1 45 court-appointed attorney fees, or public defender
  1 46 expenses, and assessment fees under section 815.9.
  1 47    Sec. ___.  Section 602.8108, subsection 2, Code
  1 48 1997, is amended to read as follows:
  1 49    2.  Except as otherwise provided, the clerk of the
  1 50 district court shall report and submit to the state
  2  1 court administrator, not later than the fifteenth day
  2  2 of each month, the fines and fees received during the
  2  3 preceding calendar month.  Except as provided in
  2  4 subsections 4, and 5, and 6, the state court
  2  5 administrator shall deposit the amounts received with
  2  6 the treasurer of state for deposit in the general fund
  2  7 of the state.  The state court administrator shall
  2  8 report to the legislative fiscal bureau within thirty
  2  9 days of the beginning of each fiscal quarter the
  2 10 amount received during the previous quarter in the
  2 11 account established under this section.
  2 12    Sec. ___.  Section 602.8108, Code 1997, is amended
  2 13 by adding the following new subsection:
  2 14    NEW SUBSECTION.  6.  The state court administrator
  2 15 shall deposit any amounts received as a result of the
  2 16 imposition of an assessment fee under section 815.9
  2 17 with the treasurer of state for deposit of the
  2 18 receipts in the indigent defense assessment fee
  2 19 account established in section 13B.6.""

  2 21 following:
  2 22    "#   .  By striking page 7, line 33, through page
  2 23 8, line 29, and inserting the following:
  2 24    "Sec. ___.  Section 815.9A, subsections 1, 2, and
  2 25 3, Code 1997, are amended by striking the
  2 26 subsections.""
