House Amendment 1896

Amendment Text

PAG LIN
1 1 Amend the amendment, H-1866, to Senate File 549, as
1 2 amended, passed, and reprinted by the Senate, as
  1 3 follows:
  1 4 #1. Page 7, line 23, by striking the word ""Sec."
1 5 and inserting the following:
  1 6 ""Sec. ___. Section 282.18, subsection 10, Code
1 7 1997, is amended to read as follows:
  1 8 10. Notwithstanding section 285.1 relating to
1 9 transportation of nonresident pupils, the parent or
1 10 guardian is responsible for transporting the pupil
1 11 without reimbursement to and from a point on a regular
1 12 school bus route of the receiving district. However,
1 13 a receiving district may send school vehicles into the
1 14 district of residence of the pupil using the open
1 15 enrollment option under this section, for the purpose
1 16 of transporting the pupil to and from school in the
1 17 receiving district, if the boards of both the sending
1 18 and receiving districts agree to this arrangement. If
1 19 the pupil meets the economic eligibility requirements
1 20 established by the department and state board of
1 21 education, the sending district is responsible for
1 22 providing transportation or paying the pro rata cost
1 23 of the transportation to a parent or guardian for
1 24 transporting the pupil to and from a point on a
1 25 regular school bus route of a contiguous receiving
1 26 district unless the cost of providing transportation
1 27 or the pro rata cost of the transportation to a parent
1 28 or guardian exceeds the average transportation cost
1 29 per pupil transported for the previous school year in
1 30 the district. If the cost exceeds the average
1 31 transportation cost per pupil transported for the
1 32 previous school year, the sending district shall only
1 33 be responsible for that average per pupil amount. A
1 34 sending district which provides transportation for a
1 35 pupil to a contiguous receiving district under this
1 36 subsection may withhold from the district cost per
1 37 pupil amount, that is to be paid to the receiving
1 38 district, an amount which represents the average or
1 39 pro rata cost per pupil for transportation, whichever
  1 40 is less.
  1 41 Sec."
