1 2 #1. By striking page 1, line 31, through page 4,
1 3 line 10, and inserting the following:
1 4 "Sec. ___. Section 614.1, Code 1997, is amended by
1 5 adding the following new subsection:
1 6 NEW SUBSECTION. 2A. WITH RESPECT TO PRODUCTS.
1 7 Those founded on the death of a person or injuries to
1 8 the person or property brought against the
1 9 manufacturer, assembler, designer, supplier of
1 10 specifications, seller, lessor, or distributor of a
1 11 product based upon an alleged defect in the design,
1 12 inspection, testing, manufacturing, formulation,
1 13 marketing, packaging, warning, labeling of the
1 14 product, or any other alleged defect or failure of
1 15 whatever nature or kind, based on the theories of
1 16 strict liability in tort, negligence, or breach of an
1 17 implied warranty shall not be commenced more than
1 18 twelve years after the product was first purchased,
1 19 leased, bailed, or installed for use or consumption
1 20 unless expressly warranted for a longer period of time
1 21 by the manufacturer, assembler, designer, supplier of
1 22 specifications, seller, lessor, or distributor of the
1 23 product. This subsection shall not affect the time
1 24 during which a person found liable may seek and obtain
1 25 contribution or indemnity from another person whose
1 26 actual fault caused a product to be defective. This
1 27 subsection shall not apply if the manufacturer,
1 28 assembler, designer, supplier of specifications,
1 29 seller, lessor, or distributor of the product
1 30 intentionally misrepresents facts about the product or
1 31 fraudulently conceals information about the product
1 32 and that conduct was a substantial cause of the
1 33 claimant's harm."
