  1  1    Amend House File 708 as follows:
  1  2    #1.  Page 17, by inserting after line 18 the
  1  3 following:
  1  4    "Sec. ___.  APPROPRIATIONS CONDITIONAL UPON
  1  5 ADOPTION OF A SPECIAL BUILDING CODE – CONFINEMENT
  1  6 FEEDING OPERATIONS.  As a condition of the
  1  7 appropriation made to the department of natural
  1  8 resources pursuant to section 11 of this Act, the
  1  9 department shall by rule adopted pursuant to chapter
  1 10 17A establish a building code which applies to animal
  1 11 feeding operation structures which are part of a
  1 12 confinement feeding operation, if the confinement
  1 13 feeding operation confines swine and has an animal
  1 14 weight capacity of more than two hundred thousand
  1 15 pounds, as provided in chapter 455B.  The department's
  1 16 building code shall be based on provisions submitted
  1 17 to the department by the animal agriculture consulting
  1 18 organization as created pursuant to 1995 Iowa Acts,
  1 19 chapter 195, section 37.  The building code shall be
  1 20 adopted in consultation with the state building code
  1 21 commissioner as provided in chapter 103A, and may be
  1 22 administered and enforced by a county independently of
  1 23 authority to administer and enforce a county building
  1 24 code as provided in section 331.304."
