1 6 "___. To the department of natural resources for
1 7 testing of animal feeding operations and their
1 8 structures, in accordance with this subsection:
1 9 .................................................. $ 200,000
1 10 The department of natural resources shall utilize
1 11 the moneys appropriated in this subsection to perform
1 12 testing of animal feeding operations and their
1 13 structures, including confinement feeding operations
1 14 and confinement feeding operation structures all as
1 15 defined in section 455B.161, and manure management and
1 16 disposal systems used by such operations. The
1 17 operations and their structures or systems must have
1 18 been constructed or installed on or before July 1,
1 19 1992. The testing shall be for the purpose of
1 20 determining the extent to which animal feeding
1 21 operations and their structures and manure management
1 22 and disposal systems contribute to point and nonpoint
1 23 contamination of the state's groundwater and surface
1 24 water. The testing shall be based on factors
1 25 established cooperatively by the department and Iowa
1 26 state university. The factors shall be evaluated in
1 27 accordance with standards, criteria, and protocols
1 28 established cooperatively by the department and Iowa
1 29 state university. A person owning or operating an
1 30 animal feeding operation may cooperate with the
1 31 department in carrying out this subsection. The
1 32 identity of the animal feeding operations shall be
1 33 confidential and information regarding the identity of
1 34 the animal feeding operation shall not be subject to
1 35 disclosure under chapter 22. The findings of the
1 36 testing shall not be used in a case or proceeding
1 37 brought against a person based upon a violation of
1 38 state law. The department shall report its findings
1 39 and recommendations to the general assembly not later
1 40 than January 15, 1999. Notwithstanding section 8.33,
1 41 moneys appropriated pursuant to this subsection shall
1 42 not revert until January 15, 1999."
