  1  1    Amend House File 612 as follows:
  1  2    #1.  Page 132, by inserting after line 5, the
  1  3 following:
  1  4    "Sec. ___.  Section 600B.41A, Code 1997, is amended
  1  5 by adding the following new subsection:
  1  6    NEW SUBSECTION.  6A.  a.  If the court determines
  1  7 that test results conducted in accordance with section
  1  8 600B.41 or chapter 252F exclude the established father
  1  9 as the biological father, but the court dismisses the
  1 10 action to overcome paternity, and the criteria of
  1 11 paragraph "b" are met, the court shall enter an order
  1 12 which provides for all of the following:
  1 13    (1)  Relieves the established father of any or all
  1 14 future support obligations owed on behalf of the
  1 15 child, while preserving the paternity determination.
  1 16    (2)  Provides that any unpaid support due prior to
  1 17 the date the order determining that the established
  1 18 father is not the biological father is filed, is
  1 19 satisfied.
  1 20    b.  The court shall issue an order pursuant to
  1 21 paragraph "a" if all of the following criteria are
  1 22 met:
  1 23    (1)  The mother represented the established father
  1 24 as the biological father of the child in a court
  1 25 proceeding or in any documents submitted to the court
  1 26 or a state agency.
  1 27    (2)  The mother testified in court that a
  1 28 possibility exists that the established father is not
  1 29 the biological father of the child.
  1 30    c.  This subsection is applicable to any support
  1 31 order existing or entered on or after July 1, 1997.
  1 32    d.  Any costs associated with the action to
  1 33 overcome paternity under this section to which this
  1 34 subsection applies shall be paid by the mother."
