1 2 #1. Page 2, by inserting after line 17 the
1 3 following:
1 4 "Sec. . Section 135L.3, subsection 3, Code
1 5 1997, is amended by adding the following new
1 6 paragraph:
1 7 NEW PARAGRAPH. o. All records and files of a
1 8 court proceeding maintained under this section shall
1 9 be destroyed by the clerk of court when six months
1 10 have elapsed from any of the following, as applicable:
1 11 (1) The date that the court issues an order
1 12 waiving the notification requirements.
1 13 (2) The date after which the court denies the
1 14 petition for waiver of notification and the decision
1 15 is not appealed.
1 16 (3) The date after which the court denies the
1 17 petition for waiver of notification, the decision is
1 18 appealed, and all appeals are exhausted."
1 19 #2. Page 3, by inserting after line 16 the
1 20 following:
1 21 "Sec. . Section 602.8102, Code 1997, is amended
1 22 by adding the following new subsection:
1 23 NEW SUBSECTION. 31. Destroy all records and files
1 24 of a court proceeding maintained under section 135L.3
1 25 in accordance with section 135L.3, subsection 3,
1 26 paragraph "o"."
1 27 #3. By renumbering as necessary.
